Legal analysis: Generally speaking, relocation and resettlement houses refer to affordable housing organized and implemented by the government, providing preferential policies, defining construction standards and limiting supply prices, which are used for the resettlement of residents in major projects and old city reconstruction projects in this city. Whether the relocated house can be loaned depends on whether the relocated house meets the mortgage conditions. Generally, after obtaining the house ownership certificate and land use right certificate, the relocated house can be mortgaged.

Legal basis: Article 23 of the Measures for the Administration of Demolition and Resettlement Houses in Shanghai. Relocation of resettlement houses shall not be transferred or mortgaged within 3 years after obtaining the property right certificate, except for non-trading behaviors such as inheritance according to law, housing security in the original resettlement areas and counties, and repurchase organized by the Housing Authority in accordance with relevant regulations.

Article 395 of the Civil Code of People's Republic of China (PRC) The following properties that the debtor or a third party has the right to dispose of may be mortgaged:

(a) buildings and other land attachments;

(2) The right to use construction land;

(3) the right to use the sea area;

(4) Production equipment, raw materials, semi-finished products and products;

(5) Buildings, ships and aircraft under construction;

(6) means of transportation;

(seven) other property not prohibited by laws and administrative regulations.

The mortgagor may mortgage the property listed in the preceding paragraph together.
