(1) Invite public bidding. The Ministry of Finance will regularly inform the financial departments of all provinces, autonomous regions, municipalities directly under the Central Government and cities under separate state planning of the loan projects to be implemented by bidding for the selected purchasing companies. After receiving the notice from the Ministry of Finance, the local financial department shall organize, guide and supervise the borrower's bidding for the procurement company. The bidding work of all loan project procurement companies must be completed within 40 working days from the date of the notice issued by the Ministry of Finance. Project units and procurement companies must conduct bidding and procurement according to the requirements of the lending country for the procurement ratio, and prepare the tender according to the procurement list approved by the competent departments of the domestic and lending countries.
(2) Bidding. The purchasing company that receives the invitation to bid shall fill in the agency application form as required. The agency application must be signed by the general manager or deputy general manager of the purchasing company and stamped with the official seal of the company. The purchasing company shall seal the agency application form and submit it to the borrower at the time and address specified in the bid invitation. If the purchasing company fails to submit the agency application according to the provisions of this article, it shall be deemed as invalid bidding.
(3) Bid evaluation. The borrower shall organize the establishment of a review committee composed of 5 ~ 7 review members. The representative of the borrower's unit is the person in charge of the jury and is fully responsible for the evaluation work. For the second-class projects, the local financial department may send representatives to participate in the jury and perform the duties of the judges; For the three types of projects, the local financial department will not send representatives to participate in the jury in principle.
(4) Waste standard. If the handling fee charged by the purchasing company does not meet the following standards, it will be considered as invalid bidding: ① If the contract amount of the loan project is 5 million dollars or less, a handling fee of 1% will be charged; (2) If the contract amount exceeds $5 million, a handling fee of 1% will be charged for the part within $5 million, and a handling fee of 0.5% will be charged for the part exceeding; ③ A handling fee of 0.3% will be charged for the civil works contract or other civil works contracts under Japanese government loans.
(5) winning the bid. The jury shall, within 5 working days after the end of the bid evaluation, submit the composition of the jury, the bid evaluation process, the scoring details of the purchasing company and the bid evaluation results to the local financial department.
(6) purchase contract. In the contract signed between the purchasing company and the winning bidder, the list of goods to be purchased with foreign government loans should be included, and the specifications and technical compatibility responsibilities of goods from different sources should be clearly stipulated.
