According to the "Notice of the Municipal Government on Adjusting the Relevant Policies for the Settlement of Talents" (hereinafter referred to as the "Notice"), these operating rules are formulated in order to regulate the application, acceptance and audit of talents in our city.
I. Scope and target of services
(1) Individuals who meet the requirements of Article 1 of the Notice and are willing to settle down within the administrative area of this Municipality (hereinafter referred to as "individuals");
(2) The employing unit (hereinafter referred to as the "applicant") that applies for settlement for the employees of the unit who meet the requirements of Articles 2 and 3 of the Notice.
Second, the basic conditions for applying for settlement
(a) about the individual who applies for settlement.
1. conforms to the provisions of Article 1 of the Notice;
2. Obtaining all kinds of academic qualifications, degrees or professional titles according to law;
3. Failing to go through retirement formalities according to law.
(2) Units applying for settlement
1. Established in accordance with the law within the scope of this Municipality, and carried out normal production and business activities;
2. Standardize the establishment of a labor employment system, sign labor contracts according to law, and participate in social insurance according to regulations;
3. The employees to be settled meet the provisions of Articles 2 and 3 of the Notice;
4. The employees to be settled have obtained various academic qualifications, degrees or professional titles and national vocational qualifications (vocational skill levels) according to law.
With the national vocational qualification (vocational skill level) to apply for settlement of the employer, the occupation (type of work) specified in the national vocational qualification certificate (vocational skill level certificate) held by the employees who intend to settle down shall be publicly released with our city, and the items listed in the "Suzhou high-skilled talents shortage occupation (type of work) directory" are consistent during the implementation period.
Third, the application process
According to the requirements of the Notice, the settlement process is implemented in six steps: pre-trial, publicity, material submission, application acceptance, review and household registration transfer.
(1) Pre-trial
In principle, the pre-trial work implements online application. Individuals or units applying for settlement log on to the online business information platform of the public employment and talent service institutions in the place where they intend to settle down or where the units are located, and fill in the pre-application information and submit the pre-application materials one by one according to the platform prompts and requirements. Relevant public employment and talent service agencies shall, in principle, feed back the pre-trial results within 3 working days from the date of receiving the pre-application materials. If the application materials meet the requirements, a file transfer letter shall be issued and the publicity procedures shall be informed. Explaining the reasons for non-conformity or requesting materials for correction. Those suspected of violating laws and regulations may be handed over to relevant departments for investigation and handling.
The management service and vocational skill appraisal departments of professional and technical personnel at all levels in the city are responsible for the pre-examination of professional and technical titles and national vocational qualifications (vocational skill levels). After receiving the relevant materials, the public employment and talent service agencies will forward them to the local professional and technical personnel management service or professional skill appraisal department for pre-examination.
(2) publicity
The application for settlement shall be publicized. The forms of publicity include social publicity and internal publicity.
1. Social publicity. After preliminary examination, if the application materials meet the requirements, the public employment and talent service institutions at all levels shall publicize them through the website of the human society department and accept public supervision. The publicity period shall not be less than 5 working days.
2. Internal publicity of the unit. Units from the date of receiving the notice of publicity, publicity in the unit bulletin board or internal information system. The publicity period shall not be less than 5 working days, and truthfully feedback the publicity results to the accepting institution.
If there is no objection to the publicity, the unit or individual shall formally submit the application after the materials are complete. If there is any objection to the publicity, the informant may report it by letter or email published by the accepting institution during the publicity period. The accepting institution shall, within 30 working days from the date of receiving the report materials, organize the investigation and verification with relevant departments.
(III) Submission of materials
According to the requirements of the Notice, the applicant individuals and units shall submit the following materials respectively:
1. Materials on individual application for settlement
(1) Suzhou Talent Settlement Application Form;
(2) Education, degree or professional and technical title materials;
(3) personnel files;
(4) materials on household registration and marital status;
(5) Integrity commitment materials.
2. Materials about the application of the unit to settle down
(1) Suzhou Talent Settlement Application Form;
(2) Education, degree or professional title, national vocational qualification (vocational skill level) materials;
(3) personnel files;
(4) materials on household registration and marital status;
(5) Integrity commitment and publicity feedback materials;
(6) Social insurance materials.
3. Description of relevant application materials
(1) Academic qualifications and degree materials
According to the second paragraph of Article 1 of the Notice, applicants should submit their academic qualifications and degree materials at the same time.
(2) Household registration and marital status materials
① If you plan to settle in your own property, you need to submit your identity card, residence booklet or relationship certificate, and ownership certificate of the house you purchased;
(2) If you plan to settle in a collective household, you need to submit your resident ID card, household registration book and the home page of the collective household of the employer;
③ If you plan to settle in a talent collective household, you need to submit your ID card and residence booklet;
(4) those who intend to take refuge in their immediate family members shall submit their identity cards, household registration books, a statement that the trusted person and the owner of legally stable residence agree to move in, a certificate of the relationship between the trusted person and the trusted person, and a certificate of legally stable residence;
⑤ marital status materials. Married persons are required to submit marriage certificates, and divorced persons are required to submit divorce certificates (attached agreements) or court judgments, court mediation books, etc. A medical certificate of birth is required for minor children to move with them; Children born out of wedlock or divorced people move with them, and the direct dependents need to submit a child custody agreement notarized by the notary office or a divorce agreement filed by the civil affairs department or a court judgment, court mediation, etc.; If the unemployed unmarried children move with them, they need to submit a written undertaking of unemployment and unmarried;
⑥ The term "relationship certificate" as mentioned in this article includes household registration files, household registration books, marriage certificates, birth medical certificates, paternity test certificates, relationship notarial certificates issued by notary departments, etc.
