Article 2: Those who engage in construction project quality testing activities within the administrative area of ??Weihai City (hereinafter referred to as this city) and implement supervision and management of construction project quality testing activities must abide by these detailed rules.
The term construction project quality inspection (hereinafter referred to as quality inspection) as mentioned in these detailed rules refers to the project quality inspection agency (hereinafter referred to as the inspection agency) that is entrusted to conduct, in accordance with relevant national laws, regulations and mandatory engineering construction standards, Conduct sampling inspections on structural safety and main functional items involving housing construction and municipal infrastructure, and witness sampling inspections on building materials and components entering the construction site.
Article 3 The Weihai Municipal Construction Committee (hereinafter referred to as the Municipal Construction Committee) is responsible for the supervision and management of the city’s construction project quality inspection activities. The construction administrative departments of each city (district) are responsible for the supervision and management of construction project quality inspection activities within their jurisdiction.
The Weihai Construction Project Quality Cost Supervision and Management Station (hereinafter referred to as the Weihai Quality Supervision Station) is responsible for the specific work of approving and filing the qualifications of the city's construction project quality inspection institutions, and supervising and inspecting testing activities. The construction project quality supervision agencies affiliated to the construction administrative departments of each city (district) are responsible for supervising and inspecting testing activities within the administrative areas under their jurisdiction.
Article 4: The testing agency is an intermediary agency with independent legal personality. Inspection agencies engaged in the quality inspection business specified in Annex 1 of these rules shall obtain a qualification certificate issued by the Shandong Provincial Construction Engineering Administration (hereinafter referred to as the Provincial Construction Administration).
Testing agency qualifications are divided into special testing agency qualifications and witness sampling testing agency qualifications according to the testing business content they undertake (testing agency qualification standards are specified in Appendix 2). Testing institutions that have not obtained the corresponding qualification certificate shall not undertake the quality testing business specified in Appendix 1 of these rules.
Testing units engaged in engineering quality inspection business beyond the scope specified in Annex 1 of these rules shall submit a filing application to the Weihai Quality Supervision Station. If the filing is not made or the filing fails, the inspection unit issued by it shall The report shall not be used as completed technical data.
Chapter 2
Article 5 When applying for testing qualifications, a testing institution shall submit the following application materials:
(1) "Testing Institution Qualification Application Form" in duplicate Three copies;
(2) Original and copy of industrial and commercial business license;
(3) Original and copy of shareholder composition and capital verification certificate;
(4) ) The original and copy of the metrological certification certificate corresponding to the scope of the applied testing qualification;
(5) Main testing instruments, equipment list, metrological verification certificate, and certificate of fixed office space;
< p>(6) Originals and copies of technical personnel’s professional title certificates, ID cards, training certificates, labor contracts and social insurance certificates;(7) Testing agency management systems and quality control measures;< /p>
(8) All application materials should be in two forms: written and electronic.
Qualified testing agencies will report to the Provincial Construction Management Bureau.
Testing units applying for testing of items other than testing qualifications shall submit filing management application materials to the Weihai Quality Supervision Station in accordance with the above requirements.
The measurement certification certificate of the testing agency must be completely consistent with the unit name in the industrial and commercial business license. Copies submitted by the testing agency must be stamped with the official seal of the unit.
The professional scope of technical personnel training should cover the projects for which the testing agency applies for qualifications, and meet the actual needs of carrying out testing work.
The "Testing Agency Qualification Application Form" adopts the format uniformly formulated by the Ministry of Construction. Qualification application units can download it from the Ministry of Construction website.
Article 6: A testing agency may apply for special testing qualifications for multiple or one of the four special projects listed in Annex 1, and its registered capital shall not be less than 1 million yuan; apply for witness sampling testing qualifications The registered capital shall not be less than RMB 800,000; if a testing institution applies for special testing qualifications and witness sampling testing qualifications at the same time, the registered capital shall not be less than RMB 1.8 million.
