The essence of bad debts is fraud.

1. There is no collection business in the regular business of the bank.

2. The general purpose of back account business is to defraud loans, and fraudsters apply for loans in the name of being cheated. After getting a loan, you can get some money if you are cheated in form, but a large part of the loan is used by the liar, and all the loans need to be borne by the liar.

3. There is often a term "exemption agreement" in back-account fraud, which is actually an invalid agreement. Bad debts refer to fraudsters handling loans in the name of being cheated. After obtaining the loan, the fraudster can get most of the loan, while the deceived can only get a small part of the loan, and all the loans are borne by the deceived. If the perpetrator swindles a large amount of public and private property, he will be suspected of fraud.

Whoever defrauds public or private property in a relatively large amount shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or public surveillance, and shall also, or shall only, be fined; If the amount is huge or there are other serious circumstances, he shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years and shall also be fined; If the amount is especially huge or there are other especially serious circumstances, he shall be sentenced to fixed-term imprisonment of not less than 10 years or life imprisonment, and shall also be fined or confiscated. Where there are other provisions in this Law, such provisions shall prevail.

Legal basis:

Article 266 of the Criminal Law of People's Republic of China (PRC) stipulates that whoever defrauds public or private property in a relatively large amount shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or public surveillance, and shall also or only be fined; If the amount is huge or there are other serious circumstances, he shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years and shall also be fined; If the amount is especially huge or there are other especially serious circumstances, he shall be sentenced to fixed-term imprisonment of not less than 10 years or life imprisonment, and shall also be fined or confiscated.
