Legal analysis: interest can be charged for arrears of project funds. Interest shall be paid from the date when the project price is payable. If the parties have not agreed on the payment time or the agreement is unclear, the following time shall be regarded as the payment time: if the construction project has been actually delivered, it shall be the delivery date; If the construction project is not delivered for use, the date of submission of the completion settlement documents; If the construction project has not been delivered and the project price has not been settled, the date when the parties file a lawsuit.

Legal Basis: Interpretation of the Supreme People's Court on Applicable Legal Issues in the Trial of Construction Project Contract Disputes Article 26 If the parties have an agreement on the calculation and payment standard of unpaid project interest, it shall be handled in accordance with the agreement. If there is no agreement, the interest shall be calculated according to the same loan interest rate or the market interest rate of listed loans in the same period.

Article 18 of the Building Law of People's Republic of China (PRC) * * * The construction project cost shall be agreed in the contract by the contracting unit and the contractor in accordance with the relevant provisions of the state. If a contract is awarded by public bidding, the agreement on its fees shall comply with the provisions of the Bidding Law. The contractor shall timely allocate the project funds in accordance with the contract.