Article 7: After accepting the application materials, the Municipal Construction Committee shall verify the application materials according to the standards specified in Attachments 1 and 2, and sign opinions on the verification results in the "Application Form for Qualification of Testing Institutions".
After receiving the applicant’s application materials, the Municipal Construction Committee will verify whether the results meet the standards within 20 working days. If the standards are met, the results will be reported to the Provincial Construction Management Bureau. If the standards are not met, a written notice shall be issued to inform the applicant.
Article 8: The Provincial Construction Management Bureau shall uniformly produce, number, and issue the "Qualification Certificate for Testing Institutions". The certificate indicates the scope of testing business and is divided into originals and duplicates. The originals and duplicates have the same legal effect.
The qualification certificate of the testing agency is valid for 3 years.
If the qualification certificate expires and needs to be extended, the testing agency shall apply to the Municipal Construction Committee for a qualification review 60 working days before the qualification certificate expires, and apply to the Provincial Construction Management Bureau for extension procedures 30 working days after passing the reexamination. Those who fail to review or apply for extension procedures after the validity period of the qualification certificate expires will be deemed to have automatically given up their qualifications and are not allowed to continue to engage in testing activities in Weihai City.
If the testing agency does not do the following during the validity period of the qualification certificate, when the validity period of the qualification certificate expires, with the consent of the Provincial Construction Management Bureau, the validity period of the qualification certificate will be extended for 3 years, and the original approving department will add " Stamp special stamp for extension.
If a testing agency commits any of the following acts during the validity period of the qualification certificate, the original approval department will not grant an extension. After expiration, the qualification certificate will become invalid and no application for qualification will be allowed within one year:
(1) Engaging in testing activities beyond the scope of qualifications;
(2) Subcontracting testing business;
(3) Alteration, reselling, renting, lending or other illegal forms Transferring qualification certificates;
(4) Failure to conduct testing in accordance with national mandatory standards for engineering construction, causing quality and safety accidents or increasing accident losses;
(5) Forging testing Data, issuing false test reports or appraisal conclusions;
(6) Maliciously lowering prices to disrupt market order.
Article 9 Testing agencies shall not have affiliations with administrative agencies, organizations authorized by laws and regulations with the function of managing public affairs, and design units, construction units, and supervision units related to the projects being tested. or other interests.
Chapter 3 Responsibilities and Obligations
Article 10 The testing agency and the legal representative are responsible for the authenticity of the application materials for qualification application, and are responsible for the completeness and integrity of the test report and test data. Responsible for accuracy and authenticity.
The project quality acceptance data should be the original of the test report. If the original test report is indeed lost and a copy of the test report needs to be used, it should be reviewed by the original testing agency. After it is determined to be correct, it should be The quality manager of the testing institution shall sign and stamp the special seal for testing.
Article 11: No unit or individual may alter, resell, rent, lend or otherwise illegally transfer qualification certificates.
If the testing agency changes its name, address, legal representative, or technical director, it must notify the Weihai Municipal Construction Committee within one month and go to the original approval authority to go through the change procedures within three months.
If a testing institution is restructured, divided, or merged, its testing qualifications shall be re-verified in accordance with the application and approval procedures stipulated in these rules.
If the testing agency is dissolved, the qualification certificate shall be returned to the original issuing authority within one month for cancellation.
Article 12: The testing agency shall establish a separate account of projects with unqualified test results and report them to the project quality supervision agency where the project is located every month. The testing agency shall report any violation of relevant laws, regulations and mandatory engineering construction standards by construction units, supervision units, and construction units discovered during the testing process, as well as unqualified situations involving structural safety testing results, to the construction site where the project is located within 24 hours. Administrative authorities.
