Article 32 divorce proceedings

If one of the men and women requests a divorce, the relevant departments may mediate or directly file a divorce lawsuit with the people's court. When trying divorce cases, the people's court shall conduct mediation; If the relationship has really broken down and mediation fails, divorce shall be granted.

In any of the following circumstances, if mediation fails, divorce shall be granted:

(a) bigamy or a spouse living with others;

(2) committing domestic violence or abusing or abandoning family members;

Thirty-first men and women who voluntarily divorce shall be granted divorce. Both parties must apply for divorce at the marriage registry.
