What are the special procedures for handling grain trade?
Article 7 Grain operators refer to legal persons, other economic organizations and individual industrial and commercial households engaged in grain purchase, sale, storage, transportation, processing, import and export.

Eighth operators engaged in grain purchasing activities shall meet the following conditions:

(1) Having the ability to raise business funds;

(2) Having or renting necessary grain storage facilities;

(3) Having corresponding food quality inspection and storage capabilities.

The specific conditions stipulated in the preceding paragraph shall be formulated and promulgated by the people's governments of provinces, autonomous regions and municipalities directly under the Central Government.

Ninth operators who have obtained the qualification of grain purchase and registered in accordance with the Regulations of the People's Republic of China on the Administration of Company Registration may engage in grain purchase activities.

To apply for grain purchasing activities, a written application shall be submitted to the administrative department of grain at the same level of industrial and commercial registration, and proof materials such as funds, storage facilities, quality inspection and storage capacity shall be provided. The administrative department of food shall complete the examination within 15 working days from the date of acceptance, and make a licensing decision and publicize the applicant who meets the specific conditions stipulated in Article 8 of these regulations.

Article 10 Anyone who has obtained the qualification license for grain purchase from the administrative department of grain shall go through the establishment registration with the administrative department for industry and commerce according to law, and indicate the grain purchase in the business scope; Registered in the administrative department for industry and commerce, engaged in grain purchase activities, should also obtain the grain purchase qualification license of the administrative department for food, and go through the registration of change of business scope with the administrative department for industry and commerce according to law, and indicate the grain purchase in the business scope.

Eleventh food business operators engaged in grain purchasing activities according to law (hereinafter referred to as grain purchasers) shall inform grain sellers or announce the varieties, quality standards and purchase prices of grain at the place of purchase.

Twelfth grain buyers to buy grain, should implement the national food quality standards, price according to quality, and shall not harm the interests of farmers and other grain producers; Payment for goods shall be made to grain sellers in a timely manner and shall not be in arrears; Do not accept the entrustment of any organization or individual to withhold and remit any taxes, fees and other funds.

Thirteenth grain buyers should regularly report the purchase situation and other relevant information to the grain administrative department of the people's government at the county level.

When purchasing grain across provinces, it shall regularly report the quantity of grain purchased and other relevant information to the grain administrative department of the people's government at the county level where the grain purchaser is located.

Article 14 Food business operators engaged in food sales, storage, transportation, processing, import and export shall register with the administrative department for industry and commerce.

Fifteenth grain storage facilities used by grain operators shall meet the requirements of relevant grain storage standards and technical specifications. No harmful substances that may pollute the grain may be mixed into the grain, and no chemical agents prohibited by the state or excessive use of chemical agents may be used to store the grain.

Sixteenth transportation of grain should strictly implement the national technical specifications for grain transportation, and no contaminated means of transport or packaging materials should be used to transport grain.

Article 17 Operators engaged in food processing shall have the necessary processing conditions to ensure the quality and hygiene of food, and shall not engage in any of the following acts:

(a) the use of moldy grain and its by-products for processing;

(two) the use of additives in violation of regulations;

(three) the use of packaging materials that do not meet the quality and hygiene standards;

(four) other acts that affect the quality and hygiene of food.

Article 18 When selling grain, we should strictly implement the relevant national standards on food quality and hygiene, and we should not be short of weight, adulterated or shoddy, and we should not hoard, monopolize, manipulate food prices or dominate the market.

Nineteenth the establishment of grain sales quality inspection system. Grain storage enterprises shall conduct quality appraisal of aged grain that exceeds the normal storage life before leaving the warehouse. It is strictly forbidden for any deteriorated and non-conforming food to flow into the ration market. Chen Hualiang's purchasing qualification shall be determined by the grain administrative department of the provincial people's government in conjunction with the administrative department for industry and commerce. The identification standard of aged grain shall be formulated by the state grain administration department jointly with relevant departments, and the specific measures for the sale, treatment and supervision of aged grain shall be implemented in accordance with the relevant provisions of the state.

Twentieth operators engaged in grain purchase, processing and sales must maintain the necessary inventory.

When necessary, the people's governments of provinces, autonomous regions and municipalities directly under the Central Government may set specific standards for the minimum and maximum inventory.

Twenty-first state-owned and state-controlled grain enterprises should actively purchase grain, do a good job in the purchase and sale of grain entrusted by the government, and obey and serve the national macro-control.

Twenty-second to meet the loan conditions of grain buyers, banks should provide timely purchase loans in accordance with relevant state regulations. China Agricultural Development Bank shall ensure the demand for credit funds for central and local grain reserves, government-regulated grain and other policy grain, and provide credit funds support according to the risk tolerance of state-owned and state-controlled grain purchase and sale enterprises, large-scale grain industrialization leading enterprises and other grain purchase and sale enterprises.

Article 23 Grain operators and feed and industrial grain enterprises engaged in grain purchase, sale, storage and processing shall establish grain business accounts and submit basic data and relevant information on grain purchase, sale and storage to the grain administrative department of the people's government at the county level. The time limit for food business operators to keep food business ledger shall not be less than 3 years. Where the basic data and related materials submitted by food business operators involve trade secrets, the administrative department of food has the obligation to keep them confidential.

The national grain circulation statistical system shall be formulated by the state grain administration department and submitted to the statistics department of the State Council for approval.

Twenty-fourth grain industry associations and intermediary organizations should strengthen industry self-discipline and play a supervisory and coordinating role in maintaining the order of the grain market.