Article 13 The testing agency should establish an information management system for testing work. Article 14: Inspection agencies shall establish an archives management system in accordance with the "Shandong Province Construction Project Quality Inspection Archives Management Measures (Interim)". Testing contracts, entrustment orders, original records, and test reports should be numbered uniformly by year. When filing, the order form, original records, and test reports should be filed individually. The numbers should be consecutive and cannot be withdrawn or altered at will. The actual storage period of long-term archives shall not be shorter than 10 years, and the actual storage period of short-term archives shall not be shorter than 5 years.
The file management of testing institutions implements the legal person responsibility system. Testing institutions should clearly identify the departments or personnel who manage files to ensure the completeness, accuracy and safety of files.
Article 15 After completing the testing business, the testing agency shall issue the testing report according to the written commitment or agreed time. If there is no commitment or no agreed time, it shall issue it within 4 days after accepting the entrustment (32 days for cement, The general mix ratio is 34 days, the concrete admixture is 3 days after the standard test age, and the special test is 5 days after the test is completed). The test report can only take effect after it is signed by the tester, signed by the legal representative of the test institution or its authorized signatory, and stamped with a special test seal. The special stamps for testing are uniformly numbered, formulated and issued by the Provincial Construction Management Bureau. After the test report is confirmed by the construction unit or project supervision unit, it shall be filed by the construction unit.
Article 16 No unit or individual may expressly or imply that a testing agency issues a false test report, or tamper with or forge a test report.
Article 17: Testing institutions should provide relevant testing technology training to technical persons in charge of testing activities and test report issuers, reviewers, and operators. The training content mainly covers relevant laws, regulations, professional foundations, technical standards, measurement certification and other knowledge. The training method should be combined with actual work, focus on actual results, and adopt a combination of entrusting professional institutions to conduct business training and testing institutions to conduct operational skills training. The Provincial Construction Management Bureau organizes a unified assessment of the training results of inspection personnel. The "Management Manual for Engineering Quality Inspection Personnel" is issued and managed uniformly. Only those with the manual can engage in corresponding engineering quality inspection work.
Testing personnel shall not be employed by two or more testing agencies at the same time.
Testing agencies and testing personnel shall not recommend or supervise the production of building materials, components and equipment.
Article 18 If a testing agency violates laws, regulations and mandatory engineering construction standards and causes losses to others, it shall bear corresponding liability for compensation in accordance with the law.
Article 19 If any interested party disputes the test results, the test results shall be re-inspected by a testing institution mutually recognized by both parties. If re-inspection is impossible or there is a dispute over the re-inspection result, it shall be resolved through arbitration or judicial proceedings. The re-inspection results or dispute resolution results shall be reported to the local construction administrative department for record by the party initiating the re-inspection.
Article 20: For the quality inspection business specified in Appendix 1 of these detailed rules, the project construction unit shall entrust a testing institution with corresponding qualifications to conduct inspection. The construction unit shall report the testing agency responsible for the project's testing business at the same time when handling the quality supervision procedures for the construction project. Projects for which the testing agency has not been determined will not be subject to supervision procedures. The entrusting party and the entrusted party shall sign a written contract.
The construction unit may entrust one or more of the special inspection services of the unit project to one inspection agency; the construction unit shall not split the inspection items in a special inspection project and then entrust them to other inspection institutions.
For some testing projects that are highly professional, require large investment in testing facilities, and have small business volume, the Weihai Quality Supervision Station will reasonably coordinate the relevant parties, establish a central laboratory based on the advantages of each testing institution, and centralize business In order to facilitate the sharing of resources and improve the city's testing level of projects.
Testing agencies are not allowed to subcontract testing services.
Article 21: The testing agency and the client shall collect and pay testing fees in accordance with relevant regulations. Testing institutions should clearly indicate the charging standards for various testing services. Do not maliciously lower prices or lower testing standards and service levels.
Article 22: Testing institutions shall establish a test sample retention system. Samples that are clearly required to be retained by specifications and standards should be retained in accordance with the prescribed procedures, environment, quantity, time and requirements; samples that are not specifically required by specifications and standards for non-destructive testing and repeatable testing should be retained during sample testing. Or leave it for 3 days after testing; destructive samples should be kept for 2 days after sample testing or testing. The retained specimens shall be accurately labeled and the retained specimens shall be marked with detection barcodes.
