Provisions of Nanjing Municipal People's Government on Entrusting Administrative Law Enforcement Matters
Article 1 In order to ensure the legality and effectiveness of administrative law enforcement activities of administrative organs, according to the Administrative Licensing Law of People's Republic of China (PRC), the Administrative Punishment Law of the People's Republic of China and other relevant laws and regulations, administrative organs may, within their functions and powers, entrust organs or organizations that meet the statutory conditions to exercise administrative law enforcement power. Article 2 The Nanjing Municipal People's Government entrusts the Nanjing Foreign Trade and Economic Cooperation Bureau and the foreign trade administrative departments of Xuanwu District, baixia district, Qinhuai District, jianye district, Gulou District, Xiaguan District, Qixia District, Yuhuatai District, Jiangning District, Pukou District, Liuhe District, Lishui County and Gaochun County and the Jiangning District Government (Jiangning Economic and Trade Department) to examine and approve the establishment, alteration, dissolution and termination of foreign-invested enterprises below the quota. Nanjing High-tech Development Zone Management Committee, Nanjing Economic and Technological Development Zone Management Committee and Nanjing Chemical Industrial Park Management Committee, as the agencies of the municipal government, exercise the same functions and powers as the above-mentioned entrusted organs according to law. Article 3 The following matters shall be entrusted by the competent department according to law:

(1) Nanjing Municipal Bureau of Public Utilities entrusts Jiangning District Transportation Bureau, Pukou District Transportation Bureau and Liuhe District Transportation Bureau to exercise the power of taxi business examination and approval, supervision and management and administrative punishment respectively.

(2) The Nanjing Municipal Development and Reform Commission entrusted the supervision and management rights and administrative punishment rights of the goods bidding market to the Nanjing mechanical and electrical equipment bidding management office.

(III) The Nanjing Municipal Labor and Social Security Bureau entrusts the Nanjing Municipal Center for the Settlement of Endowment Insurance of Institutions and Institutions and the Nanjing Vocational and Technical Training Guidance Center to exercise the right of collection, management, supervision and inspection of endowment insurance premiums of institutions and institutions and the right of supervision and management of vocational skills training institutions according to law. Article 4 A written power of attorney shall be signed for the entrustment of administrative law enforcement. The power of attorney shall be signed by the entrusting organ and the entrusted organ or organization. The power of attorney shall specify the name, basis, matters, authority, duration, legal responsibility and time of entrustment of the entrusting organ and the entrusted organ or organization. Article 5 The entrusted organ or organization must exercise the power of administrative law enforcement in the name of the entrusted organ within the scope of entrusted matters and authority.

The entrusted organ or organization may not entrust other organizations or individuals to exercise administrative law enforcement power. Article 6 The entrusting organ shall supervise and guide the administrative law enforcement acts carried out by the entrusted organ or organization according to law, and bear legal responsibility for the consequences of the entrusted acts. Article 7 These Provisions shall come into force as of August 6, 2006.
