Can collective land be mortgaged?
Legal analysis: The following collective land can be mortgaged:

(a) the land use right of collectively owned barren hills, gullies, hills and beaches contracted by farmers with the consent of the employer;

(two) to the township (town) village enterprise factory buildings and other buildings as collateral, the enterprise factory buildings and other buildings within the scope of collective land use rights shall be mortgaged at the same time.

Legal basis: Article 400th of the Civil Code of People's Republic of China (PRC) establishes mortgage, and the parties shall conclude a mortgage contract in writing. A mortgage contract generally includes the following clauses:

(1) The type and amount of secured creditor's rights;

(2) the time limit for the debtor to perform the debt;

(3) The name and quantity of the mortgaged property.

(4) Scope of guarantee.