Chapter 4 Witness Testing and Off-site Testing
Article 23 Construction project quality supervision agencies at all levels should strengthen government supervision of the witness sampling quality testing business specified in Annex 1 of these Rules manage.
The construction unit of the engineering project should separate the witness sampling quality inspection business from other non-witness inspection business, entrust testing across agencies, and the engineering quality supervision agency where the project is located shall be responsible for the supervision and implementation.
Article 24: Sampling of quality inspection samples shall strictly comply with relevant engineering construction standards and relevant national regulations, and on-site sampling shall be conducted under the supervision of the construction unit or project supervision unit. The proportion of test blocks, specimens and materials involving structural safety that must be witnessed and submitted for inspection shall not be less than 30% of the number of samples specified in the relevant technical standards. Units and individuals that provide quality testing samples shall be responsible for the authenticity of the samples.
Witnesses and sampling personnel must undergo unified training by the Weihai Quality Supervision Station, pass the assessment and obtain certificates before they can serve.
The witness should be a person with knowledge of construction testing from the construction unit or the supervision unit of the project, and the construction unit or the supervision unit of the project should notify the testing agency in writing.
The test report for witnessing the sampling test should indicate the witness, the unit and name of the sampler, and affix a special seal for witnessing the sampling. Witnesses and sample takers are responsible for the authenticity and representativeness of the samples.
Witnesses and samplers should strictly abide by the relevant regulations of the witness sampling system and must not engage in fraud. If there is one act of fraud within the year, their certificate qualifications will be cancelled, and they will be recorded by the Weihai Quality Supervision Station. They will not be allowed to engage in this work in the future. . Witness and sampler certificates may not be transferred to others for use. Once found violating the rules, their qualification certificates will be revoked.
Article 25: If a testing agency establishes a fixed branch or conducts testing activities in another place based on business needs, it shall be responsible for the quality of its testing work and testing behavior.
If a testing agency registered outside the province undertakes engineering quality testing projects in this city, it should first obtain the "Registration Certificate for Construction Project Quality Testing Institutions in Shandong" issued by the Provincial Construction Management Bureau, and then it should The testing items shall be filed with Weihai Quality Supervision Station. When filing, relevant information should be submitted in accordance with the relevant provisions of the "Jinlu Testing Institution Registration Management Measures (Interim)" and be responsible for the authenticity of the application materials.
Testing agencies within and outside the province that undertake engineering quality inspection projects in this city should register with the Weihai Quality Supervision Station more than 7 days before the start of the inspection business for the inspection projects. The filing shall be carried out for individual engineering inspection projects. method, once a single engineering inspection item is completed, the filing certificate will automatically become invalid. The filing and submission of materials shall refer to the relevant provisions of the "Jinlu Testing Institution Registration Management Measures (Interim)".
Testing business can only be carried out after filing and must comply with relevant local regulations. Testing agencies that have not been registered are not allowed to undertake testing business in this city, and the test reports issued by them are not allowed to be used as completed technical data.
Article 26 The testing agency of this city that conducts witness sampling quality testing business in the urban area of ??this city and across regions between the three cities must set up a branch or laboratory at the location of the project and obtain local industrial and commercial registration Business license and metrology certification certificate of the testing projects carried out. The branch's testing instruments and equipment, site environment and personnel should be suitable for the business it undertakes. Article 27 The Weihai Quality Supervision Station shall check the personnel status of the institution applying for registration and the measurement and verification status of instruments and equipment, and supervise and manage its testing activities; if it is found to have violated regulations during testing activities Report the status of laws, regulations and technical standards to the Provincial Quality Supervision Headquarters.
