Hangzhou cross-border electronic commerce Comprehensive Test Zone covers the administrative area of this Municipality. Article 3 The term "cross-border electronic commerce" as mentioned in these Regulations refers to the cross-border e-commerce activities of trading subjects or trading objects belonging to different customs areas. Article 4 This Municipality promotes the development of cross-border electronic commerce, adheres to the principles of "try first, step by step, innovation and development, and standardization according to law", and establishes a mechanism of government guidance, enterprise subject and industry self-discipline. Article 5 The development of cross-border electronic commerce should embody the main features of online integration, cross-border trade and comprehensive services, improve the level of logistics customs clearance channels, single-window information system and financial value-added services, promote the integration of customs clearance, inspection and quarantine, foreign exchange, taxation, commerce, logistics and finance, promote the coordinated development of online single-window comprehensive service platform and offline comprehensive park platform, and build a national cross-border electronic commerce Entrepreneurship and Innovation Center with convenient investment and trade, efficient supervision services and optimized legal environment. Chapter II Management System Article 6 The Municipal People's Government shall establish a coordination mechanism for cross-border electronic commerce's construction leadership, strengthen the organization, leadership and overall coordination of cross-border electronic commerce's construction work, formulate relevant policies for cross-border electronic commerce's construction, development and management according to law, regularly study major issues, organize relevant departments to formulate and implement phased goals, and coordinate and promote cross-border electronic commerce's construction work and innovative development. Article 7 The China (Hangzhou) cross-border electronic commerce Comprehensive Experimental Zone Management Office established by the Municipal People's Government (hereinafter referred to as the cross-border electronic commerce Comprehensive Experimental Office) is responsible for the construction and overall management of Hangzhou cross-border electronic commerce Comprehensive Experimental Zone, and shall perform the following duties in accordance with the provisions of these Regulations:
(a) to implement the laws and regulations related to the comprehensive test work in cross-border electronic commerce and the relevant policies of the state, province and city, study the problems related to the development of cross-border electronic commerce, cooperate with customs, inspection and quarantine, foreign exchange management, taxation and other departments, simplify and optimize the supervision process, promote institutional innovation, explore the construction of management systems and rules, and promote the development of cross-border electronic commerce;
(two) the preparation of cross-border electronic commerce comprehensive test area development plan, organized and implemented after the approval of the Municipal People's government;
(3) Coordinate the functional layout of the offline park in Hangzhou cross-border electronic commerce Comprehensive Test Zone, coordinate and supervise the construction and management of the offline park, be responsible for the construction of the investment network in Hangzhou cross-border electronic commerce Comprehensive Test Zone, and guide the investment promotion work in cross-border electronic commerce;
(4) Organizing innovative research on cross-border electronic commerce's technical standards, business processes, and regulatory models for trading, payment, logistics, customs clearance, tax refund, and foreign exchange settlement, and promoting the formation of cross-border electronic commerce's trading rules and standards;
(5) To be responsible for the informatization work in cross-border electronic commerce, organize the construction and management of a single-window integrated service platform, establish an information exchange and sharing mechanism, build a credit evaluation and statistical monitoring system in cross-border electronic commerce, implement credit evaluation and classified supervision, and promote the information interconnection among information flow, capital flow and cargo flow;
(6) To be responsible for the construction of risk prevention and control system in cross-border electronic commerce, organize professional risk analysis in the whole process of cross-border electronic commerce, and prevent and control economic risks, technological risks and trading risks;
(seven) to organize the construction of financial services and intelligent logistics system in cross-border electronic commerce, and promote the integrated development of cross-border electronic commerce and warehousing, logistics, finance and other industries;
(eight) responsible for the construction of talent system in cross-border electronic commerce;
(nine) to perform other duties entrusted by the Municipal People's government.
District, county (city) people's government should be clear about the competent department of cross-border electronic commerce, specifically responsible for promoting the development of cross-border electronic commerce within their respective administrative areas. Article 8 The resident offices established in cross-border electronic commerce by the customs, inspection and quarantine, foreign exchange administration and taxation departments (hereinafter referred to as resident offices) shall perform relevant management duties according to law.
Other relevant departments of the Municipal People's Government and the relevant district and county (city) people's governments shall, in accordance with their respective responsibilities, do a good job in relevant management. Article 9 The cross-border electronic commerce Comprehensive Experimental Office shall establish a working mechanism of cooperation, coordination and linkage with the resident institutions and relevant departments, provide necessary guarantee for the resident institutions and relevant departments to supervise according to law, and study and solve the problems in the development of Hangzhou cross-border electronic commerce Comprehensive Experimental Zone. Tenth to encourage cross-border electronic commerce operators, third-party e-commerce trading platform to establish industry self-discipline system, give play to the role of industry organization autonomy.
Cross-border electronic commerce industry autonomous organizations should study the development direction of cross-border electronic commerce industry, explore the law of industry development, promote the formulation and implementation of trade regulations and quality standards, standardize business practices, safeguard the legitimate rights and interests of operators and industry reputation according to law, guide the standardized development of cross-border electronic commerce, and promote fair competition. Chapter III Development Planning Article 11 The development plan of cross-border electronic commerce in the whole city shall be compiled by the cross-border electronic commerce Comprehensive Test Office in conjunction with relevant departments according to the requirements of the state, province and city to promote the standardized development of cross-border electronic commerce, and shall be implemented after being approved by the Municipal People's Government.
The development plan of cross-border electronic commerce in this Municipality shall define the core area of industrial development, industrial application economic circle and industrial development belt of cross-border electronic commerce, and form the overall layout of global coverage.
