Public ownership as the main body and the simultaneous development of multiple ownership economies are the basic economic systems in the primary stage of socialism in our country. Unswervingly consolidating and developing the public economy, and unswervingly encouraging, supporting and guiding the development of the non-public economy so that the two can promote each other and develop together in the process of socialist modernization are basic policies that must be adhered to in the long term. It is an inevitable requirement for improving the socialist market economic system and building socialism with Chinese characteristics.
Since the reform and opening up, my country's individual, private and other non-public economies have continued to develop and grow, and have become an important part of the socialist market economy and an important force in promoting the development of social productivity. Actively developing the individual, private and other non-public sectors of the economy is conducive to prospering the urban and rural economy, increasing fiscal revenue, expanding social employment, improving people's lives, optimizing the economic structure, promoting economic development, and is important for building a moderately prosperous society in an all-round way and accelerating socialist modernization. The process is of great strategic significance.
To encourage, support and guide the development of the non-public economy, we must be guided by Deng Xiaoping Theory and the important thought of "Three Represents", fully implement the Scientific Outlook on Development, conscientiously implement the principles and policies determined by the central government, and further emancipate the mind, Deepen reforms, eliminate institutional obstacles that affect the development of the non-public economy, establish equal market subject status, and achieve fair competition; further improve national laws, regulations and policies, and protect the legitimate rights and interests of non-public enterprises and employees in accordance with the law; further strengthen and improve government supervision management and services to create a good environment for the development of the non-public economy; further guide non-public enterprises to operate in accordance with the law, be honest and trustworthy, improve management, continuously improve their own quality, and promote the sustainable and healthy development of the non-public economy. To this end, the following opinions are hereby put forward:
1. Relax market access for non-public economic sectors
(1) Implement the principles of equal access and fair treatment. Allow non-public capital to enter industries and fields not prohibited by laws and regulations. Industries and fields that allow foreign capital to enter also allow domestic non-public capital to enter, and relax restrictions on equity ratios and other conditions. In terms of investment approval, financing services, fiscal and taxation policies, land use, foreign trade, and economic and technological cooperation, non-public enterprises are treated equally with other ownership enterprises and are treated equally. For matters requiring approval, verification and filing, government departments must disclose the corresponding systems, conditions and procedures. Relevant national departments and local people's governments must complete the work of sorting out and revising the laws, regulations and policy provisions that restrict market access for the non-public economy as soon as possible. Foreign-invested enterprises shall comply with relevant laws and regulations.
(2) Allow non-public capital to enter monopolized industries and fields. Accelerate the reform of monopoly industries and further introduce market competition mechanisms in industries and fields such as electricity, telecommunications, railways, civil aviation, and petroleum. For the natural monopoly business, we will actively promote the diversification of investment entities, and non-public capital can enter through equity participation. For other businesses, non-public capital can enter through sole proprietorship, joint venture, cooperation, project financing, etc. Under the premise of unified national planning, unless otherwise provided by national laws and regulations, qualified non-public enterprises are allowed to equally obtain exploration and mining rights for mineral resources in accordance with the law, and non-public capital is encouraged to conduct commercial exploration and development of mineral resources. .
(3) Allow non-public capital to enter the public utilities and infrastructure fields. Accelerate the improvement of the government franchise system, standardize bidding behavior, and support non-public capital to actively participate in the investment, construction and operation of municipal utilities and infrastructure such as urban water supply, gas supply, heat supply, public transportation, sewage and garbage treatment. Under the premise of regulating the transfer behavior, qualified public utilities and infrastructure projects can transfer property rights or operating rights to non-public enterprises. Encourage non-public enterprises to participate in the reform of the property rights system and operating methods of municipal public enterprises and public institutions.
(4) Allow non-public capital to enter the field of social undertakings. Support, guide and regulate non-public capital investment in non-profit and for-profit fields such as education, scientific research, health, culture, sports and other social undertakings. While liberalizing market access, we will strengthen government and social supervision to safeguard public interests.
Financial institutions are encouraged to start financial leasing, corporate financial management, account custody and other businesses. Improve the service methods and means of insurance institutions and carry out product and service innovation for non-public enterprises. Support non-public enterprises in attracting investment from international financial organizations in accordance with relevant regulations.
(13) Establish and improve a credit guarantee system. Support the non-public economy in establishing commercial or mutual credit guarantee institutions. Encourage qualified regions to establish small and medium-sized enterprise credit guarantee funds and regional credit re-guarantee agencies. Establish and improve the industry access, risk control and compensation mechanisms for credit guarantees, and strengthen the supervision of credit guarantee institutions. Establish and improve self-regulatory organizations for the guarantee industry.
