All employers in China are required to establish trade union organizations.

According to Article 10 of the Trade Union Law of the People's Republic of China, trade union organizations should be established in all types of enterprises, institutions and agencies;

Basic trade union committees should be established individually, and basic trade union committees should be established jointly by members of two or more units, and an organizer may also be elected to organize the activities of the members. Where there are a large number of female workers, a trade union committee for female workers shall be established and work under the leadership of the trade union at the same level; where there are a small number of female workers, a committee for female workers shall be set up in the trade union committee.

Conditions for the Formation of Grassroots Trade Union Committees

Article 25, paragraph 1, of the Constitution of the Trade Union of China stipulates that enterprises, institutions, organs, other social organizations and other grass-roots units shall establish trade union organizations in accordance with the law. Communities and administrative villages may establish trade unions.

If there are more than 25 members, a grass-roots trade union committee shall be established; if there are fewer than 25 members, a separate grass-roots trade union committee may be established, or a grass-roots trade union committee may be established consisting of two or more members, or an organizer or trade union chairman may be chosen to preside over the work of the grass-roots trade union.

Article 10 of the Trade Union Law of the People's Republic of China*** and the State of China stipulates that enterprises, institutions and agencies with more than 25 members shall establish grass-roots trade union committees; with fewer than 25 members, they can either establish a separate grass-roots trade union committee or establish a grass-roots trade union committee by two or more members*** of the unit, or they can choose an organizer to organize the members to carry out their activities .
