Article 1 In order to implement the requirements of strictly administering the Party in an all-round way, strengthen the management and supervision of leading cadres, and promote leading cadres to abide by discipline and rules and be honest in politics, these Provisions are formulated in accordance with other relevant laws and regulations of party constitution and the state.

Article 2 The leading cadres mentioned in these Provisions include:

(1) Cadres at or above the county level in Party organs, people's congresses, administrative organs, CPPCC organs, judicial organs, procuratorial organs and democratic party organs at all levels (including non-leading cadres, the same below);

(2) Cadres at or above the county level in people's organizations and institutions managed by reference to the Civil Service Law shall not be counted as members of the leading bodies of people's organizations and institutions managed by reference to the Civil Service Law and leaders of internal management institutions (equivalent to above the county level);

(3) members of the leading bodies of central enterprises and managers at or above the middle level, and members of the leading bodies of state-owned enterprises managed by provinces (autonomous regions and municipalities directly under the Central Government) and cities (prefectures and leagues).

These Provisions shall apply to those who have retired from their current posts within the above-mentioned scope and have not yet gone through retirement procedures.

Article 3 Leading cadres shall report the following matters: marriage, spouse, children leaving the country, employment, etc.

(1) My marital status;

(2) I hold an ordinary passport and go abroad for personal reasons;

(3) I have a pass to and from Hong Kong and Macao, a pass to and from Taiwan for mainland residents, and travel to and from Hong Kong, Macao and Taiwan Province Province for personal reasons;

(4) The marriage of children with foreigners and stateless persons;

(five) the marriage of children with residents of Hong Kong, Macao and Taiwan provinces;

(6) The situation that the spouse and children have moved outside the country (territory), or the situation that they have not moved outside the country (territory) for more than 1 year;

(7) The employment of spouses, children and their spouses, including the employment of senior positions in private enterprises, the appointment and appointment of senior positions by Chinese and foreign parties in representative offices of wholly foreign-owned enterprises, Sino-foreign joint ventures and overseas non-governmental organizations in China, and the employment and employment outside the country (territory);

(eight) the spouse, children and their spouses are investigated for criminal responsibility by judicial organs.

The children mentioned in these Provisions include the legitimate children, illegitimate children, adopted children and stepchildren with dependency relationship of leading cadres.

The term "outside the country of emigration" as mentioned in these Provisions refers to obtaining foreign nationality or permanent residence qualification and long-term residence permit outside the country (territory).

Fourth leading cadres should report the following income, real estate, investment and other matters:

(1) My salary and various bonuses, allowances and subsidies;

(two) income from giving lectures, writing, consulting, reviewing manuscripts, painting and calligraphy;

(3) Information on the property, garage, parking space, storage room, etc. where I, my spouse and children living with * * * are the owners or * * * are the owners. There is a separate property ownership certificate (the registered property area is subject to the property ownership certificate, and the unregistered property area is subject to the registered house sales contract);

(4) I, my spouse and children living together invest or hold stocks, funds and investment insurance in other ways;

(5) Information on the business enterprises run by spouses, children and their spouses, including investment in unlisted joint stock limited companies, limited liability companies, registered individual industrial and commercial households, sole proprietorships and partnerships, etc. And register a company or invest in shares outside the country (territory);

(six) I, spouse, children living together * * * deposits and investments outside the country (territory).

The term "* * * children living together" as mentioned in these Provisions refers to the underage children of leading cadres under the age of 18 and the adult children who are raised by them and cannot live independently.

The term "stocks" as mentioned in these Provisions refers to stocks issued, traded or transferred in Shanghai Stock Exchange, Shenzhen Stock Exchange and the national share transfer system for small and medium-sized enterprises. The so-called "funds" refer to publicly issued funds and private equity funds in China. The so-called "investment insurance" refers to insurance products with dual functions of protection and investment, including life insurance investment insurance and property insurance investment insurance.

Article 5 Leading cadres shall make a centralized report on the matters listed in Articles 3 and 4 of the present Provisions in the previous year before June 65438+1October 3 1 every year, and be responsible for the authenticity and completeness of the contents of the report and consciously accept supervision.

Persons who do not belong to the scope listed in Article 2 of these Provisions, who intend to be promoted to the scope listed in Article 2 of these Provisions, or candidates for reserve cadres who intend to be included in the scope listed in Article 2, shall report personal matters when they intend to be promoted or included.

If the personnel listed in Article 2 of these Provisions resign from public office, they shall report personal matters at the same time when applying for resignation.

Article 6 After the annual centralized report, leading cadres shall report the matters listed in Article 3 of these Provisions within 30 days afterwards. If it cannot be reported on time due to special reasons, it shall be reported in time after the special reasons are eliminated, and the reasons shall be explained.

Seventh leading cadres report personal matters, according to the cadre management authority by the corresponding organization (personnel) department is responsible for accepting:

(a) the central management of leading cadres report to the Central Organization Department, and the report materials are read and signed by the main person in charge of the unit where the leading cadres work, and audited by the organization (personnel) department of the unit where they work.