3. Improve social services for the non-public economy
(14) Vigorously develop social intermediary services. Governments at all levels must increase support for intermediary service agencies, adhere to the principles of socialization, specialization, and marketization, and continuously improve the social service system. Support the development of various social intermediary service institutions such as entrepreneurship guidance, financing, market development, technical support, certification and accreditation, information services, management consulting, and talent training. In accordance with market-oriented principles, regulate and develop self-regulatory organizations such as various industry associations and chambers of commerce. Rectify the order of the intermediary service market, standardize intermediary service behavior, and create a good service environment for the non-public economy.
(15) Actively carry out entrepreneurial services. Further implement the national employment and re-employment policy, increase policy support for self-employment, and encourage laid-off and unemployed persons, retired soldiers, university graduates, returned overseas students and other types of personnel to start small businesses, develop new jobs, and promote employment through entrepreneurship. Governments at all levels should support the establishment of entrepreneurial service agencies and encourage the provision of various entrepreneurial services and policy support for start-up small businesses. For start-up small businesses, the company's registered capital limit can be reduced according to industry characteristics, the registered capital can be paid in installments, and registration fees can be reduced or exempted.
(16) Support the training of business operators and employees. Various forms of training are carried out according to the different needs of the non-public economy. Integrate social resources, innovate training methods, and form a training mechanism that combines government guidance, social support, and enterprise independence. Relying on colleges and universities, various training institutions and enterprises, we should focus on training in laws and regulations, industrial policies, business management, vocational skills and technology applications, and governments at all levels should provide appropriate subsidies and funding. Enterprises should regularly provide professional skills training and safety knowledge training to employees.
(17) Strengthen scientific and technological innovation services. It is necessary to increase support for the scientific and technological innovation activities of non-public enterprises, accelerate the establishment of information and comprehensive technical service platforms suitable for the characteristics of non-public small and medium-sized enterprises, and promote the informatization construction of non-public enterprises. Vigorously cultivate the technology market and promote the transformation of scientific and technological achievements and technology transfer. Science and technology intermediary service agencies should actively provide professional services such as science and technology consulting and technology promotion to non-public enterprises. Guide and support scientific research institutes, universities and non-public enterprises to carry out various forms of industry-university-research cooperation. Encourage state-owned scientific research institutions to open their laboratories to non-public enterprises and make full use of existing scientific and technological resources. Support non-public capital in establishing technology-based small and medium-sized enterprises and scientific research and development institutions. Encourage retired personnel with expertise to provide technical services to non-public enterprises. Effectively protect the intellectual property rights of units and individuals.
(18) Support enterprises to explore domestic and foreign markets. Improve government procurement methods so that non-public enterprises enjoy the same treatment as other enterprises in government procurement. Promote the construction of information networks and actively provide domestic and foreign market information to non-public enterprises. Encourage and support non-public enterprises to expand exports and "go global", invest and start businesses overseas, and enjoy the same treatment as other enterprises in terms of foreign investment, import and export credit, export credit insurance, etc. Non-public enterprises are encouraged to declare intellectual property rights overseas. Give full play to the role of intermediary organizations such as industry associations and chambers of commerce, make good use of the national small and medium-sized enterprises' international market development funds, and support non-public enterprises in developing international markets.
(19) Promote the construction of corporate credit system. Accelerate the establishment of a credit collection system, rating release system and breach of trust punishment mechanism that are suitable for the characteristics of non-publicly owned small and medium-sized enterprises, promote the pilot work of establishing corporate credit files, and establish and improve the credit file database of non-publicly owned enterprises.
For enterprises with higher credit ratings, relevant registration and review agencies should simplify annual inspection, filing and other procedures. It is necessary to strengthen corporate credit awareness, improve corporate credit systems, and establish a corporate credit self-discipline mechanism.
4. Safeguard the legitimate rights and interests of non-public enterprises and employees
(20) Improve the private property protection system. It is necessary to strictly implement laws, regulations and administrative rules that protect legitimate private property. No unit or individual may infringe upon the legitimate property of non-public enterprises, or illegally change the ownership relationship of the property of non-public enterprises. In accordance with the provisions of the Constitutional Amendment, accelerate the review, revision and improvement of laws, regulations and administrative regulations related to the protection of legal private property.
