Measures of Yunnan Province on Supervision and Inspection of Organization Establishment

Chapter I General Provisions

Article 1 In order to strengthen and standardize the supervision and inspection of organization establishment, and enforce the discipline of organization establishment, these measures are formulated according to the Regulations of Yunnan Province on the Administration of Organization Establishment, the Interim Provisions on the Punishment of Violations of Law and Discipline in the Organization Establishment of Administrative Organs and the Interim Provisions on the Supervision and Inspection of Organization Establishment, combined with the actual situation in our province.

Article 2 The supervision and inspection of institutional setup shall adhere to the principles of combining supervision and inspection with strengthening management, combining preventive education with punishment, and following the principles of seeking truth from facts, being objective and fair, acting according to law and paying attention to actual results.

Article 3 The establishment management organs at all levels shall perform the duties of supervision and inspection of establishment in accordance with the statutory management authority. The establishment management organ of the superior organization guides the establishment management organ of the subordinate organization to carry out supervision and inspection, and can directly supervise and inspect the establishment matters of the subordinate organization when necessary.

Article 4 Institutions at all levels shall strengthen internal supervision and improve the coordination mechanism of examination and approval, supervision and inspection of institutions.

Discipline inspection and supervision organs at all levels should perform their duties of accountability for supervision and discipline in accordance with the law, check the problems existing in the Regulations on the Administration of Organization Establishment, and investigate the responsibility for violation of discipline and law in organization establishment.

Organizations at all levels, finance, human resources and social security, auditing and other departments should cooperate closely, carry out their duties, and establish and improve the organization management, supervision and restriction mechanism.

Chapter II Objects and Contents of Supervision and Inspection

Article 5 The objects of supervision and inspection of institutional establishment are Party committees, people's congresses, government organs, CPPCC organs, judicial organs, procuratorial organs, organs of democratic parties, mass organizations, institutions (hereinafter referred to as administrative organs and institutions) and other organs included in the management of institutional establishment.

Article 6 The main contents of supervision and inspection of institutional setup are:

(a) the implementation of the relevant laws, regulations and rules of the organization management;

(two) whether the policies and measures for the establishment and management of local institutions comply with laws, administrative regulations and relevant provisions of the state;

(three) the implementation of the policies and measures of the provincial party committee and the provincial government on the transformation of government functions, the reform of administrative management system, the classification reform of public institutions, the reform of administrative examination and approval system, the list of powers and responsibilities, and the control and reduction of staffing;

(four) the implementation of the reform plan approved by the higher party committees, governments and institutions;

(five) the total control of institutional establishment, staffing and career establishment in each region;

(six) the implementation of administrative organs and institutions at all levels, such as functional allocation, institutional setup, staffing and leadership positions;

(seven) the implementation of organizational staffing management authority and approval procedures;

(eight) the implementation of the organization's real-name management;

(nine) to accept reports and investigate and deal with acts in violation of the provisions of the organization management;

(ten) to organize the implementation of statistical provisions;

(eleven) other matters that need supervision and inspection.

Chapter III Supervision and Inspection Work System

Article 7 The establishment management organs at all levels shall disclose to the public the principles, procedures and actual personnel for examination and approval of the establishment matters of administrative organs and institutions, and accept social supervision.

Article 8 The establishment management organs of institutions at all levels shall urge the administrative organs and institutions at the same level to disclose the establishment matters (including the administrative examination and approval items and the list of powers and responsibilities) that do not involve state secrets to their staff and the society according to law.

Article 9 Institutions at all levels shall, according to the needs of Party committees and governments, evaluate the performance of various administrative organs and institutions in a timely manner, and take the evaluation results as an important basis for adjusting institutions.

Tenth administrative organs and institutions at all levels shall establish a responsibility system for the management of institutional establishment. The implementation of the organization management will be used as the assessment content of the party and government leading bodies and members of the state (city) and county (city, district).

Article 11 The principal leaders of local governments at all levels and the principal leaders of administrative organs and institutions at all levels shall accept the economic responsibility audit of the establishment, establishment and use of institutions and the implementation of relevant regulations.

Article 12 The establishment management organs of institutions at all levels shall promptly supervise and inspect the major work such as the transformation of government functions, the reform of administrative management system, the classification reform of public institutions, the reform of administrative examination and approval system, the list of powers and responsibilities, and the reduction of personnel, and urge the party committees and governments at all levels and relevant departments to implement the work requirements, and timely follow up and supervise the problems found.

Article 13 The staffing administration organs at all levels shall organize self-examination and self-correction of staffing administration once a year, and report the relevant information to the higher party committee, government, editorial board and staffing administration organs before the end of 65438+February every year. Important information should be reported in time.

Article 14 The establishment management organs at all levels should unblock the "trinity" complaint reporting channels of telephone, internet and letters and visits, further improve the acceptance system for reporting violations of organizational discipline, and strengthen the acceptance of "123 10" organization establishment reporting telephone and mass visits.

Fifteenth any unit or individual has the right to report violations of the provisions of the organization management to the organization management organ or the discipline inspection and supervision organ. The accepting organ shall keep confidential the information of the informer. If the real name is reported, the result will be returned to the informant.

Sixteenth institutions at all levels shall, in conjunction with relevant departments, timely notify the implementation of the organization's work discipline.

Chapter IV Methods and Procedures of Supervision and Inspection

Seventeenth according to different objects, contents and tasks, supervision and inspection take the combination of self-examination and spot check, regular inspection and key supervision, internal inspection and social supervision.

Eighteenth institutions at all levels can organize their own supervision and inspection, and can also conduct joint supervision and inspection with relevant departments such as finance, auditing, human resources and social security. Major supervision and inspection activities, with the consent of the Provincial Commission for Discipline Inspection and the Provincial Supervision Department, can be carried out in the name of the Provincial Commission for Discipline Inspection and the Provincial Supervision Department.

