1. Generally speaking, when you borrow money from a bank, the guarantee that the bank requires the guarantor to provide is a joint and several liability guarantee. If it is overdue, the bank has the right to ask either of you to return it or both of you to return it at the same time;

2. If the bank sues you both at the same time, then the court can only order you to return them at the same time;

3. The court will not directly decide that someone's salary will be repaid directly, because this is only a compulsory measure and cannot be the subject of the court's judgment.

Article 18 Where the parties agree in the suretyship contract that the guarantor and the debtor shall be jointly and severally liable for the debts, it is a suretyship of joint liability.

If the debtor of joint and several liability guarantee fails to perform the debt at the expiration of the debt performance period agreed in the main contract, the creditor may require the debtor to perform the debt, or may require the guarantor to assume the guarantee liability within the scope of its guarantee.
