Article 68 Civil servants who are related by husband and wife, lineal consanguinity, collateral consanguinity within three generations, and close in-laws shall not hold positions in the same organ where both sides are directly subordinate to the same leader or have direct leadership relations between superiors and subordinates, nor shall they engage in organization, personnel, discipline inspection, supervision, auditing and financial work in the organ where one of them holds leadership positions.

Due to the special nature of the region or work, it is necessary to flexibly implement the post avoidance, which shall be stipulated by the competent department of civil servants at or above the provincial level.

Article 69 Civil servants who hold the leading positions of township-level organs, county-level organs and their relevant departments shall be subject to geographical withdrawal, except as otherwise provided by law.

Article 70 When performing official duties, a civil servant shall be avoided under any of the following circumstances:

(a) involving my interests;

(2) Involving the interests of persons who have relatives listed in the first paragraph of Article 68 of this Law;

(three) other may affect the impartial execution of official duties.

Seventy-first civil servants should be avoided, I should apply for withdrawal; Interested parties have the right to apply for withdrawal of civil servants. Other personnel can provide the authorities with information that civil servants need to avoid.

According to the application of civil servants themselves or interested parties, the authorities make a decision on whether to withdraw after examination, or they can make a decision on withdrawal directly without application.

Article 72 Where the law provides otherwise for the withdrawal of civil servants, such provisions shall prevail.
