Trial Measures of Shanghai Municipality on the Administration of Affordable Housing

Chapter I: General Provisions

Article 1 (Purpose and Basis)

In order to establish and improve the city's housing security system and improve the living conditions of low-and middle-income families with housing difficulties, according to the State Council's "Several Opinions on Solving the Housing Difficulties of Urban Low-income Families" (Guo Fa [2007] No.24), with reference to the Measures for the Administration of Economically Affordable Housing of the former Ministry of Construction and other seven departments (F J [2007] No.258), combined with the actual situation of this Municipality, these Trial Measures are formulated.

Article 2 (Scope of Application)

These Trial Measures are applicable to the construction, supply, use, supervision and management of affordable housing within the administrative area of this Municipality.

The term "affordable housing" as mentioned in these Trial Measures refers to the policy housing provided by the government, which is built in accordance with relevant standards, limits the area, sales price and rent standard of Xing Tao, and faces low-income families with housing difficulties in cities and towns.

Article 3 (Administrative Department)

The municipal government set up a leading group for housing security, which is responsible for the decision-making and coordination of major issues such as the system, policies, plans and plans of affordable housing. The district (county) government is responsible for organizing the implementation of the construction, supply, use, supervision and management of affordable housing within its administrative area.

City Housing Security Housing Authority is the administrative department of affordable housing in this city. District (county) housing management department is the administrative department in charge of affordable housing within their respective administrative areas.

City and district (county) development and reform, urban and rural construction, land planning, finance, taxation, civil affairs and supervision departments in accordance with the division of responsibilities, responsible for the relevant management and supervision of affordable housing.

City Housing Security Housing Authority, district (county) housing management departments, sub-district offices and township governments set up housing security agencies to undertake the transactional work of affordable housing.

Chapter II: Construction of indemnificatory housing

Article 4 (Planning and Planning): The district (county) government shall, according to the district (county) housing security needs, the implementation of urban planning and the current situation of land use, organize the preparation of the district (county) affordable housing development plan and annual implementation plan, which will be incorporated into the city's affordable housing development plan and annual implementation plan after being comprehensively balanced by the Municipal Housing Security Housing Administration in conjunction with the municipal development and reform, urban and rural construction and other departments and reported to the municipal government for approval. Affordable housing construction land should be included in the annual land use plan management, and the municipal and district (county) planning and land departments should list it separately when arranging the annual land use indicators, and ensure the priority supply. Some central city governments in short supply of construction land may apply to the municipal government for overall arrangement of affordable housing construction land; Approved by the overall arrangement of affordable housing construction land, the application of the district government to organize the implementation of supply, and pay land occupation compensation fees in accordance with the relevant provisions.
