Article 2 The investment by compatriots in Taiwan Province Province as mentioned in these Detailed Rules refers to the investment made by companies, enterprises, other economic organizations or individuals in Taiwan Province Province as investors in other provinces, autonomous regions and municipalities directly under the Central Government (hereinafter referred to as the mainland).
Article 3 The State protects the investment of compatriots in Taiwan Province Province according to law.
The investment, investment income and other legitimate rights and interests of compatriots in Taiwan Province Province are protected by state laws, and no organ, unit or individual may occupy or damage them.
Article 4 The State encourages compatriots in Taiwan Province Province to invest according to law.
Taiwan Province compatriots' investment shall enjoy preferential treatment in accordance with the relevant state laws, administrative regulations and these Detailed Rules.
Article 5 The investment of Taiwan Province compatriots shall be governed by the Investment Protection Law of Taiwan Province Compatriots in People's Republic of China (PRC) and these Detailed Rules; Where there are no provisions in the Investment Protection Law of People's Republic of China (PRC) and Taiwan Province Compatriots and these Detailed Rules, relevant foreign-related economic laws and administrative regulations of the State shall apply mutatis mutandis.
Article 6 The investment of compatriots in Taiwan Province Province shall conform to the national economic and social development plan, the national industrial policy and the investment direction, and the provisions of the state guiding the direction of foreign investment shall be applied mutatis mutandis.
Seventh Taiwan Province compatriots investors can use freely convertible currency, machinery and equipment or other physical objects, industrial property rights, non-patented technology as investment.
Investors of Taiwan Province compatriots can reinvest their investment income.
Eighth Taiwan Province compatriots can invest in the following forms according to law:
(a) the establishment of joint ventures, cooperative ventures or enterprises with all their capital invested by Taiwan Province compatriots (hereinafter referred to as enterprises invested by Taiwan Province compatriots);
(2) Cooperative exploration and development of natural resources;
(three) to carry out compensation trade, processing and assembly, cooperative production;
(4) purchasing stocks and bonds of the enterprise;
(5) purchasing real estate;
(six) to obtain land use rights, development and operation;
(seven) the purchase of small state-owned enterprises or collective enterprises and private enterprises;
(8) Other investment methods permitted by laws and administrative regulations.
Article 9 Where the investment of Taiwan Province compatriots needs to be examined and approved, the examination and approval procedures shall be handled in accordance with the procedures prescribed by relevant state laws and administrative regulations.
Article 10 To establish an enterprise invested by Taiwan Province compatriots, an application shall be submitted to the Ministry of Foreign Trade and Economic Cooperation or the department authorized by the State Council and the local people's government. The examination and approval authority that accepts the application shall decide whether to approve or not within 45 days from the date of receiving all the application documents.
After the application for establishing an enterprise with investment by compatriots in Taiwan Province Province is approved, the applicant shall, within 30 days from the date of receiving the approval certificate, register with the enterprise registration authority according to law and obtain a business license.
Eleventh the establishment of Taiwan Province compatriots investment enterprises, Taiwan Province compatriots investors shall submit the application documents to the examination and approval authority according to law; When necessary, relevant supporting documents issued by the Taiwan Province Affairs Office of the State Council or the Taiwan Province Affairs Office of the local people's government shall also be attached.
Twelfth examination and approval authorities to approve the investment of compatriots in Taiwan Province Province, should improve efficiency, reduce the management level, simplify the examination and approval procedures, so that the management system is unified, open and transparent.
Thirteenth Taiwan Province compatriots investment enterprises in accordance with the provisions of relevant state laws and administrative regulations, enjoy preferential tax treatment.
Fourteenth Taiwan Province compatriots in the central and western regions of the mainland investment projects, can be encouraged or appropriately relaxed in accordance with the relevant provisions of the state.
Fifteenth Taiwan Province compatriots investment enterprises in line with the loan principle, can be given the necessary credit support in accordance with the relevant provisions of the state.
Article 16 Individual investors of Taiwan Province compatriots and their accompanying families, employees of Taiwan Province compatriots in enterprises invested by Taiwan Province compatriots and their accompanying families may, in accordance with the provisions of relevant state laws and administrative regulations, apply to the public security organs for multiple entry and exit procedures for a certain period of time and temporary residence procedures for a corresponding period of time. The entry, exit and temporary residence procedures for foreign employees of enterprises with investment by compatriots in Taiwan Province Province shall be handled in accordance with relevant state laws and administrative regulations.
Article 17 The children of individual investors of Taiwan Province compatriots and employees of Taiwan Province compatriots in enterprises invested by Taiwan Province compatriots may attend primary schools, middle schools and institutions of higher learning in Chinese mainland in accordance with relevant state regulations.
Compatriot investors in Taiwan Province Province or Taiwan Province Compatriot Investment Enterprise Association may apply for the establishment of Taiwan Province Compatriot Children's School in areas where Taiwan Province Compatriot investment is concentrated. Schools for children of Taiwan Province compatriots established upon approval shall be subject to the supervision of the administrative department of education.
