(1) The buyer bought it knowing it was stolen goods: if the original thing still needs to be recovered, it shall be recovered free of charge; If the original thing has been consumed or does not need to be recovered, the buyer shall be ordered to make restitution at the purchase price; If the original thing is bought again, the price will be changed;
(2) The buyer buys the goods without knowing that they are stolen goods: if the original goods still need to be recovered, the criminals will redeem the original goods at the selling price; If the original thing has been consumed or does not need to be recovered, the criminal shall compensate for the losses; If the original thing still needs to be recovered after being sold, the criminal or seller shall redeem the original thing at the original price. Eighth weapons, ammunition, explosives, toxic substances, radioactive substances, drugs, obscene articles, superstitions and other contraband. Those illegally obtained by criminals must be confiscated. Article 9 If a criminal redeems stolen goods or compensates for losses, it shall be paid by his economic income or offset by his own property. Juvenile criminals who have no economic income or property shall be properly compensated for their losses by their parents or other guardians, unless the unit is the guardian. Article 10 If the buyer does not know that it is stolen goods and the criminal is unable to redeem or compensate the owner for the losses, mediation can be conducted according to the actual situation of the buyer and the owner and the principle of sharing economic losses. If mediation fails, the people's court, people's procuratorate or public security organ shall decide to implement it. Article 11 If the buyer refuses to hand over the stolen goods that need to be handed over or certified for crops, the people's court, people's procuratorate or public security organ shall seize them according to the provisions of Article 34 of the Criminal Procedure Law of People's Republic of China (PRC). Chapter iii custody and disposal of recovered stolen money and goods article 12 the case-handling organ must register and record, designate a special person to be responsible for it and keep it properly. It is forbidden to intercept, deduct commissions, divide them among themselves, damage, misappropriate, exchange or occupy them, or auction them by themselves. Article 13 The stolen money and goods collected by people's courts, police stations and security organizations of state organs, public organizations, enterprises and institutions must be listed one by one and promptly turned over to people's courts, people's procuratorates or public security organs at or above the county level. Article 14 In the course of criminal proceedings, the recovered stolen money and goods shall be transferred with the case. Among them, valuables that are inconvenient to carry and need to be properly kept, stolen money and contraband that are dealt with first in accordance with the provisions of these regulations, must be transferred to the list and physical photos with the case. Article 15 The recovered money and stolen goods must be handled by people's courts, people's procuratorates and public security organs at or above the county level. The stolen money and goods in the case decided by the people's court shall be judged together with the judgment; Illegal money and stolen goods in cases directly handled by people's procuratorates or public security organs shall be decided at the time of closing the case. Article 16 The recovered stolen money and goods shall be handled by the closing organ according to the following circumstances:
(a) robbery, theft, fraud, looting, extortion of property belonging to state organs, organizations and state-owned enterprises and institutions shall be turned over to the state treasury, except that the unit has reported the case and the people's court, people's procuratorate or public security organ decides to return it to the original unit; Party dues, tour fees, union fees, staff canteens and other properties belonging to collective ownership units or collective welfare institutions shall be returned to the original units; Legal property belonging to an individual shall be returned to the individual;
(2) Corrupted property belonging to organs, organizations, state-owned enterprises and institutions shall be turned over to the state treasury; Others were returned to their original owners;
(three) illegal income such as smuggling, speculation, profiteering, human trafficking, bribery and gambling. Confiscated by any unit or individual and turned over to the state treasury;
(4) As mentioned in Item (1) of Article 7, the compensation and change price returned by the buyer shall be confiscated and turned over to the state treasury, except that the criminals are unable to return the compensation.
