Land certificate knowledge
Land certificate is a written document issued by the local people's government to prove that the holder has a certain area of land ownership or use right, and it is a legal certificate that the holder enjoys land ownership or use right.
In the first 50 years, after the completion of China's land reform, the people's government issued land ownership certificates to farmers who had allocated land in rural areas; Land use certificates have been issued to farmers who have been allocated state-owned land in the suburbs of the city.
After the transformation of agricultural socialism, farmers' private land has become collective public land, and the state-owned land used by farmers in urban suburbs has also been used collectively. Land certificate has lost its meaning and function. In order to strengthen land management and safeguard the legitimate rights and interests of land owners and users, the Land Management Law of the People's Republic of China, which was promulgated in 1986 and came into effect in 1, stipulates that collectively owned land and state-owned land used by units and individuals owned by the whole people according to law shall be registered by the people's government at the county level, and certificates shall be issued to confirm ownership and use rights.
There are three kinds of land certificates, namely, state-owned land use certificate, collective land ownership certificate and collective land construction land use certificate. Where the land ownership is changed or the land use is changed, the land ownership change registration formalities shall be handled according to legal procedures, and the certificate shall be renewed.
There are three main types of land certificates issued by China:
1. collective land ownership certificate: the people's government at the county level shall register the land collectively owned by farmers, issue the collective land ownership certificate and confirm the ownership.
2. Certificate of the right to use collective land for construction: The people's government at the county level shall register the collectively owned land used for non-agricultural construction according to law, issue the certificate of the right to use collective land for construction, and confirm the right to use construction land.
