In order to promote the steady and healthy development of the real estate market in our city and accelerate the construction of affordable housing, According to the Notice of the Ministry of Land and Resources on Optimizing the Supply Structure of Housing and Land to Promote the Stable and Healthy Development of the Real Estate Market (Guo Tu Zi Fa [2015] No.37) and the Measures of the Ministry of Finance for the Management of Special Funds for Urban Security Housing Projects (Caizong [2014] No.65433) and the General Office of the People's Government of Henan Province forwarded to the Provincial Department of Housing and Urban-Rural Development on promoting the stability of the real estate market.

I. Basic requirements

(a) this opinion is applicable to the city included in the national 20 15-20 17 annual affordable housing construction plan and incorporated into the annual affordable housing plan.

(II) The term "purchase of commercial housing" as mentioned in this opinion refers to the purchase of resettlement houses or public rental housing in urban shanty towns, and the purchase of resettlement houses and public rental housing for relocated households in shanty towns in accordance with the methods and procedures specified in this opinion.

The purchaser mentioned in this opinion refers to the implementer of shantytown renovation project or the purchaser of public rental housing designated by the city and county (District) government (Administrative Committee).

(III) All relevant functional departments should perform their duties and cooperate with each other to ensure the smooth progress of the management of the purchase and distribution of resettlement houses and public rental houses, and strengthen the management and supervision of the purchase and distribution of affordable housing. The purchaser shall draw up the purchase plan of affordable housing, conduct budget review on the funds for purchasing affordable housing, and conduct overall management on the purchased housing and other affordable housing. The purchase of affordable housing is carried out by the government procurement center entrusted by the purchaser. The financial department is responsible for the supervision and inspection of the use of financial purchase funds for affordable housing. The audit department is responsible for auditing and supervising the purchase of affordable housing to ensure that the capital expenditure is reasonable and used properly. The supervision department shall supervise and inspect the work related to affordable housing.

(four) the implementation of the purchase of shantytowns to transform commercial housing, resettlement housing and public rental housing adhere to the principle of government-led, voluntary residents.

Second, policy support.

(1) According to the Implementation Opinions of the General Office of the People's Government of Henan Province on Promoting the Government to Purchase Services from Social Forces (No.2014168), the transformation of shanty towns has been included in the catalogue to guide the government to purchase services from social forces. County (District) government (Administrative Committee) and relevant departments should openly choose the main body of shantytown renovation, and sign an agreement with the main body to purchase shantytown renovation services, giving priority to the purchase of resettlement houses.

(two) the shantytown renovation project in our city, which is included in the annual urban shantytown renovation plan, will be tilted by the central and provincial financial subsidies. At the same time, according to the relevant regulations, apply for policy loans from the National Development Bank and the Agricultural Development Bank.

(3) Where ordinary commercial houses are converted into resettlement houses, relevant tax reduction and exemption policies shall be implemented in accordance with the Notice of the Ministry of Finance on Doing a Good Job in the Transformation of Urban shantytowns (Caizong [2015] No.57).

(4) Establish a "green channel" for the monetized resettlement project of shantytown renovation, simplify the approval process as much as possible, speed up the approval procedures related to the procurement and construction of resettlement houses, and shorten the approval time limit.

Third, the procurement plan

(a) the purchase of resettlement houses in shanty towns should fully respect the wishes of the resettled residents, first determine the scope of the purchase object, and then carefully and reasonably determine the purchase price, which shall be chosen voluntarily by the resettled residents. Buyers should conduct in-depth research, find out the demand, consider the location, apartment type, area, decoration, supporting facilities, occupancy time and other conditions of the house as a whole, carry out work in line with the principle of effectively improving the living conditions of residents, and formulate the purchase plan for resettlement houses.

(two) the purchase of public rental housing should meet the needs of the plan, and the purchaser should make a purchase plan for public rental housing.

(three) the purchase plan of affordable housing needs to be reported to the municipal and county (District) governments (administrative committees) for approval. After the approval, the actual work of buying a house is implemented by the purchaser.