Article 19 The staffing administration organ at the higher level may instruct the staffing administration organ at the lower level to investigate, verify and supervise the relevant issues that violate the provisions on staffing administration, and may send a supervision inspection team to supervise when necessary.

Article 20 The staffing administration organ of a subordinate institution shall report the investigation results approved by the staffing administration organ of a superior institution within 60 days. If the report cannot be made within the time limit, the reasons shall be explained in writing.

Article 21 The general procedures for supervision and inspection are as follows:

(a) Develop a plan;

(two) according to the management authority for approval;

(3) giving notice;

(4) Organizing the implementation;

(5) Inspection report;

(six) to feedback the inspection situation to the inspected unit, and put forward opinions or suggestions.

Under special circumstances, the supervision and inspection of the organization establishment can be carried out without prior notice.

Twenty-second in violation of the provisions of the organization management, the organization management organs at all levels shall conduct investigation and verification in accordance with their functions and powers, and the investigation and verification shall be carried out by more than two people.

In the process of investigation, the units and personnel under investigation have the right to defend themselves to the organization management organ.

Twenty-third objects of supervision and inspection shall provide relevant materials in a timely, comprehensive and objective manner, and explain and explain the relevant issues involved in the investigation. Anyone who practices fraud, obstructs supervision and inspection, or retaliates against supervision and inspection personnel will be severely dealt with according to relevant regulations.

Chapter V Accountability

Twenty-fourth party committees and governments at all levels have one of the following acts in the organization, and the organization management organ at the higher level shall advise them to make corrections or order them to make corrections within a time limit:

(1) establishing or merging various institutions beyond the authority or violating the prescribed procedures, improving the specifications of institutions or changing the nature of institutions;

(two) the number of leading cadres exceeds the standard;

(three) beyond the staffing quota;

(four) the establishment of administrative examination and approval projects beyond the authority;

(five) other acts in violation of the provisions of the organization management.

Article 25 Where an administrative organ or institution at any level commits any of the following acts in its organizational establishment, the administrative organ for organizational establishment at the same level or at a higher level shall give informed criticism, suggest to make corrections or order it to make corrections within a time limit, and suggest that the directly responsible person in charge and other directly responsible personnel be punished.

(a) in violation of the provisions of the subordinate function allocation, institutional setup, staffing approval and leadership positions;

(two) in violation of the provisions of the unauthorized expansion or reduction of the scope of responsibilities or authority of institutions;

(three) unauthorized establishment, merger, improve the specifications of institutions or change the name, affiliation and funding channels of institutions;

(four) the number of cadres in internal institutions or subordinate institutions;

(five) unauthorized use of personnel beyond the approved staffing or change the scope of use;

(six) administrative examination and approval beyond the authority;

(7) Appropriating funds for supernumerary personnel or handling employment, transfer, wage relations, social security and other procedures. ;

(eight) the statistical information is inaccurate or not submitted in accordance with the provisions;

(nine) other acts in violation of the provisions of the organization management.

Article 26 If the staffing administration organs at all levels commit any of the following acts, the staffing administration organs at higher levels shall, in accordance with the regulations, give informed criticism, suggest to make corrections or order him to make corrections within a time limit, and suggest that the directly responsible person in charge and other directly responsible personnel be punished.

(1) Examining and approving the establishment of an institution beyond the institutional limit, improving the institutional specifications beyond the authority, hanging the institutional brand or changing the nature and name of the institution;

(2) Approving the establishment beyond the establishment limit or misappropriating the establishment in violation of regulations;

(three) in violation of the provisions of the approved leadership positions;

(four) other acts in violation of the provisions of the organization management.

Article 27. Those who need to be investigated for the disciplinary responsibility of the organization shall be given disciplinary sanctions, and the party organization of the discipline inspection organ or the appointment and removal organ shall be punished in accordance with the relevant provisions of the Regulations on Disciplinary Actions of the Party of People's Republic of China (PRC). Should be given disciplinary sanctions, the appointment and removal organ or the supervisory organ shall be given disciplinary sanctions in accordance with the relevant provisions. Anyone suspected of committing a crime shall be transferred to judicial organs for handling according to law.

Twenty-eighth organizations at all levels can take the following measures against units and individuals who violate organizational discipline:

(1) informed criticism;

(2) Suggesting correction or ordering correction within a time limit;

(three) to be corrected;

(four) suggested that the financial sector should not allocate funds for supernumerary personnel;

(five) it is suggested that the person in charge and other directly responsible personnel be punished.

Article 29 When investigating and dealing with matters that violate the provisions on the administration of institutional establishment, the institutional establishment management organs at all levels think that it is necessary to investigate the disciplinary responsibility of the responsible personnel according to law and discipline, they shall transfer the relevant materials to the appointment and removal organ or the discipline inspection and supervision organ for handling, and put forward suggestions for handling; When the discipline inspection and supervision organs find problems in violation of the provisions on the administration of institutional establishment, they shall promptly notify the relevant authorities of the establishment.

Thirtieth institutions at all levels shall include the following contents:

(1) Transfer Letter;

(2) clues to violations of discipline and discipline;

(3) Investigation report;

(4) All evidential materials;

(five) other materials that need to be handed over.

When handing over relevant materials, both parties shall sign the handover list, or the receiving party shall issue a receipt for the materials to the handing over party.

Thirty-first supervision and inspection personnel who abuse their powers, neglect their duties and engage in malpractices for personal gain in their work shall be punished according to law and discipline; Anyone suspected of committing a crime shall be transferred to judicial organs for handling according to law.

Chapter VI Supplementary Provisions
