The land compensation fee for requisitioned cultivated land is 10 times of the average annual output value of the cultivated land in the three years before requisition. The minimum standards for the average annual output value of cultivated land in the first, second, third and fourth categories are per mu 1.800 yuan, 1.600 yuan, 1.400 yuan and 1.200 yuan respectively.
The resettlement subsidy for requisitioned cultivated land shall be calculated according to the number of landless farmers who need to be resettled. The number of land-expropriated farmers who need to be resettled shall be calculated according to the number of expropriated cultivated land divided by the average number of cultivated land occupied by each rural collective economic organization before land expropriation. The minimum subsidy standards for the first, second, third and fourth categories of landless peasants who need to be resettled are 20,000 yuan, 17000 yuan, 13000 yuan and1/000 yuan respectively.
Large and medium-sized water conservancy and hydropower projects land acquisition compensation standards and resettlement measures, in accordance with the relevant provisions of the State Council. The compensation standard for land acquisition in coal mining subsidence land shall be stipulated separately. The land compensation fee for requisition of other land and the land compensation fee and resettlement subsidy standard for requisition of other agricultural land shall be adjusted by the Municipal People's Government according to the Regulations of Jiangsu Province on Land Management and the above provisions.
Expropriation of land legally owned by farmers' collectives must be compensated and resettled in accordance with regulations. The land acquisition compensation and resettlement fees must be paid in full within 3 months from the date of approval of the land acquisition compensation and resettlement plan, and shall not be paid in installments. Land requisition compensation and resettlement are not in place, and collective land may not be forcibly used. If the rural collective economic organizations fail to adjust other land with the same quality and quantity to the land-expropriated farmers to continue the contracted operation, they must pay the land compensation fee of not less than 70% to the land-expropriated farmers. Land-expropriated farmers do not need unified resettlement, and all resettlement subsidies are paid to the resettled people. In accordance with the provisions, the compensation and resettlement fees for land acquisition that should be paid to farmers must be paid to farmers in full and on time, and it is strictly forbidden to deduct, occupy, intercept or use them for other purposes. Those who fail to pay compensation and resettlement fees according to regulations, or embezzle, occupy, intercept or use them for other purposes will be severely punished according to law.
