The departments of environmental protection, public security, food and drug supervision, industry and commerce, forestry and other township (town) people's governments in the counties (cities, districts) where Cordyceps originated shall do a good job in the collection and management of Cordyceps and the protection of Cordyceps resources within their respective functions and duties. Fifth Cordyceps producing areas (cities), counties (cities, districts) and township (town) people's governments shall establish and improve the responsibility system for the protection and collection of Cordyceps resources.
The people's governments of counties (cities, districts) and townships (towns) in Cordyceps producing areas should strengthen the management and education of Cordyceps gatherers and raise their awareness of protecting grassland ecological environment and Cordyceps resources. Article 6 The people's governments of all localities (cities) and counties (cities, districts) shall, in accordance with the principle of paying attention to reality and respecting history, properly handle the contradictions that occur in the process of people in neighboring provinces (districts), counties (cities, districts) and townships (towns) digging Cordyceps, maintain social order and promote economic development and social stability. Chapter II Management of Cordyceps Resources Article 7 The administrative department of agriculture and animal husbandry of the autonomous region shall, according to the general survey of Cordyceps resources in various places, formulate a plan for the development and protection of Cordyceps resources in Tibet.
The administrative department of agriculture and animal husbandry in the county (city, district) where Cordyceps sinensis originated shall, according to the development and protection plan of Cordyceps sinensis resources in the autonomous region, prepare the development and protection plan of local Cordyceps sinensis resources, which shall be audited by the local county (city, district) people's government, reported to the administrative office (people's government) for approval, and reported to the administrative department of agriculture and animal husbandry in the autonomous region for the record. Article 8 The grasslands in the core areas of nature reserves are prohibited areas for exploitation of Cordyceps sinensis. Disputes over the right to use grasslands shall be settled through consultation between the two parties to the dispute. If negotiation fails, it shall be handled as a forbidden mining area. Ninth Cordyceps producing counties (cities, districts) administrative departments of agriculture and animal husbandry, should be based on the local Cordyceps resources development and protection planning, Cordyceps collection over the years, the development of Cordyceps collection plan.
The annual plan for the collection of Cordyceps sinensis should scientifically and reasonably determine the collection area, collection area, planned collection amount, appropriate collection amount, number of collectors, collection period, forbidden mining area and related safeguard measures. Tenth Cordyceps producing counties (cities, districts) administrative departments of agriculture and animal husbandry in the formulation of the annual plan of Cordyceps collection, should coordinate and handle the interests of contractors and grassland users. Chapter III Collection Management Article 11 A collection certificate shall be obtained for the collection of Cordyceps sinensis. The collection certificate is issued to the local people in the county where Cordyceps is produced. If Cordyceps is collected across counties due to historical tradition, it shall be settled by the people's government at the adjacent county level through consultation.
The collection certificate shall specify the holder and relevant identity information, collection area and place, effective period and environmental protection measures. Twelfth Cordyceps collection certificate collection. The collection certificate is issued by the township (town) people's government entrusted by the administrative department of agriculture and animal husbandry of the county (city, district) where Cordyceps originated.
The application for the collection of Cordyceps sinensis shall be submitted to the people's government of the township (town) where Cordyceps sinensis is produced, and the people's government of the township (town) shall examine and issue the collection certificate in accordance with the principles of openness, fairness and impartiality and in the order in which the applicants submit their applications.
It is forbidden to collect Cordyceps without a license or in the forbidden mining area. Thirteenth Cordyceps collection certificate by the Cordyceps producing counties (cities, districts) administrative departments of agriculture and animal husbandry in accordance with the format prescribed by the state and the autonomous region. The collection certificate of Cordyceps sinensis shall be issued, and no fees shall be charged except for paying the grassland vegetation restoration fee according to law.
The purchase certificate shall not be forged, resold, altered, transferred, leased or lent. Fourteenth Cordyceps collectors shall pay the grassland vegetation restoration fee when applying for the Cordyceps collection certificate. The specific payment standards shall be determined and published by the competent price department of the autonomous region and the administrative department of agriculture and animal husbandry of the autonomous region in consultation with the financial department. Fifteenth Cordyceps collectors should obey the management of the county (city, district) administrative department of agriculture and animal husbandry, the township (town) people's government and the villagers' committee, and collect in accordance with the provisions of the collection certificate. Sixteenth Cordyceps collectors should protect the grassland ecological environment and grassland construction facilities, and abide by the following provisions:
Respect the customs and habits of Cordyceps collection points;
(two) the establishment of residential areas shall not destroy grassland vegetation;
(3) collecting Cordyceps sinensis and filling turf when digging turf;
(four) shall not be used to destroy the grassland vegetation collection tools;
(five) shall not destroy the grassland and animal husbandry construction facilities;
(six) shall not cut and dig shrubs, dig turf, dig trenches, dig other rare wild plants, windbreak and sand fixation plants;
(seven) shall not illegally hunt wild animals;
(eight) do a good job in the timely treatment of domestic garbage;
(nine) comply with the relevant provisions of the people's government of the county (city, district) where Cordyceps is produced.
