As the mortgage loan only needs mortgage registration, it does not need to transfer the possession and use of the house, nor does it need to change the current lease status, so it does not affect the lessee to lease the house as agreed in the contract.
Three, the landlord can not repay the loan within the time limit stipulated in the loan contract, the bank has the right to sell or discount the house to repay the loan debt, so that the mortgage right is given priority.
When the ownership of the house changes, the lease contract will remain valid for the new owner until the lease term expires.
At the same time, in the process of ownership change, the lessee also enjoys the preemptive right under the same conditions.

Article 20 of the Supreme People's Court's Interpretation on Several Issues Concerning the Specific Application of Law in the Trial of Disputes over Urban Housing Lease Contracts: If the ownership of the leased house changes during the lease period and the lessee requests the transferee to continue to perform the original lease contract, the people's court shall support it. However, the leased house is under any of the following circumstances or unless otherwise agreed by the parties: (1) The house has been mortgaged before being leased, and the ownership has changed due to the mortgagee's realization of the mortgage right; (two) the house has been sealed up by the people's court before the lease.
Article 22 of the Supreme People's Court's Interpretation on Several Issues Concerning the Specific Application of Law in the Trial of Disputes over Urban House Lease Contracts: If the lessor and the mortgagee agree to discount or sell the leased house to pay off debts, they shall notify the lessee within a reasonable period of time. The people's court shall support the lessee's request for priority in purchasing houses under the same conditions.
