Foreign trade operators engaged in the import and export of goods or technologies shall register with the People's Republic of China and the Ministry of Commerce (hereinafter referred to as the Ministry of Commerce) or the institutions entrusted by the Ministry of Commerce; However, unless the laws, administrative regulations and the provisions of the Ministry of Commerce do not require filing and registration.

The Ministry of Commerce is the competent department for filing and registration of foreign trade operators nationwide. If a foreign trade operator fails to register in accordance with these measures, the customs shall not go through the formalities of import and export declaration and clearance.