⑦ Immediate family members mentioned in this article refer to my spouse, parents, children, grandparents, grandparents, grandchildren and grandchildren.
(4) Acceptance of the application
Individuals or units can formally submit applications after finishing the collection of application materials.
1. About individual application. The applicant himself shall submit the application materials to the public employment and talent service institution in the legally stable residence within the city or where he intends to settle down. According to the order of legally stable residence, relying on immediate family members and talent collective households, the place where the household registration is moved is determined.
Objects that meet the provisions of the second paragraph of Article 2 of the Notice may be handled with reference to the provisions of the preceding paragraph.
2. About the unit application. The applicant shall submit the application materials to the public employment and talent service institution where the registration place is located, and determine the place where the household registration moves in according to the order of legally stable residence, refuge with immediate family members, unit collective households and talent collective households.
3. In any of the following circumstances, the applicant shall not be accepted:
(1) The application materials are incomplete;
(2) failing to carry out internal publicity of the unit as required;
(3) The applicant is listed in the list of business anomalies by the market supervision and management department;
(4) the suspected illegal acts are handed over to the relevant departments for investigation, and during the investigation.
The accepting institution shall decide whether to accept the application within 3 working days after receiving the application materials. Those who meet the requirements for settlement and have complete application materials shall be accepted and enter the review process. Those who do not meet the conditions for settlement shall be informed of the reasons for rejection, and those whose application materials are incomplete shall be informed of the materials that need to be supplemented at one time.
(5) Audit
If the materials are complete, the accepting institution shall organize the examination and approval within 5 working days from the date of acceptance. After preliminary examination and review, those who meet the conditions for settlement will be issued with the approval of the person in charge of the accepting institution and forwarded to the public security organ where they intend to settle down.
In any of the following circumstances, the applicant shall not be approved:
1. The applicant fails to establish labor relations according to law and fails to pay social insurance as required;
2. The applicant is inconsistent with the unit that applied for the payment of social insurance premiums for employees;
3. According to the application in Article 3 of the Notice, the social insurance premium has not been paid, paid back, paid discontinuously or paid by the non-applicant within 6 months before accepting the application;
4. Providing false application materials or application information inconsistent with personnel files.
If the audit is not passed, the accepting institution shall timely feedback the information to the applicant or individual and explain the reasons.
(VI) Migration of household registration
The public security organ shall verify the identity information of individuals and accompanying personnel through the National Population Information Inquiry System within 2 working days after receiving the Registration Form of Suzhou Talents Settlement. Applicants who meet the requirements of "Jiangsu Inter-city Account Migration Business Collaborative Service Management System" for household registration migration in the province can fill in the "Application Form for Electronic Quasi-migration Permit" for one-stop migration. The public security organ in the place of immigration shall move to registered permanent residence within 3 working days after receiving the information of the transfer certificate of the public security organ in the place of emigration. The public security organ shall, according to its wishes, issue the Certificate of Permission to Move in on the spot or by mail to the applicant who meets the requirements for handling the household registration outside Jiangsu Province, and the applicant shall go through the formalities of moving to registered permanent residence, the original domicile. The public security organ shall handle it after receiving the Registration Form of Suzhou Talents Settlement, and the handling period shall not exceed 20 working days.
The applicant shall, in accordance with the notification from the public security organ and the corresponding requirements in Paragraph (3) of Article 3 of these Rules, carry the materials of household registration and marital status (the certificate of permission to move in and the certificate of household registration transfer are also required for household registration transfer outside the province), and go to the public security organ for settlement formalities in time.
IV. Supervision and Management
(a) human and social departments at all levels and public security organs should strengthen the supervision and management of the implementation of the talent settlement policy, regularly carry out data analysis and comparison, find problems in time, and urge rectification. It is necessary to strengthen the supervision and guidance of accepting institutions at all levels in all aspects of talent settlement application, acceptance, review and settlement, carry out examination and approval files in a timely manner, and continuously improve service quality.
(two) all levels of public employment and talent service agencies, responsible for the specific business of talents settled in the area, should establish and improve the talent settlement audit system, and implement the audit responsibility. It is necessary to formulate and improve the service guide, clearly explain the application materials, and establish electronic documents for the relevant application forms for the applicants and units to download and fill in.
(three) the applicant shall actively create conditions for the establishment of unit collective households, and the public security organs shall provide convenience for the applicant to set up unit collective households and smooth the settlement channels. Temporary unconditional establishment of unit collective households, can be settled in the public employment and talent service institutions talent collective households. The applicant should take the initiative to establish a file custody relationship with the public employment and talent service institutions in the registered place, and actively cooperate with the public employment and talent service institutions to do a good job in the management of the immigration, emigration and personnel changes of collective households. For applicants who are negligent in management, the public employment and talent service agencies may suspend or cancel the procedures for collective households to move in.
(four) the term "legally stable residence" as mentioned in these rules refers to the residential house that belongs to its own house ownership; Houses rented by tenants with public housing lease certificates; Public rental housing rented by low-and middle-income families with housing difficulties in urban areas. Legally stable residence does not include * * houses with property rights (except * * affordable housing with property rights, houses with property rights for spouses and minor children * *) and non-residential houses.
(five) these rules and the "Notice" shall be implemented simultaneously. If the previously issued documents are inconsistent with these rules, these rules shall prevail.
