Matters needing attention in determining the jurisdiction of a case:
1. The loan contract dispute is also a kind of contract dispute. According to Article 24 of the Civil Procedure Law, a lawsuit brought for a contract dispute shall be under the jurisdiction of the people's court of the defendant's domicile or the place where the contract is performed. In the dispute of loan contract, the defendant's location is easy to determine, but the place of performance of the contract has always been controversial, especially when the lender asks the borrower to repay, there is no clear legal stipulation on whether the lender's location is the place of performance of the loan contract or the borrower's location is the place of performance of the loan contract. If the borrower and the lender are not in the same place, the lender will often bring a lawsuit to the court where they are located, and the borrower will often object to the court's jurisdiction, which will lead to the protracted dispute over the loan contract.
2. The loan contract is a two-way contract. The lender performs the loan at the borrower's location, and the borrower performs the loan at the lender's location, that is, the place where the lender requires the borrower to repay the loan is on the lender's side, and the lender may bring a lawsuit to the local court.
To sum up, in general, the loan contract is under the jurisdiction of the people's court where the defendant has his domicile or where the contract is performed. However, before applying the legal provisions, the parties can reach an agreement through consultation, and only when the agreement is unclear will they say that the court of jurisdiction is determined according to the legal provisions.

Article 23
A lawsuit brought in connection with a contract dispute shall be under the jurisdiction of the people's court in the place where the defendant has his domicile or where the contract is performed.
Article 34
A party to a dispute over a contract or other property rights and interests may, through written agreement, choose a people's court in a place that is actually related to the dispute, such as the defendant's domicile, the place where the contract is performed, the place where the contract is signed, the plaintiff's domicile and the place where the subject matter is located, but it shall not violate the provisions of this Law on hierarchical jurisdiction and exclusive jurisdiction.
