Chapter I General Provisions Article 1 In order to standardize the management of social pension welfare institutions, safeguard the legitimate rights and interests of social pension welfare institutions and their elderly people, and promote the development of social pension welfare undertakings, these Measures are formulated in accordance with relevant laws and regulations and combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the administration of social pension welfare institutions within the administrative area of this Municipality.

The term "social welfare institutions for the aged" as mentioned in these Measures refers to institutions invested by citizens, legal persons or other organizations using non-financial funds to provide housing, life care, rehabilitation care, custody and other old-age services for the elderly. According to the nature of registration, social pension welfare institutions are divided into for-profit social pension welfare institutions and non-profit social pension welfare institutions.

The establishment and management of nursing homes and rehabilitation hospitals for the elderly shall be implemented in accordance with the relevant provisions on the management of medical institutions. Article 3 The development of social institutions for the aged adheres to the principles of government guidance, social promotion, policy support and strict management. Article 4 The Municipal People's Government shall, according to the economic and social development, the needs of the elderly and the overall planning of the city, take the construction and development of social pension institutions as the main content of the development plan of the city's pension services and incorporate them into the overall planning of national economic and social development.

The District People's Government shall lead the management of social-run pension welfare institutions within their respective administrative areas in a unified way, formulate the establishment plan of social-run pension welfare institutions in this district according to the development plan of the municipal pension service industry, and coordinate the construction and development of social-run pension welfare institutions in this district. Article 5 The municipal civil affairs department is the competent department of social pension welfare institutions within the administrative area of this Municipality, and is responsible for the guidance, coordination, supervision and management of the management of social pension welfare institutions in this Municipality.

The district civil affairs department is specifically responsible for the approval, registration and management of social pension welfare institutions within its administrative area. Article 6 The relevant departments of development and reform, land planning, urban and rural construction, industry and commerce, price, health, housing security, housing management, water affairs, public security, food and drug supervision, human resources and social security, urban management, taxation, finance and aging work shall, according to their respective functions and duties, do a good job in the management of social pension institutions.

Township (town) people's governments and sub-district offices shall do a good job in the management of social pension institutions within their respective jurisdictions.

Power supply, water supply, gas supply, telecommunications, cable television and other enterprises should do a good job in providing related services to social pension welfare institutions within their respective business scope. Article 7 The management committees of Wuhan East Lake New Technology Development Zone, Wuhan Economic and Technological Development Zone, East Lake Eco-tourism Scenic Area and Wuhan Chemical Industry Zone shall be responsible for the management of social pension welfare institutions within their respective management scope in accordance with the provisions of these Measures on the management responsibilities of district people's governments and relevant departments. Article 8 Trade associations of social pension welfare institutions established according to law shall cooperate with civil affairs departments to do a good job in industry self-discipline, service, coordination and service rating.

The municipal and district civil affairs departments shall support trade associations to carry out business activities according to law, and strengthen business guidance and supervision. Ninth to encourage citizens, legal persons or other organizations to set up social pension welfare institutions according to law; Encourage and support citizens, legal persons or other organizations to donate funds, materials or provide services to social pension welfare institutions free of charge. Social pension welfare institutions and their organizers who have made outstanding contributions shall be commended and rewarded by the municipal and district people's governments.

The funds needed for social pension welfare institutions to support and reward are included in the fiscal budget at the same level. Chapter II Establishment of Institutions Article 10 The establishment of social pension welfare institutions shall go through the formalities of examination and approval of establishment, establishment of institutions, registration of private non-enterprise units or industrial and commercial registration according to law. Eleventh the establishment of social pension welfare institutions shall meet the following conditions:

(1) The applicant is an individual, legal person or other organization established according to law with full capacity for civil conduct;

(two) in line with the planning of the old-age welfare institutions in this administrative region;

(3) Having a fixed service place, and the architectural design, fire safety, environmental protection, health and epidemic prevention of the service place meet the standards and technical specifications suitable for the elderly;

(4) Having living, cultural, rehabilitation, medical care and safety facilities suitable for the scale, business nature and scope of the pension welfare institution;

(five) there are start-up funds suitable for the service content and scale, with an average of not less than 5,000 yuan per bed;

(six) management, service, health technology, life care personnel who adapt to the development of service industry and have corresponding professional requirements; The ratio of staff who can take care of themselves to clients is not less than 1: 6, and the ratio of staff who need help and care is not less than1:3;

(7) Having perfect articles of association and rules and regulations;

(eight) other conditions stipulated by the state and the province. Twelfth applicants to apply for the establishment of social pension welfare institutions, should hold the following materials to the district civil affairs department to apply for the preparation:

(a) the application and feasibility study report;

(2) the identity certificate of the applicant;

(3) Documents certifying the source of funds;

(4) proof of ownership of the service place;

(five) the notice of pre-approval of the name of the private non-enterprise unit or the notice of pre-approval of the name of the enterprise;

(six) other materials stipulated by the state and the province.