Chapter 5 Supervision and Management
Article 28 For testing institutions that implement qualification management, the Provincial Construction Management Bureau shall issue a management manual for testing institutions and personnel ("Project Quality Inspection" Organization Management Manual" and "Project Quality Inspection Personnel Management Manual"). The Weihai Municipal Construction Committee issues a management manual for testing institutions and personnel for registered and managed testing institutions.
Construction administrative departments at all levels should establish bad behavior records of testing institutions and testing personnel in the region. The bad behavior records should record the illegal behaviors and violations of mandatory standards by testing institutions and testing personnel in the " "Management Manual for Engineering Quality Inspection Personnel" and "Management Manual for Engineering Quality Inspection Institutions" (in both written and electronic forms), as an important basis for approving the qualification extension and filing management of inspection institutions.
The testing agency management manual is used in conjunction with the construction project quality inspection qualification certificate. It is a supplement to qualification management and filing management. It is an important basis for the extension of the testing agency’s qualification certificate and the acquisition of filing qualifications. It is also an important basis for the testing agency to undertake business in other places. Valid documents for filing.
Article 29: The Weihai Municipal Construction Committee organizes testing agencies to conduct test proficiency verification and comparison activities in accordance with the unified requirements of the Provincial Construction Management Bureau. Testing institutions that fail the test proficiency verification and comparison should conduct secondary verification. If they are still unqualified, the testing work of the project should be suspended.
Article 30 If a testing institution no longer meets the corresponding qualification standards after obtaining the qualification of a testing institution, the Weihai Municipal Construction Committee will report it to the Provincial Construction Management Bureau, which may order it based on the request of an interested party or based on its authority. Corrections must be made within a time limit; if corrections are not made within the time limit, the corresponding qualification certificate may be withdrawn.
Article 31 Construction administrative departments at all levels shall strengthen supervision and inspection of testing institutions, mainly checking the following contents:
(1) Whether it meets the qualification standards stipulated in these rules ;
(2) Whether it engages in quality inspection activities beyond the scope of qualifications;
(3) Whether it has altered, resold, rented, lent or otherwise illegally transferred the qualification certificate;
(4) Whether the test report is signed and stamped in accordance with regulations, and whether the test report is authentic;
(5) Whether the testing agency conducts testing in accordance with relevant technical standards and regulations;

(6) Whether the instruments, equipment and environmental conditions meet the requirements for measurement certification;
(7) Other matters stipulated by laws and regulations.
Article 32 When conducting supervision and inspection, the construction authority and its supervisory agency have the right to take the following measures:
(1) Require the testing agency or the client to provide relevant documents and information;
(2) Enter the work site of the testing agency (including the construction site) to conduct random inspections;
(3) Organize comparative tests to verify the testing capabilities of the testing agency;
(4) When detecting any testing behavior that does not comply with relevant national laws, regulations and engineering construction standards, order corrections.
Article 33: In order to collect evidence during supervision and inspection, the construction authorities at all levels may adopt sampling methods to obtain evidence from relevant samples and test data; when the evidence may be lost or difficult to obtain in the future, Under certain circumstances, with the approval of the department head, the relevant samples and testing data may be registered and saved in advance, and a timely decision shall be made within 7 days. During this period, the parties or relevant personnel shall not destroy or transfer the relevant samples and testing data.
Article 34: Inspection personnel shall engage in inspection work in strict accordance with the requirements of national norms, procedures, and technical standards, and inspection personnel shall implement a management manual system.
The following behaviors of inspection personnel should be recorded in the management manual. If the circumstances are serious or the error is refused to be corrected, the management manual will be withdrawn and the inspection personnel shall not continue to conduct inspection work:
(1) Engage in inspection work beyond the scope of professional qualification items ;
(2) Failure to conduct testing in accordance with national and provincial technical standards and serious violation of operating procedures;
(3) Forging test data and issuing false test reports;

Article 35: Construction administrative departments at or above the county level and their project quality supervision departments shall handle and impose administrative penalties on problems discovered during supervision and inspection in accordance with the prescribed authority, and report to the qualification approval authority in a timely manner.
