Interim Measures for the Management of National High-tech Industry Development Projects

Chapter 1 General Provisions Article 1 is to standardize and manage national high-tech industry development projects, promote the healthy development of high-tech industries, and improve the core competitiveness of the industry. According to the Science and Technology Progress Law of the People's Republic of China and the People's Republic of China " and the "Law of the People's Republic of China on Promoting the Transformation of Scientific and Technological Achievements", the "Decision of the State Council on the Reform of the Investment System" and other laws and regulations, and in accordance with the "Interim Measures for the Management of Investment Subsidies and Interest Discount Funds within the Central Budget" and other relevant regulations, this document is formulated way. Article 2 These Measures shall apply to projects whose main tasks are to enhance independent innovation capabilities and promote the development of high-tech industries and which have been approved by the National Development and Reform Commission (hereinafter referred to as the “National Development and Reform Commission”) and are included in the national high-tech industry development project plan. National high-tech industry development projects (hereinafter referred to as "national high-tech projects") are provided with investment subsidies or loan interest discounts within the central budget, are organized and managed by the project authorities, and are implemented by the project units.

National high-tech projects in which funds from the central budget are injected in the form of direct investment and capital funds shall be managed in accordance with relevant national regulations. Article 3 The national high-tech projects mentioned in these Measures include:

(1) National high-tech industrialization projects (hereinafter referred to as "industrialization projects") refer to the engineering integration and demonstration of key technologies As the main content, or as a transformation project of independent scientific and technological innovation achievements with the goal of large-scale application.

(2) National major technical equipment research and development projects and major industrial technology development projects (hereinafter referred to as "research and development projects") refer to major technical equipment research and development projects required for national key construction projects and key industrial structure optimization and upgrading Urgently needed industry-leading and key technology research and development projects.

(3) The national industrial technology innovation capacity building project refers to the national engineering laboratory construction project with the goal of breaking through the technical bottlenecks of industrial development and improving the engineering, industrialization research and development and verification capabilities of major scientific and technological achievements. (hereinafter referred to as the "Engineering Laboratory Project") and the National Engineering Research Center Construction Project (hereinafter referred to as the "Engineering Center Project"), as well as the nationally recognized enterprise technology center construction project (hereinafter referred to as the "Technology Center") with the goal of improving the company's technological innovation capabilities project").

(4) The national high-tech industry technology upgrading and structural adjustment project refers to the transformation of backward production conditions with advanced technologies, processes and equipment as the main content to promote the information industry, biological industry, civil aviation The aerospace industry expands its scale, promotes the optimization and upgrading of the industrial structure, drives industrialization with informatization, and actively develops construction projects (hereinafter referred to as "upgrading and adjustment projects") with the goal of developing e-commerce and enterprise informatization.

(5) High-tech industry development projects in other countries. Article 4 The term “investment subsidies” as mentioned in these Measures refers to the investment fund subsidies provided by the National Development and Reform Commission to qualified enterprise investment projects (including public institution investment projects, the same below) and local government investment projects. The term “loan interest subsidies” as mentioned in these Measures refers to the loan interest subsidies provided by the National Development and Reform Commission to investment projects that meet the conditions and use medium- and long-term bank loans. Investment subsidies and loan interest discount funds (hereinafter referred to as "state subsidy funds") are free investments. Chapter 2 Organization and Management Article 5 The National Development and Reform Commission is the organizational department for national high-tech projects and mainly performs the following responsibilities:

(1) Research and propose national high-tech industry development plans and related special plans, and study Propose development policies for relevant industries;

(2) Study and determine the key areas and key tasks of national high-tech projects;

(3) Organize and review national high-tech projects, and approve national high-tech projects. Fund application reports for technology projects;

(4) Prepare and issue annual national high-tech industry development project plans and investment plans;

(5) Coordinate the implementation of national high-tech projects , organize or commission project evaluation work. Article 6 The project authorities referred to in these Measures refer to the relevant departments of the State Council, the Development and Reform Commission or the Economic (Trade) Commission of provinces, autonomous regions, municipalities directly under the Central Government, cities under separate state planning and Xinjiang Production and Construction Corps.

Enterprise groups under separate planning and centrally managed enterprises can directly submit fund application reports to the National Development and Reform Commission and assume supervisory responsibility for the project. Specific requirements are stipulated in national high-tech project announcements or notices.

For national high-tech projects organized across regions and departments, the project management department may be determined through consultation by the relevant regions or departments, or the project management department may be designated by the organizational department.

The project management department shall perform the following main responsibilities:

(1) According to the national high-tech project announcement or notice of the National Development and Reform Commission, organize the department, the region and the enterprise ( Relevant work related to applying for state subsidy funds for high-tech projects of the Group), conducting a preliminary review of the project's construction conditions, bidding content, etc., and submitting a project fund application report to the National Development and Reform Commission after passing the review, and being responsible for the preliminary review results and application materials;

(2) Responsible for the management of national high-tech projects and the coordination and handling of major issues in project implementation, ensuring that projects are completed on schedule and organizing project acceptance work;

(3) Cooperation Relevant national departments carry out inspections, audits and inspections;

(4) Regularly summarize and report the implementation of national high-tech projects of the department, region and enterprise (group) to the National Development and Reform Commission every year . Article 7 The term "project unit" as mentioned in these Measures refers to the enterprise or institutional legal person registered and registered in accordance with Chinese laws and applying for state subsidy funds for high-tech projects. The project unit should have a good level of operation and management, and have the technological development capabilities, fund raising, and project construction organization and management capabilities required to undertake national high-tech projects.

The project unit shall perform the following main responsibilities:

(1) In accordance with the requirements of these Measures and project announcements, prepare and submit an application report for state subsidy funds for high-tech projects to the project authority , and shall be responsible for the authenticity of the application materials;

(2) Implement the project in accordance with the contents and requirements determined in the project fund application report approved by the project organizing department and the competent department;

( 3) Report the project implementation status and funding implementation to the project management department as required, and promptly report major events that occur during project implementation;

(4) Implement special account management of state subsidy funds;

(5) Accept the evaluation, inspection, audit and inspection conducted by the National Development and Reform Commission, finance and audit departments at all levels, project management departments or institutions entrusted by the above departments;

(6 ) After the overall project goal is achieved, project acceptance will be carried out in a timely manner as required.
