1. Can the house with outstanding loan be mortgaged?

1. The house with outstanding loan can be mortgaged, but the conditions to be met for re-mortgage are as follows:

(1) It is necessary to truthfully inform the second mortgagee of the fact that the collateral has been mortgaged;

(2) The creditor's rights secured by mortgage shall not exceed the value of the collateral, nor shall they exceed the remaining value after the collateral is secured.

2. Legal basis: Article 395 of the Civil Code of People's Republic of China (PRC).

The following properties that the debtor or a third party has the right to dispose of may be mortgaged:

(a) buildings and other land attachments;

(2) The right to use construction land;

(3) the right to use the sea area;

(4) Production equipment, raw materials, semi-finished products and products;

(5) Buildings, ships and aircraft under construction;

(6) means of transportation;

(seven) other property not prohibited by laws and administrative regulations.

The mortgagor may mortgage the property listed in the preceding paragraph together.

2. Can the mortgage be transferred if it is not paid off?

The house that has not paid off the bank loan cannot be transferred normally because it is in a mortgage state. The conditions for property transfer are as follows:

1. The owner has the ownership of the transferred property and has registered it. Real estate unsecured loans, affordable housing or small property houses without transfer time;

2. Both parties are persons with full capacity for civil conduct;

3. If both parties are equal and voluntary, the real estate change registration shall be handled in accordance with legal procedures.