(21) Safeguard the legitimate rights and interests of enterprises. No unit or individual may interfere with the production and operation activities carried out by non-public enterprises in accordance with the law. Protect business owners’ reputation, personal and property rights and other legitimate rights and interests in accordance with the law. Government departments must promptly accept administrative reconsideration requests when the legitimate rights and interests of non-public enterprises are infringed upon, treat them fairly, and respond within a time limit.
(22) Protect the legitimate rights and interests of employees. Non-public enterprises must respect and safeguard the legitimate rights and interests of employees, sign standardized labor contracts with employees on the basis of equal consultation in accordance with the Labor Law of the People's Republic of China and other laws and regulations, and improve the collective contract system , ensuring the equality of rights and obligations of both parties; employees must be paid in full and on time in accordance with the law, and the wage standard must not be lower or disguisedly lower than the minimum wage standard stipulated by the local government, and gradually establish a normal increase mechanism for employee wages; employees must be respected and guaranteed in accordance with the national The rights to rest and vacation are stipulated, and employees shall not be forced or disguised to work overtime. Overtime wages or compensatory leave must be paid in accordance with the law for overtime or extended working hours; labor protection and occupational disease prevention and control must be strengthened, in accordance with the "Production Safety Law of the People's Republic of China and the State" 》 and other laws and regulations, we must do a good job in preventing and controlling occupational hazards in production safety and workplaces, improve working conditions, and strengthen labor protection. It is necessary to protect the legitimate rights and special interests of female workers and prohibit the use of child labor.
(23) Promote the construction of the social security system. Non-public enterprises and their employees must participate in social insurance such as pension, unemployment, medical, work-related injury, and maternity insurance and pay social insurance premiums in accordance with relevant national regulations. Establish a housing provident fund system in accordance with national regulations. Relevant departments should actively explore and improve the social security system for employees based on the characteristics of non-public enterprises such as their large size, flexible employment, and high employee mobility.
(24) Establish and improve enterprise trade union organizations. Non-public enterprises must protect the rights of employees to participate in and form trade unions in accordance with the law. Enterprise trade unions implement democratic management and represent and safeguard the legitimate rights and interests of employees in accordance with the law. Enterprises must create necessary conditions for trade unions to carry out their normal work, allocate trade union funds in accordance with the law, and must not interfere in trade union affairs.
5. Guide non-public enterprises to improve their own quality
(25) Implement national laws, regulations and policies. Non-public enterprises must implement national laws and regulations, operate in accordance with the law, and pay taxes in accordance with regulations. Obey the country's macro-control, strictly implement relevant technical regulations, consciously abide by relevant regulations on environmental protection and production safety, proactively adjust and optimize industry and product structure, accelerate technological progress, improve product quality, reduce resource consumption, and reduce environmental pollution. The state supports the non-public economy to invest in high-tech industries, modern service industries and modern agriculture, and encourages the development of labor-intensive industries such as processing trade, community services, and agricultural product processing with large employment capacity.
(26) Standardize enterprise management behaviors. Non-public enterprises engaged in production and business activities must obtain corresponding qualifications and licenses in safety production, environmental protection, sanitation, quality, land use, resource extraction, etc. in accordance with the law. Enterprises must strengthen production, marketing, quality and other management and improve various rules and regulations. Establish responsibility systems for safety, environmental protection, sanitation, labor protection, etc., and ensure necessary investment. Establish and improve the accounting system and prepare financial statements truthfully. Enterprises must submit statistical information in accordance with the law. Accelerate research, improvement and improvement of accounting, taxation, statistics and other management systems for individual businesses and small businesses.
(27) Improve the enterprise organizational system.
Enterprises must establish standardized sole proprietorships, partnerships and corporate enterprises in accordance with the provisions of laws and regulations. Corporate enterprises must improve their corporate governance structure in accordance with the requirements of the Company Law of the People's Republic of China. Explore and establish organizational systems that are conducive to the development of individual businesses and small businesses.
(28) Improve the quality of business managers. Investors and management personnel of non-public enterprises must consciously study national laws, regulations, principles and policies, learn modern science and technology and business management knowledge, enhance legal concepts, integrity awareness and social ethics, and strive to improve their own quality. Guide non-public enterprises to actively carry out social welfare activities such as poverty alleviation and development, social relief and "glorious undertakings" to enhance their sense of social responsibility. Governments at all levels should pay attention to the construction of talent teams in the non-public economy and implement the same policies as public enterprises in terms of personnel management, education and training, professional title evaluation and government rewards. Establish a professional manager evaluation and recommendation system to accelerate the professionalization and marketization of enterprise management talents.