Article 36: Construction authorities at all levels and their project quality supervision departments shall establish a system for accepting and handling complaints, and make public the complaint telephone number, mailing address and email address.
If the testing agency conducts testing in violation of relevant national laws, regulations and engineering construction standards, any unit or individual has the right to complain to the construction authority.
Chapter 6 Penalties
Article 37 If anyone violates the provisions of these rules, fails to obtain the corresponding qualifications, and undertakes the testing business stipulated in these measures without authorization, his or her testing report will be invalid. The construction administrative department of the local people's government at or above the county level shall order corrections and impose a fine of not less than RMB 10,000 but not more than RMB 30,000.
Article 38 If a testing agency conceals relevant information or provides false materials to apply for qualifications, the Provincial Construction Management Bureau will not accept the application or grant an administrative license, and will give a warning and will not apply for qualifications again within one year. .
Article 39 If a qualification certificate is obtained by improper means such as deception or bribery, the provincial construction department shall revoke the qualification certificate and shall not apply for a qualification certificate again within 3 years; and the local people at or above the county level shall The government construction department shall impose a fine of not less than RMB 10,000 but not more than RMB 30,000; if a crime is constituted, criminal liability shall be pursued in accordance with the law.
Article 40 If a testing agency violates the provisions of these rules and commits any of the following acts, the construction department of the local people's government at or above the county level shall order it to make corrections and may impose a fine of not less than RMB 10,000 and not less than RMB 30,000. The following fines shall be imposed; if a crime is constituted, criminal liability shall be pursued in accordance with the law:
(1) Engaging in testing activities beyond the scope of qualifications;
(2) Alteration, reselling, leasing, lending, and transfer Qualification certificate;
(3) Using unqualified testing personnel;
(4) Failure to report discovered violations and testing failures as required;< /p>
(5) Failure to sign and seal the inspection report as required;
(6) Failure to conduct inspections in accordance with national mandatory standards for project construction;

(8) Subcontracting the testing business.
Article 41 If a testing agency falsifies testing data and issues false testing reports or appraisal conclusions, the construction authorities at or above the county level will give a warning and impose a fine of 30,000 yuan; if it causes losses to others, it shall be punished in accordance with the law. Bear liability for compensation; if a crime is constituted, criminal liability shall be investigated in accordance with the law.
Article 42 If the client violates the provisions of these rules and commits any of the following acts, the construction department of the local people's government at or above the county level shall order it to make corrections and impose a fine of not less than RMB 10,000 but not more than RMB 30,000. Fines:
(1) Entrusting a testing agency without corresponding qualifications to conduct testing;
(2) Expressing or implying that the testing agency issued a false test report, tampered with or forged the test report ;
(3) Submitting samples for inspection by fraud.
Article 43: If a fine is imposed on a testing institution in accordance with the provisions of these Measures, a fine of not less than 5% but not more than 10% of the fine shall be imposed on the legal representative and other directly responsible personnel of the testing institution.
Article 44 If any staff member of the construction administrative department at all levels or the project quality supervision agency entrusted by them, during the quality inspection and management work, commits any of the following circumstances, he or she shall be given administrative sanctions in accordance with the law; if this constitutes a crime , pursue criminal liability in accordance with the law:
(1) Issue qualification certificates to applicants who do not meet the statutory conditions;
(2) Refrain from issuing qualifications to applicants who meet the legal conditions certificate;
(3) Failure to issue qualification certificates within the statutory time limit to applicants who meet the statutory conditions;
(4) Taking advantage of the position to accept property from others or Other benefits;
(5) Failure to perform supervision and management duties in accordance with the law, or failure to investigate and deal with illegal activities upon discovery.
Chapter 7 Supplementary Provisions
Article 45 If the original management regulations and methods are inconsistent with these rules, these rules shall prevail.