Four. Procurement requirements and methods

(a) qualified affordable housing shall meet the following conditions:

1. Meet the residents' living desire;

3. 4. The main body of the house is capped or meets the conditions of direct occupancy or decoration, and the infrastructure of the community is perfect and the surrounding facilities are complete; 5. Unsecured, frozen, sealed up, ownership disputes, etc.

(2) In order to ensure the supply of affordable housing and effectively improve the living conditions of residents, centralized government procurement is mainly conducted through competitive negotiation, and the procurement subject invites qualified real estate development enterprises to bid for commercial housing in the region in the form of tender announcement.

1. Determination of the reserve price. The purchaser entrusts a qualified appraisal agency within the scope of government procurement bidding to evaluate the price of commercial housing within the planned procurement area, and comprehensively considers the architectural design standards, lots and floors. After the approval of the municipal and county (district) governments (administrative committees), the reserve price shall be determined as the procurement control price.

2. Determination of the winning bidder. In the project procurement, the winning bidder shall be determined according to the procurement process specified in the Interim Measures for the Administration of Competitive Consultation Procurement Methods of Government Procurement (Caiku [2014] No.214) and other documents.

3. Sign the purchase agreement. According to the purchase confirmation document issued by the procurement center, the main body of the purchase and the development enterprise signed a purchase intention agreement on the purchase of shantytown renovation and resettlement houses. The agreement shall stipulate the following matters: the object of purchase, the room type, the purchase price, the purchase place, the purchase standard, the payment progress of the purchase price, the quality requirements of the house, the occupancy time arrangement, etc.

Residents who are resettled within the scope of the purchase object shall choose their houses and sign the purchase contract according to the procedures determined in the purchase plan.

For the purchase of public rental housing, the purchaser shall sign a purchase contract with the development enterprise according to the purchase confirmation document issued by the procurement center.

Verb (abbreviation of verb) fund payment

(a) the purchaser shall pay the purchase price in accordance with the purchase contract signed by the demolished residents and the development enterprise, and reasonably control the payment progress to ensure that the demolished residents are properly resettled in time.

(two) the sum of the construction area of the resettlement housing selected by the compensated person shall not exceed the construction area to be resettled in principle, and the purchase price that does not pay the house price difference and does not exceed the monetary compensation shall be exempted from deed tax. The part exceeding the construction area to be resettled shall be paid by the compensated person according to the cash standard stipulated in the compensation plan, unless otherwise stipulated in the relevant documents. The settlement amount shall be deposited by the compensated person into the account designated by the municipal or county (District) government (Administrative Committee).

(three) the total construction area of the resettlement house selected by the compensated person is less than the construction area that should be placed. The insufficient part shall be paid to the compensated person in cash according to the monetary compensation standard stipulated in the project compensation and resettlement plan, and shall be exempted from personal income tax, unless otherwise stipulated in relevant documents.

(four) in accordance with the purchase contract signed by the purchaser and the development enterprise, the purchase of public rental housing shall be audited by the housing security management department and the financial department and paid by the government's special fund for affordable housing.

Sixth, housing distribution.

(a) the purchase of shanty towns to transform the resettlement housing by the purchase of the main body in strict accordance with the city, county (District) government (CMC) to review and record the specific allocation of resettlement housing implementation plan, the organization of resettlement housing distribution.

(two) the purchase of public rental housing, the housing security management department is responsible for the qualification access, distribution, property management and other work.

Seven. Other relevant requirements

(a) the county (District) government (CMC) according to the provisions of this opinion, combined with the specific situation of the annual objectives and tasks of affordable housing, through the purchase of services, choose the best shantytown renovation implementation plan, * * * with the purchase plan and organize the implementation.

(two) the city level is led by the government and the funds have been put in place for the renovation project of urban shanty towns, and the resettlement houses are mainly purchased according to the requirements of this opinion.

(three) the construction of public rental housing in our city is mainly based on the construction, and if it is really necessary to build it, it is mainly based on the purchase demand of this opinion.

(four) this opinion shall come into force as of the date of issuance.
