Legal analysis: As the payee, there are risks. Unless there is a clear agreement with the bank, you may be responsible for overdue repayment. Guaranteeing loans for others involves the following risks: the guarantor may be sued, the guarantor may be declared bankrupt, many guarantors are not safe, and death does not mean that the guarantee is exempted.

Legal basis: Article 391 of the Civil Law of People's Republic of China (PRC) stipulates the guarantee. If the creditor allows the debtor to transfer all or part of the debt without his written consent, the guarantor will no longer bear the corresponding guarantee liability.

Article 109 of the Law of People's Republic of China (PRC) on Public Security Administration Punishment shall ensure that the guarantor does not evade the execution of administrative detention punishment. If the guarantor fails to perform the obligation of guarantee, causing the guarantor to evade the punishment of administrative detention, the public security organ shall impose a fine of not more than 3,000 yuan.
