Chapter I General Provisions Article 1 In order to unify the management of urban and rural fair trade in the province, these detailed rules are formulated in accordance with the Measures for the Administration of Urban and Rural Fair Trade issued by the State Council and combined with the actual situation in our province. It has played an active role in promoting the development of production, invigorating the urban and rural economy, facilitating people's lives and supplementing the shortcomings of state-owned commerce. Article 3 The management of urban and rural fair trade should give full play to the auxiliary role of market regulation under the guidance of the state plan, and adhere to the principle of "living without chaos, managing without death". Through administrative management, the leading role of the state-owned economy and ideological education of the masses, the state protects legitimate business operations, stops illegal activities, and enlivens and manages urban and rural fair trade. Article 4 The administrative departments and competent departments of urban and rural fair trade are the administrative departments for industry and commerce. Public security, price, taxation, banking, transportation, culture, health, posts and telecommunications, urban construction, animal husbandry, metrology and other departments should give full play to their functions and cooperate with the administrative authorities for industry and commerce to do a good job in the management of urban and rural fair trade. Article 5 State-owned businesses should use economic means to regulate the supply and demand of commodities, stabilize prices and play a leading role in market trade.

State-owned businesses and supply and marketing cooperatives can conduct normal business activities such as bargaining, acquisition, purchase and sale, consignment, storage and transportation in the market. Article 6 All units and individuals participating in the fair trade shall abide by the provisions of these Detailed Rules, obey the administration of the administrative department for industry and commerce, and accept their inspection and supervision. No unit or individual may disturb the market order. Chapter II Establishment and Management of Urban and Rural Fairs Article 7 Urban and rural bazaars shall be incorporated into urban construction and commercial network planning by local people's governments, and shall be arranged in an overall way and set up reasonably in accordance with the principles of facilitating the circulation of commodities, facilitating the purchase and sale of the masses and not affecting traffic.

The people's governments of large and medium-sized cities should incorporate the construction of agricultural and sideline products market into the overall planning of the city's construction, adjust measures to local conditions, rationally lay out the scope of the site, implement the construction funds, improve the trading conditions, and earnestly strengthen management, so as to facilitate the prosperity of the farmers' market and maintain the urban traffic order and clean city appearance.

Urban and rural fairs should build some covered markets and permanent indoor markets in a planned way, gradually establish and improve service facilities, generally set the scale of fairs, and constantly improve market service conditions.

No unit or individual may occupy the service facilities of urban and rural fairs. Article 8 Commodities listed for sale shall be included in the market, sold in the designated market, and shall not be traded outside the market. In addition to the established pig, grain, egg and vegetable markets, large livestock markets can be established as needed; Material distribution centers should explore, restore and develop markets such as mountain products, native products, fruits and medicinal materials according to local conditions; Towns at or above the county level shall, according to the needs, establish a small commodity market with three types of industrial products as the mainstay and a professional market for secondhand goods, used bicycles and flowers.

The period of rural fairs shall be stipulated by the county (city) people's government.

Market managers must wear uniform signs, abide by managers' codes, conduct civilized management and serve courteously. Ninth to do a good job in urban and rural fairs, conscientiously implement the "People's Republic of China (PRC) Food Hygiene Law (Trial)" and the "Trial Measures for Food Hygiene Management of Rural Fair Trade" issued by the Ministry of Health and the State Administration for Industry and Commerce. Article 10 Local administrative departments for industry and commerce shall collect market management fees for commodities entering the market. The charging standards are: 2% of the sales of agricultural and sideline products in provinces and municipalities directly under the Central Government, 1.5% in rural markets at or below the county level, and 1% for large livestock and industrial products, with the charging starting point in 5 yuan.

State-owned and collective enterprises purchasing in urban and rural fairs shall pay a market management fee of 6/1000 of the amount of purchased goods.

Commodities purchased by state-owned businesses, supply and marketing cooperatives and food departments outside the market and raw materials purchased by industrial production enterprises according to regulations are not subject to market management fees.

State-owned and foreign collective enterprises purchase goods inside and outside the market or entrust enterprises of origin to pay a market management fee of 6/1000 according to the amount of purchased goods.

Undocumented individual traders who enter the market to purchase goods shall pay 2% of the market management fee according to the purchase amount.

Self-employed and state-owned and collective enterprises must obtain the consent of the administrative department for industry and commerce and pay a fixed market management fee when entering stalls or bazaars to set up their stalls. The fixed standard is decided by the municipal and state people's governments and regional administrative offices.

If the epidemic prevention department carries out quarantine work in the market, it may charge quarantine fees according to regulations. No other unit or individual may make an excuse to collect fees at the fair.

The market management fee is collected and remitted by the administrative department for industry and commerce, and the principle of use is "take it from the market and use it for the market". Mainly used for building the market, providing service facilities, carrying out publicity activities, improving the sanitation of the site, and hiring temporary service personnel or delaying payment in the market. No unit or individual may transfer or misappropriate it. Article 11 All tax paying units and individuals shall accept the supervision and inspection of the tax authorities and pay taxes in accordance with the provisions of the tax law. Chapter III Scope of Listed Materials Article 12 The first and second types of agricultural and sideline products of state-owned farms, forest farms, pastures, fishing grounds, agro-industrial enterprises, social groups and individual farmers are not allowed to be listed and traded, except cotton and musk, and other varieties are allowed to be listed and traded after completing the sales tasks stipulated by the state and fulfilling the contractual obligations. Three types of agricultural and sideline products and large livestock are allowed to be listed.
