Legal basis: Provisions on the Application and Use of Motor Vehicle Driving License Article 77 If a motor vehicle driver has any of the following circumstances, dmv shall cancel his motor vehicle driving license:
(1) Dead;
(two) apply for cancellation;
(3) Loss of capacity for civil conduct, and the guardian applies for cancellation;
(four) physical conditions are not suitable for driving a motor vehicle;
(5) Having diseases such as organic heart disease, epilepsy, Meniere's disease, vertigo, hysteria, paralysis agitans, psychosis, dementia, and nervous system diseases that affect limb activities that hinder safe driving;
(6) Having been found to be driving a motor vehicle after taking or injecting drugs, and being in the process of community detoxification, compulsory isolation detoxification and community rehabilitation, or having been addicted to dependent psychotropic drugs for a long time;
(seven) more than one year after the validity of the motor vehicle driver's license;
(8) Being over 70 years old and failing to submit the physical condition certificate within one year after the end of a scoring cycle; Or holding a small automatic passenger car for the disabled, and failing to submit the physical condition certificate within one year after the end of three scoring cycles;
(nine) at the age of 60 or above, the motor vehicle driver's license only has trolley buses or trams, or at the age of 70 or above, and the motor vehicle driver's license only has low-speed trucks, three-wheeled vehicles and wheeled self-propelled vehicles;
(ten) the motor vehicle driving license is revoked or the driving license is revoked according to law.
If the motor vehicle driver's license has not been recovered under any of the circumstances from Item 2 to Item 10 of the first paragraph, it shall be announced that the motor vehicle driver's license is invalid.
If the motor vehicle driver's license has been cancelled for less than two years in the case of item 7 of the first paragraph, the motor vehicle driver may resume his driving qualification after passing the examination of road traffic safety laws, regulations and related knowledge.
If the motor vehicle driver's license is cancelled in the case of Item 8 of the first paragraph, and the motor vehicle driver's license is within the validity period or exceeds the validity period by less than one year, the motor vehicle driver may resume driving qualification after submitting the physical condition certificate.
In case of any of the circumstances from Item 2 to Item 8 of the first paragraph, if you apply for a motor vehicle driver's license in accordance with the provisions of Article 24, and there are records of road traffic safety violations or traffic accidents that have not been handled, you shall finish handling the road traffic safety violations and traffic accidents.
