Article 1 In order to strengthen the management of the sale and discharge of fireworks and firecrackers, ensure the safety of the public and personal and property, and prevent and control environmental pollution, these Provisions are formulated in accordance with the Regulations on the Safety Management of Fireworks and Firecrackers and other relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 These Provisions shall apply to the sales, discharge and related management activities of fireworks and firecrackers within the administrative area of this Municipality. Article 3 The people's governments of cities and counties (cities, districts) shall, in accordance with the principles of comprehensive management and strict control, strengthen their leadership over the management of the sale and discharge of fireworks and firecrackers, and coordinate relevant major issues as a whole. Township people's governments and sub-district offices shall do a good job in the management of sales and discharge of fireworks and firecrackers within their respective jurisdictions, and guide and urge units and individuals to abide by these provisions. Village (neighborhood) committees shall cooperate with the relevant work of fireworks sales and discharge management. Fireworks and firecrackers industry associations should strengthen industry self-discipline, organize self-management of fireworks and firecrackers safety, and guide standardized operation according to law. Article 4 The emergency management department shall be responsible for the supervision and management of safety production of fireworks and firecrackers, and investigate and deal with illegal sales and business storage of fireworks and firecrackers according to law. The public security organs are responsible for the safety management of fireworks and firecrackers, and investigate and deal with illegal discharge and non-operating storage of fireworks and firecrackers according to law. Fifth the following areas (locations) of this Municipality prohibit the sale and discharge of fireworks and firecrackers:

(1) Lucheng District, Longwan District and ouhai district Administrative Region; 　　

(2) Dongtou Island, Niyu Island, Champion's Ao Island, damen island, Xiaomen Island, Lingkun Street and Kunpeng Street under the jurisdiction of Dongtou District; 　　

(3) Urban built-up areas of Yueqing City, Ruian City and Longgang City, and towns (streets) built-up areas where the people's governments of Yongjia County, wencheng county County, Pingyang County, Taishun County and Cangnan County are located. The specific scope is determined by the relevant county (city) people's governments and announced to the public; 　　

(four) other areas (locations) determined and announced by the people's governments of cities and counties (cities, districts). Because of major traditional festivals, important folk activities and major public events, it is necessary to sell and set off fireworks and firecrackers in the areas (locations) listed in the first paragraph of this article, the people's governments of cities and counties (cities, districts) can determine the specific circumstances, time, areas (locations) and product categories, product levels, specifications and quantities of fireworks and firecrackers, and announce them to the public. Article 6 No unit or individual may store fireworks and firecrackers in areas (places) where the sale and discharge of fireworks and firecrackers are prohibited, except for temporary storage according to the second paragraph of Article 5 of these Provisions. In the area (place) where fireworks are allowed to be set off, no unit or individual may store more than 30 kilograms of fireworks and firecrackers except fireworks operators and organizers of large-scale fireworks and firecrackers. Operators engaged in fireworks and firecrackers retail in places where fireworks and firecrackers are allowed to be sold shall not store fireworks and firecrackers products beyond the limit specified in the license. Seventh any unit or individual shall discharge fireworks and firecrackers safely, clean up the residue after discharge in time, and shall not commit any of the following acts:

(1) Setting off fireworks and firecrackers obtained through illegal channels or exceeding the shelf life; 　　

(2) Launching or throwing lit fireworks and firecrackers at buildings, structures, underground pipelines, septic tanks, etc., or launching or throwing fireworks and firecrackers outward from buildings and structures; 　　

(three) hinder road traffic, water traffic and flight safety; 　　

(four) to set off fireworks and firecrackers in other ways that endanger the safety of the public and the safety of people and property. Minors who set off fireworks and firecrackers shall be accompanied by guardians or other adults. Eighth any unit or individual has the right to discourage and report the illegal sale, discharge and storage of fireworks and firecrackers. Property service providers should discourage the illegal sale, discharge and storage of fireworks and firecrackers found in their property management areas; Those who refuse to listen to dissuasion shall promptly report to the emergency management department or the public security organ. Article 9 Operators who provide services for celebrations, funerals and other activities shall inform the clients of the regulations prohibiting the discharge of fireworks and firecrackers, and dissuade the clients from illegally discharging fireworks and firecrackers; Those who refuse to listen to dissuasion shall promptly report to the public security organ. Operators who provide services for celebrations, funerals and other activities shall not commit any of the following acts:

(a) illegal sales of fireworks; 　　

(2) Providing fireworks and firecrackers for illegal discharge free of charge; 　　

(three) to provide other assistance or convenience for the illegal discharge of fireworks and firecrackers in areas (locations) where fireworks and firecrackers are prohibited.

Legal basis:

According to the "Regulations on the Safety Management of Fireworks and Firecrackers" and other relevant laws and regulations, Article 10 violates the provisions of the first and second paragraphs of Article 6 of these Provisions, the public security organ shall confiscate the stored fireworks and firecrackers products and impose a fine of not less than 100 yuan but not more than 500 yuan. In violation of the provisions of the third paragraph of article sixth, the emergency management department shall order it to make corrections within a time limit and impose a fine of not less than one thousand yuan but not more than five thousand yuan; Overdue correction, a fine of five thousand yuan and ten thousand yuan. Article 11 Operators who provide services for celebrations, funerals and other activities, in violation of the provisions of the first paragraph of Article 9 of these Provisions, fail to fulfill the obligation of informing, discouraging or reporting, and allow the clients to illegally set off fireworks and firecrackers, shall be given a warning or informed criticism by the public security organ, and shall also be fined between 200 yuan and 500 yuan. Operators who provide services for celebrations, funerals and other activities in violation of the provisions of Article 9, paragraph 2, items 2 and 3, shall be given a warning or informed criticism by the public security organ and fined between 1,000 yuan and 3,000 yuan.