Eighteenth Taiwan Province compatriots investment enterprises in accordance with the relevant laws and administrative regulations of the state and the contract and articles of association approved by the examination and approval authority, enjoy the autonomy of operation and management.
The operational autonomy of enterprises invested by compatriots in Taiwan Province Province is protected by state laws, and no organ, unit or individual may illegally interfere with or infringe upon it.
Article 19 Enterprises invested by Taiwan Province compatriots shall enjoy the same treatment as other similar enterprises in Chinese mainland in purchasing machinery and equipment, raw materials and auxiliary materials, and obtaining services such as water, electricity, heat, freight, labor, advertising and communication.
Individual investors of Taiwan Province compatriots and employees of Taiwan Province compatriots in enterprises invested by Taiwan Province compatriots enjoy the same treatment as mainland compatriots in transportation, communication, tourism and hotel accommodation.
Twentieth Taiwan Province compatriots investment property, industrial property rights, investment income and other legitimate rights and interests, can be transferred and inherited according to law.
Twenty-first investment income, other legitimate income and funds obtained by compatriots in Taiwan Province Province according to law can be remitted back to Taiwan Province Province or abroad after liquidation.
The lawful income of employees of Taiwan Province compatriots in enterprises invested by Taiwan Province compatriots may be remitted back to Taiwan Province Province or abroad according to law.
Twenty-second investors of Taiwan Province compatriots may entrust their relatives and friends or others as their investment agents, and the agents shall hold a legally binding power of attorney.
Article 23 The charging items and standards of state organs for enterprises invested by Taiwan Province compatriots are the same as those of other similar enterprises in the mainland. No organ or unit may set up separate charging items or raise charging standards for enterprises invested by Taiwan Province compatriots.
No organ or unit may apportion manpower, material resources and financial resources to enterprises invested by Taiwan Province compatriots, or impose inspections or fines on enterprises invested by Taiwan Province compatriots beyond the provisions of laws and regulations, or force enterprises invested by Taiwan Province compatriots to participate in various training, appraisal and assessment activities in violation of state regulations or in disguised form.
Taiwan Province compatriots investment enterprises have the right to refuse and report violations of the above provisions to the relevant government departments. The government department that accepts the report shall handle it according to law and keep confidential the informant.
Article 24 The state shall not nationalize or expropriate the investment of investors from Taiwan Province compatriots; Under special circumstances, according to the needs of social public interests, the investment of Taiwan Province compatriots investors can be levied in accordance with legal procedures and given corresponding compensation. The compensation fee is equivalent to the investment value before the collection decision is made, including the interest calculated at a reasonable interest rate from the date of collection to the date of payment, and can be converted into foreign exchange, remitted back to Taiwan Province Province or remitted abroad according to law.
Article 25 The State protects the personal freedom and personal safety of individual investors of Taiwan Province compatriots and their accompanying families, and employees of Taiwan Province compatriots of enterprises invested by Taiwan Province compatriots and their accompanying families according to law. Except in accordance with the relevant laws and regulations of the state, no compulsory measures to restrict personal freedom shall be taken against compatriots in Taiwan Province Province.
Twenty-sixth in Taiwan Province Province, where enterprises with investment by compatriots are concentrated, Taiwan Province Province Association of Enterprises with Investment by Compatriots can be established according to law.
The lawful rights and interests of Taiwan Province Compatriots Investment Enterprise Association and the lawful activities carried out in accordance with its articles of association are protected by law.
Twenty-seventh people's governments at all levels should provide high-quality, standardized and convenient services for Taiwan Province compatriots to invest. The Taiwan Province Affairs Office of the people's governments at all levels shall do a good job in legal publicity and consultation, complaint acceptance and dispute settlement of investment by compatriots in Taiwan Province Province.
Article 28 Investors of Taiwan Province compatriots, enterprises with investment of Taiwan Province compatriots and enterprises with investment of Taiwan Province compatriots may apply for administrative reconsideration or bring an administrative lawsuit in accordance with the provisions of relevant state laws and administrative regulations if they think that specific administrative acts of administrative organs and their staff infringe upon their legitimate rights and interests.
Twenty-ninth investment-related disputes between investors of Taiwan Province compatriots and mainland companies, enterprises, other economic organizations or individuals can be resolved through consultation or mediation.
If the parties are unwilling to negotiate or mediate, or if negotiation or mediation fails, they may submit it to an arbitration institution in China for arbitration according to the arbitration clause in the contract or a written arbitration agreement reached afterwards. Mainland arbitration institutions may employ Taiwan Province compatriots as arbitrators in accordance with relevant state regulations.
If the parties fail to conclude an arbitration clause in the contract and fail to reach a written arbitration agreement afterwards, they may bring a lawsuit to the people's court.
Thirtieth Taiwan Province compatriots to their companies, enterprises or other economic organizations in other countries or regions as investors to invest in the mainland, these rules can be applied mutatis mutandis.
Article 31 These Rules shall come into force as of the date of promulgation.
