Article 1 In order to implement the spirit of the Notice of the State Administration of Foreign Exchange and the General Administration of Quality Supervision, Inspection and Quarantine (Huifa [2002] No.24), effectively improve foreign exchange supervision, improve the quality of balance of payments statistics and monitoring data, and ensure the comprehensiveness, accuracy and unification of the applicant's basic information.
Article 2 The State Administration of Foreign Exchange entrusts the National Organization Code Management Center of the General Administration of Quality Supervision, Inspection and Quarantine to handle the distribution of special organization codes. The branches of the State Administration of Foreign Exchange in all provinces, autonomous regions and municipalities directly under the Central Government, the foreign exchange administration departments and the branches of Shenzhen, Dalian, Qingdao, Xiamen and Ningbo (hereinafter referred to as the branches of the foreign exchange administration) are responsible for the application and management of the codes of professional institutions under their jurisdiction. The State Administration of Foreign Exchange is responsible for coordinating the application and coding of domestic special institution codes, and the National Organization Code Management Center is responsible for the coding of special institution codes, the prevention of rechecking errors and the installation and maintenance of the special institution code coding system (hereinafter referred to as the coding system) in the balance of payments statistical declaration.
Article 3 The term "special institutions" as mentioned in these Measures refers to the reporting institutions that are not within the scope of the formal organization code given by the National Organization Code Management Center and really need to be uniformly identified to handle revenue and expenditure business, including some domestic institutions (army, armed police, etc.). ), overseas institutions (including institutions in Hongkong, Macau and Taiwan Province provinces, hereinafter referred to as overseas institutions), embassies and consulates in China, international organizations in China, etc.
The special organization code refers to the special code given to the special organization by the National Organization Code Management Center, which is only used by the organization when handling the declaration of international payments. This code is not used as proof that a special institution is recognized as an effective institution.
Article 4 Banks handling foreign-related payments shall examine the People's Republic of China (PRC) Organization Code Certificate (hereinafter referred to as "Code Certificate") of the institutions that apply for international payments statistics for the first time, and verify its validity.
(1) If the institution does not have a code certificate, but belongs to the domestic institutions of the military and armed police, overseas institutions or institutions of embassies and consulates in China or international organizations in China as stipulated in Article 3 of these Provisions, the specialized institution code shall be handled according to the following procedures:
1. The institution shall issue a valid certificate containing its accurate, complete and standardized name or the approval or certificate of its competent department to the bank. On the same day, the bank will notify the corresponding foreign exchange branch or the local foreign exchange branch with the numbering system in the format of "Application Form for Special Institution Code" (table 1). The bank shall review the name of the applicant institution to ensure that the name of the institution is consistent with the name or reserved seal in the account opening document. The bank shall keep a copy of the valid certificate or approval issued by the institution for 24 months.
2. After receiving the application form, the branches and sub-branches of the foreign exchange bureau shall apply for the special organization code to the National Organization Code Management Center through the coding system within 1 working days, and keep the corresponding application form.
3. The National Organization Code Management Center shall, after reviewing the application requests submitted by the branches of the foreign exchange bureau, give the organization a special code in real time through the coding system and return it to the corresponding branches of the foreign exchange bureau.
4. After receiving the special agency code issued by the National Organization Code Management Center, the branches and sub-branches of the foreign exchange bureau will print out the Notice on the Allocation of Special Agency Code (by Bank) (Table 2) and the Notice on the Allocation of Special Agency Code (Table 5) within this working day, and notify the corresponding banks.
5. After receiving the Notice of Distribution of Special Institution Codes from the branches of the foreign exchange bureau, the bank shall keep the Notice of Distribution of Special Institution Codes (Bank) and notify the applicant to receive the Notice of Distribution of Special Institution Codes within this working day.
(2) For domestic institutions with invalid organization code certificates, domestic institutions without organization code certificates and not belonging to the army or armed police, special organization codes shall be handled according to the following business operation procedures:
1. Banks that handle foreign-related receipts and payments should fill in the column of "Fill in by Bank" in the Coordination Table for Code Application of Special Organizations (hereinafter referred to as the Coordination Table, see Schedule 3), and require institutions to fill in the column of "Fill in by Institution" and apply for a code certificate at the code working institution of the local quality and technical supervision department.
2. If it is verified by the code working organization of the local quality and technical supervision department that it belongs to its assigned code range, the organization shall apply for the organization code in accordance with the provisions; Does not belong to the scope of code assignment, the local quality and technical supervision department code work organization should fill in the column of "code management center opinions" within the co-organizer within this working day, and notify the organization to handle the special agency code with the local foreign exchange bureau branches and co-organizers; The code working organization of the local quality and technical supervision department shall keep a joint sponsorship form for reference when the organization becomes a formal organization in the future.
3. After receiving the co-sponsorship form, the branches and sub-branches of the foreign exchange bureau that have installed the coding system should apply for the special organization code to the National Organization Code Management Center through the coding system within 1 working days, and keep the relevant co-sponsorship form; After receiving the Co-sponsorship Form, the branches and sub-branches of the foreign exchange bureau that have not installed the coding system shall summarize the List of Code Application for Special Institutions within 1 working days, fill in the Application Form for Code of Domestic Special Institutions (Table 4), submit the application form to the branches and sub-branches of the foreign exchange bureau, and keep the relevant Co-sponsorship Form.
4. Each branch of the foreign exchange bureau shall, after receiving the Application Form for the Code of Special Institutions in China submitted by the branches within its jurisdiction or the Co-sponsorship Form for Special Institutions in China issued by the code work organization, apply for the code of special institutions to the National Organization Code Management Center through the coding system within 1 working days, and keep the corresponding application form or co-sponsorship form.
5. The National Organization Code Management Center shall, after reviewing the application requests submitted by the branches of the foreign exchange bureau, give the organization a special code in real time through the coding system and return it to the corresponding branches of the foreign exchange bureau.
6. After receiving the special institution code issued by the National Organization Code Management Center, the branches and sub-branches of the foreign exchange bureau shall print the Notice on the Distribution of Special Institution Code (Table 5) and the Notice on the Distribution of Domestic Special Institution Code (Table 6) within this working day, and notify the applicant institution or the corresponding branches and sub-branches of the foreign exchange bureau within its jurisdiction.
7. After receiving the Notice of Special Institution Code Assignment from the SAFE, the branches and sub-branches of the SAFE without the distribution system shall notify the applicant to collect the Notice of Special Institution Code Assignment within this working day (Table 5).
Article 5 The storage period of the joint form and application form is 24 months.
Article 6 An institution that has been transformed from a specialized agency into one that conforms to the code distribution scope of the National Organization Code Management Center shall, in accordance with the application requirements for organization code, re-apply for the organization code at the code office of the local quality and technical supervision department. When applying for the organization code, such institutions should present the Notice of Assigning their Special Organization Code to the code working institution to ensure the uniqueness of the organization code.
Article 7 Branches and sub-branches of foreign exchange bureaus that have installed the coding system shall back up the coding information and regularly maintain the coding information and coding system.
Article 8 The National Organization Code Management Center will give feedback to the State Administration of Foreign Exchange within 5 working days after the next month. The State Administration of Foreign Exchange regularly publishes the information of special institutions and their codes on the internal network of the foreign exchange bureau system for all branches to inquire, so as to reduce the burden of repeatedly applying for the codes of special institutions. The national organization code management center shall do a good job of data backup, and regularly provide specialized institutions and their codes to local code working institutions to facilitate their checking and management of organization codes.
Article 9 These Rules shall come into force as of the date of promulgation.
