Relevant legal knowledge: the guarantee of property preservation The State Compensation Law stipulates that compensation caused by property preservation errors shall be borne by the people's court. Therefore, in practice, when the parties file an application for property preservation, the court will generally require the applicant to provide corresponding guarantees. The guarantee method is generally cash or physical mortgage. If the parties do not have enough cash and corresponding physical objects, they can also apply for a guarantee from the guarantee company. The guarantee provided by the guarantee company is generally a credit guarantee, and there is no need to go through the mortgage formalities.
Article 4 of the Provisions of Beijing Higher People's Court on Several Issues Concerning Property Preservation (Trial) stipulates: "When applying for property preservation, an applicant may provide a guarantee in the following ways: (1) a guarantee provided by the applicant or a cash guarantee; (2) The third party provides credit guarantee, physical guarantee or cash guarantee; (3) Professional guarantee companies provide credit guarantees. "
