Legal analysis: If divorced couples have an agreement in advance, it is ok to deal with it according to the agreed agreement in advance. If there is no agreement, if the two parties jointly borrow money to buy a house after marriage, it will be regarded as the joint property of the husband and wife, and the two parties will negotiate how to deal with it. If negotiation fails, the treatment method is as follows: 1. Both parties who claim the ownership of the house will bid; 2. If one of the husband and wife claims the ownership of real estate, the husband and wife who have obtained the ownership of real estate shall give the other party corresponding compensation because the housing appraisal institution evaluates the house according to the current market price of the house; 3. If neither husband nor wife claims the ownership of the house, the house shall be auctioned according to the application of both husband and wife, and the income shall be divided.

Article 1062 The following property acquired by husband and wife during the marriage relationship is the common property of husband and wife, which is jointly owned by husband and wife: (1) wages, bonuses and labor remuneration; (2) Income from production, operation and investment; (3) Income from intellectual property rights; (4) Inherited or donated property, except as provided for in Item 3 of Article 1063 of this Law; (5) Other property that should be jointly owned. Husband and wife have equal rights in dealing with common property.

Article 1089 Upon divorce, the joint debts of husband and wife shall be paid off jointly. If the joint property is insufficient to pay off or the property belongs to each other, it shall be paid off by mutual agreement; If the agreement fails, the people's court shall make a judgment.