(29) Encourage qualified enterprises to become stronger and bigger. The state supports qualified non-public enterprises to further strengthen their strength through mergers, acquisitions, alliances, etc., and develop into large companies and groups with outstanding main businesses and strong market competitiveness. If conditions permit, they can develop into multinational companies. Non-public enterprises are encouraged to implement brand development strategies and strive to create famous brand products. Support the development of non-public high-tech enterprises, encourage them to increase scientific and technological innovation and new product development, strive to improve independent innovation capabilities, and form independent intellectual property rights. The state's support policies on enterprise technological transformation, scientific and technological progress, foreign trade and other aspects also apply to non-public enterprises.
(30) Promote professional collaboration and the development of industrial clusters. Guide and support enterprises to engage in specialized production and characteristic operations, and develop in the direction of "specialization, precision, specialness, and innovation". Encourage small and medium-sized enterprises to carry out various forms of economic and technological cooperation with large enterprises and establish stable collaborative relationships in supply, production, sales, technology development and other areas. By improving the level of professional collaboration, cultivating key enterprises and well-known brands, developing specialized markets, innovating market organization forms, promoting the sharing of public resources, and promoting the healthy development of industrial clusters characterized by the agglomeration of small and medium-sized enterprises.
6. Improve government supervision of non-public enterprises
(31) Improve supervision methods. People's governments at all levels must improve relevant systems based on the production and operation characteristics of non-public enterprises and perform supervision and management functions in accordance with the law. All relevant regulatory authorities must improve regulatory methods, make regulatory systems public, standardize regulatory behaviors, and improve regulatory levels. Strengthen the construction of supervisory teams and improve the quality of supervisory personnel. Timely release relevant regulatory information to the public and play the role of social supervision.
(32) Strengthen labor inspection and labor relations coordination. Labor and security departments at all levels must attach great importance to labor relations issues in non-public enterprises and strengthen supervision and inspection of the implementation of labor contracts, wages, labor protection, social insurance and other laws and policies by non-public enterprises. Establish and improve the labor relations coordination mechanism of non-public enterprises, improve the labor dispute settlement system, resolve labor disputes in a timely manner, promote harmonious labor relations, and maintain social stability.
(33) Regulate the charging behavior of state administrative agencies and public institutions. Further clean up the fees charged by existing administrative agencies and public institutions. Except for the fee items specified by national laws and regulations and the finance and price authorities of the State Council, no department or unit has the right to forcefully collect any fees from non-public enterprises, and has no right to force requirements for any reason. Enterprises provide various sponsorship fees or accept paid services. It is necessary to strictly implement the fee disclosure system and the management regulations on the two lines of revenue and expenditure, and enterprises have the right to refuse and report unlicensed and illegal charging behaviors. People's governments at all levels must strengthen supervision and inspection of various types of fees, and seriously investigate and deal with arbitrary fees, arbitrary fines and various assessments.
7. Strengthen guidance and policy coordination for the development of the non-public economy
(34) Strengthen guidance for the development of the non-public economy. People's governments at all levels should strengthen service awareness, improve service methods, and innovate service means based on the needs of the development of the non-public economy.
It is necessary to incorporate the development of the non-public economy into the national economic and social development plan, strengthen the monitoring and analysis of the development dynamics of the non-public economy, and promptly publish to the public information on industrial policies, development plans, investment priorities, and market demand. Establish a work coordination mechanism and departmental joint meeting system to promote the development of the non-public economy, strengthen cooperation between departments, and form a joint force to promote the healthy development of the non-public economy. It is necessary to give full play to the assistant role of the federations of industry and commerce at all levels in the government's management of non-public enterprises. Statistical departments must improve and perfect the current statistical system to timely and accurately reflect the development status of the non-public economy.
(35) Create a good atmosphere of public opinion. Vigorously publicize the party and the country's principles, policies, laws and regulations that encourage, support and guide the development of the non-public economy, publicize the important position and role of the non-public economy in socialist modernization, publicize and commend the advanced models emerging in the non-public economy, Form a good social public opinion environment that is conducive to the development of the non-public economy.
(36) Do a good job in implementation. All regions and departments must strengthen investigation and research, promptly formulate and improve specific measures and supporting methods to promote the development of the non-public economy, conscientiously solve new problems encountered in the development of the non-public economy, and ensure that the principles and policies of the party and the state are implemented. Promote the healthy development of the non-public economy.
