On March 4th, the Housing and Urban-Rural Development Bureau of Dongguan City, Guangdong Province issued the Notice on Further Optimizing the Management of the Sales Price Declaration of Newly-built Commercial Housing (hereinafter referred to as the Notice), in which it was mentioned that the declared price of unsold houses will be adjusted 180 days after obtaining the pre-sale permit or the filing certificate of the current sale, with the increase rate not exceeding 5% and the unlimited reduction.

In terms of the sales price of commercial housing, the Notice stipulates that after obtaining the pre-sale permit or the record certificate of the current sale of commercial housing projects, all the houses for sale and the declared price of each suite source should be disclosed at one time within 10, and the sales should be strictly in accordance with the clearly marked format. The actual transaction price shall not be higher than the declared price, nor less than 90% of the declared price. When handling the building list, Dongguan Real Estate Registration Center shall enter and lock it according to the sales price declared when the enterprise applies for pre-sale (current sale). In addition, if the declared price of the project is significantly higher than the price of similar projects around or the pre-transaction price of the project cannot be reasonably explained, the Municipal Housing and Urban-Rural Development Bureau will suspend the issuance of pre-sale permits or temporarily not handle the filing of current sales.

In addition, after obtaining the pre-sale permit or the record certificate of the current sale of commercial housing, the developer should publicize all the houses for sale at one time within 10 days, and sell them in strict accordance with the declared price. The maximum loanable amount can be increased by 20% on the basis of the amount calculated by the calculation formula for buyers of prefabricated houses, talents recognized by Dongguan and applicants who meet the relevant provisions on the deposit and withdrawal of provident fund. In order to actively and effectively respond to the impact of COVID-19 epidemic, further optimize government services, improve the management of commodity housing sales, standardize the order of the real estate market, safeguard the legitimate rights and interests of buyers, and implement the work related to one city, one policy and differentiated regulation, with the consent of the Municipal People's Government, the relevant requirements are hereby notified as follows:

The first is to simplify the declaration process of commodity housing sales price.

Since March 5, 2020, the Municipal Development and Reform Bureau will no longer accept the filing and declaration of the sales price of new commercial housing. When a development enterprise applies to the Municipal Housing and Urban-Rural Development Bureau for the pre-sale permit of commercial housing projects, it will declare the sales price of newly-built commercial housing for the first time in the submitted pre-sale plan (see Annex 1 for the style). The sales price declaration information shall include the building number, floor, apartment type, floor height, area, unit price, total price, preferential discount and its conditions, sales status, delivery standard, etc. Among them, the delivery standard is the standard that the development enterprise actually delivers to the owner for use. Development enterprises need to promise to sell and deliver in strict accordance with the declared price and delivery standard in the pre-sale plan. The pre-sale plan should be publicized in a prominent position at the commercial housing sales site. Development enterprises do not need to submit the pre-sale plan for the existing commercial housing projects for the record, but they still need to declare and promise the sales price of new commercial housing. When the Municipal Housing and Urban-Rural Development Bureau publicized the pre-sale permit or filing certification information of the newly-built commercial housing project in official website, it simultaneously publicized the declaration information of the commercial housing sales price of the project and pushed it to the municipal real estate registration center.

Two, strengthen the guidance of commodity housing sales price.

Real estate development enterprises should scientifically and reasonably determine the declared price. If the declared price of the project is significantly higher than the price of similar projects around or the pre-sale price of the project cannot be reasonably explained, the Municipal Housing and Urban-Rural Development Bureau will suspend the issuance of pre-sale permits or temporarily not handle the filing of cash sales. After obtaining the pre-sale permit or the record certificate of the current sale of commercial housing projects, all the houses for sale and the declared price of each suite shall be publicized at one time within 10 days, and the actual transaction price shall not be higher than the declared price or lower than 90% of the declared price. City real estate registration center in the process of building list, according to the enterprise to apply for pre-sale (now) to declare the sales price input and lock. For the commercial housing projects that have obtained the pre-sale permit or the registration certificate of current sale before the date of issuance of this notice, the development enterprise may apply to the Municipal Housing and Urban-Rural Development Bureau to change the registered sales price before March 3, 2020, and re-declare the unsold housing sales price. The Municipal Housing and Urban-Rural Development Bureau publicized the sales price declaration information after the change of unsold houses of the project in official website, and pushed it to the Municipal Real Estate Registration Center, which re-entered and locked it.

Three, strengthen the linkage management of commodity housing price declaration and interior decoration management.

The "delivery standard" declared by the development enterprise in the "Dongguan New Commodity Housing Sales Price Declaration Form" should be the standard for the development enterprise to actually deliver the house to the buyer. At the time of price declaration, the construction drawing design document of the commercial housing project is the standard acceptance of the blank, the development enterprise intends to promote the sale of the commercial housing and promises to deliver it with fine decoration, and the price of the commercial housing sales contract to be signed includes the interior decoration expenses, so the "delivery standard" declared by the development enterprise in the "Dongguan New Commercial Housing Sales Price Declaration Form" should be fine decoration, and the development enterprise should, within 60 days after obtaining the pre-sale permit, Go to the housing construction department to review the design documents of the interior decoration project, and go through the alteration procedures such as construction permit and supervision registration (filing), and clearly stipulate the decoration and related equipment standards in the commercial housing sales contract (or improve it in the form of supplementary agreement). The delivery standard is consistent with the declared price, sales contract, project completion acceptance and residential delivery standard. Specific requirements shall be implemented in accordance with the Notice on Further Standardizing Interior Decoration of Residential Projects (Dong Jian An Zhi [2065438+08] No.226).

Fourth, standardize the sales price behavior of commercial housing.

After the development enterprise obtains the pre-sale permit or the record certificate of the current sale of commercial housing, it shall disclose all the houses for sale at one time within 10, and sell them in strict accordance with the declared price. Commercial housing sales shall be clearly marked with a set of one standard, and the styles of Dongguan Commercial Housing Sales Price List (Annex 2) and Dongguan Commercial Housing Sales Information Publicity Form (Annex 3) supervised by Dongguan Municipal Market Supervision Administration shall be uniformly adopted. Real estate development enterprises should make their own products and publicize them in the eye-catching position of commercial housing sales. If conditions permit, they can also use electronic information screens, multimedia terminals or computer inquiries. If the price is clearly marked in the above way, the price content shall be consistent.

Fifth, strengthen the main responsibility of real estate enterprises' price behavior.

Real estate development enterprises should earnestly perform their main responsibilities, operate in good faith according to laws and regulations, and strictly abide by the relevant provisions on clearly marked prices of commercial housing sales. It is not allowed to increase the price beyond the marked price of commercial housing, and it is not allowed to charge any unspecified fees. It is not allowed to maliciously speculate or drive up housing prices by fabricating or spreading price increase information, and it is not allowed to evade the supervision and management of residential interior decoration by means of "rough house inspection, hardcover quotation and delivery". Relevant functional departments stepped up market inspections and supervision and law enforcement, jointly carried out special treatment, severely investigated and dealt with illegal acts of development enterprises according to law, and adopted measures such as interviewing the person in charge of the enterprise, publicly informing, suspending the sale of commercial housing, and lowering the supervision level of advance payment. Depending on the seriousness of the case, we will further improve the joint punishment mechanism for corporate dishonesty.

This notice shall come into force on March 5, 2020, with the number of DF [20 16] 5 10, DF [20 17] 146, DF [20 17] 453. If the previous policies are inconsistent with this notice, this notice shall prevail.