(two) the leading cadres who belong to the management of this unit report to the organization (personnel) department of this unit; Leading cadres who do not belong to the management of this unit shall report to the organization (personnel) department of the Party Committee (Party Group) at the next higher level, and the report materials shall be handed over to the organization (personnel) department of the unit where the leading cadres belong after being read and signed by the main person in charge of this unit.

If the accepting institution of leading cadres changes due to work changes, the original accepting institution shall, within 30 days, transfer all the report materials of the leading cadres to the new accepting institution according to the cadre management authority.

Eighth leading cadres in the implementation of these provisions, that there is a need for instructions, you can ask the organization (personnel) department to accept the report. The organization (personnel) department that accepts the report should seriously study and reply in time.

Article 9 The organization (personnel) department shall summarize and synthesize the personal matters reported by leading cadres every year and report them to the organization (personnel) department of the Party committee (party group) at the same level and the Party committee (party group) at the next higher level.

Tenth organizations (personnel) departments in the supervision and selection and appointment of cadres, in accordance with the cadre management authority, with the approval of the person in charge of the organ and the unit, can consult the personal matters related to the report of the leading cadres.

Discipline inspection and supervision organs (institutions) in performing their duties, in accordance with the cadre management authority, with the approval of the person in charge of the organ, can consult the relevant leading cadres to report personal matters.

During the inspection work, the inspection agency may, according to the needs of the work and with the approval of the person in charge of the inspection work leading group, consult the materials on personal matters reported by leading cadres.

When investigating and handling a duty crime case, the procuratorial organ may, with the approval of the person in charge of the organ, consult the personal related matters reported by the leading cadres involved.

Eleventh organizations (personnel) departments shall, in accordance with the cadre management authority, check the authenticity and completeness of personal matters reported by leading cadres. Inspection methods include random inspection and key inspection.

Random sampling is conducted once a year, and the sampling rate is 10%.

The main audit objectives include:

(a) the proposed promotion is the object of investigation within the scope listed in Article 2 of these Provisions;

(two) candidates for reserve cadres included in the scope listed in Article 2 of these Provisions;

(3) the candidate to be further used;

(four) due to personal reporting matters need to be verified;

(five) other need to check.

Discipline inspection and supervision organs (institutions), inspection agencies and procuratorial organs may, when performing their duties, entrust the organization (personnel) department to check the authenticity and completeness of personal matters reported by leading cadres in accordance with the cadre management authority after performing the examination and approval procedures in accordance with Article 10.

Twelfth audit found that the family property of leading cadres significantly exceeded the normal income, it should be required to explain, if necessary, to verify the legitimacy of the source of their property.

Thirteenth leading cadres in any of the following circumstances, according to the seriousness of the case, give criticism and education, organizational adjustment or organizational treatment, disciplinary action.

(1) Failing to report on time without justifiable reasons;

(two) omission, underreporting;

(3) Concealing or not reporting;

(four) the audit found other violations of discipline.

Article 14 Party committees (leading bodies) and their organizations (personnel) departments should take the audit results as an important reference to measure whether leading cadres are loyal, upright and honest, and apply them to the selection, appointment, management and supervision of cadres. Those who are promoted and used without inspection or fail to deal with the problems found in the inspection according to the regulations shall be investigated for the responsibility of party committees (party groups), organization (personnel) departments and their relevant leading members.

Article 15 The Organization Department of the Central Committee and the Organization Department of the local Party Committee take the lead in establishing a working mechanism for reporting, checking and contacting leading cadres on related matters, and are responsible for organizing implementation and coordination. Members of the audit liaison mechanism include judicial, procuratorial, diplomatic (foreign affairs), public security, civil affairs, land and resources, housing and urban construction, people's bank, taxation, industry and commerce, financial supervision and other units. Each member unit shall be responsible for the inquiry of relevant information, and truthfully provide the inquiry results to the organization department within the specified time.

Sixteenth organization (personnel) departments and members of the audit liaison mechanism shall strictly abide by the work discipline and confidentiality discipline, and designate special personnel to properly keep the personal reports of leading cadres and materials such as summary, synthesis and audit. Those who violate work discipline and confidentiality discipline, or who are perfunctory and engage in malpractices in audit work, shall be held accountable.

Seventeenth organizations (personnel) departments should strengthen the supervision and inspection of the implementation of these provisions.

Eighteenth the Central Military Commission (CMC) can be based on the regulations, combined with the actual situation of the China People's Liberation Army and the Chinese People's Armed Police Force, formulate relevant regulations.

Article 19 Party committees of all provinces, autonomous regions and municipalities directly under the Central Government may, in accordance with these Provisions and in light of the actual situation, formulate specific measures and submit them to the Organization Department of the Central Committee for approval before implementation.

Article 20 The Organization Department of the CPC Central Committee shall be responsible for the interpretation of these Provisions.

Article 21 These Provisions shall come into force on February 8, 20 17. On may 26th, 20 10, the regulations on reporting personal matters by leading cadres shall be abolished at the same time.
