Chapter I General Principles

Article 1 In order to implement the strategy of rejuvenating the city through science and education and promote the rapid and healthy development of private education, these Measures are formulated in accordance with the provisions of the Law of People's Republic of China (PRC) Municipality on the Promotion of Private Education and the Regulations on the Implementation of the Law of People's Republic of China (PRC) Municipality on the Promotion of Private Education, combined with the actual situation of this Municipality.

Article 2 The term "private schools" as mentioned in these Measures refers to private educational institutions such as preschool education, primary education, junior high school education, ordinary senior high school education, secondary vocational education, self-study exams, higher education and vocational skills training schools organized by social organizations or individuals other than state institutions with non-state financial funds.

Article 3 Private education is a public welfare undertaking and an integral part of socialist education.

Private schools are non-enterprise social organizations.

The municipal, county (city) and district people's governments shall implement the policy of "actively encouraging, strongly supporting, correctly guiding and managing according to law" and the principle of reasonable layout and structure, and incorporate private education into the national economic and social development plan.

Article 4 The government encourages various forms of joint establishment of private schools. Protect the autonomy of running a private school and the legitimate rights and interests of the organizers, principals, teaching staff and educatees according to law.

Private schools established according to law and their teachers and educatees enjoy the same legal status as public schools and their teachers and educatees.

Article 5 The municipal, county (city) and district people's governments shall commend and reward organizations and individuals that have made outstanding contributions to the development of private education.

Article 6 Private schools shall abide by laws and regulations, implement the national education policy, ensure the quality of education, and devote themselves to cultivating all kinds of talents for socialist construction.

Chapter II Establishment and Examination and Approval

Seventh private schools within the scope of examination and approval authority of this Municipality shall be implemented in accordance with the standards for the establishment of similar public schools at the same level; If there is no corresponding setting standard, it shall be implemented in accordance with the setting standard stipulated by the provincial and municipal administrative departments of education and labor security.

Article 8 The names of private schools shall conform to the relevant provisions of the state. The domain name and font size of the city, county (city) and district where the private school is located shall be added, and the words "China, China and Henan" shall not be used. The word "Jiaozuo" shall not be used without the approval of the relevant competent department of Jiaozuo City and the municipal civil affairs department.

Article 9 To apply for the establishment of a private school, relevant materials shall be submitted in accordance with the Law on the Promotion of Private Education and the Regulations on the Implementation of the Law on the Promotion of Private Education.

Tenth private kindergartens, primary schools and junior high schools shall submit application materials to the local county (city) district education administrative department; If a private ordinary high school or private secondary vocational school is to be established, the application materials for establishment shall be submitted to the Education Bureau window of the Municipal Administrative Service Center. During the preparatory period, enrollment and enrollment advertisements shall not be released.

Article 11 To apply for the formal establishment of a private school, an application and related materials shall be submitted to the education administrative department of the county (city) or the education bureau window of the municipal administrative service center in accordance with the provisions of Articles 14 and 15 of the Law on the Promotion of Private Education.

Twelfth private schools set up examination and approval authority and procedures:

(a) the establishment of institutions of higher learning with bachelor's degree or above and the education of teachers' and medical majors shall be reported to the state education administrative department for examination and approval in accordance with the procedures prescribed by law; The establishment of higher vocational schools to implement academic education shall be examined and approved by the provincial people's government; The establishment of higher education self-study examination aid institutions and institutions of higher learning that implement non-academic education shall be examined and approved by the education administrative department of the provincial people's government.

(two) the establishment of private ordinary high schools, private secondary vocational schools and secondary education institutions that implement academic education shall be examined and approved by the municipal education administrative department.

(three) the establishment of private preschool education, primary and junior high school education schools and non academic education and training institutions below secondary level, the county (city) district education administrative department for examination and approval.

(4) The establishment and implementation of vocational qualification training and vocational skills training schools with vocational skills as the main focus shall be examined and approved by the municipal, county (city) and district labor and social security administrative departments, and copied to the education administrative departments at the same level for the record.

(five) the examination and approval authority shall, within 20 days from the date of accepting the application for formal establishment, conduct on-the-spot investigation on the private schools with qualified application materials, and form an expert review committee to put forward opinions, make a written decision on whether to approve the license, and serve it on the applicant.

Thirteenth examination and approval authorities issued a "private school license" to the approved private schools; If an administrative license is not granted, the reasons shall be explained in writing, and the right to administrative reconsideration and administrative litigation shall be informed.

The license for running a private school shall not be lent or transferred.

Article 14 The sponsor of a private school shall apply to the civil affairs department at the same level or the window set up in the administrative service center for the Registration Certificate of a Private Non-enterprise Unit with the License for Running a Private School issued by the examination and approval authority. The civil affairs department shall register within 5 working days. Private schools can only carry out enrollment, publicity, education and teaching activities after obtaining the above certificates.

Fifteenth the examination and approval authority shall announce to the public the private schools established with the approval of the registration authority and registered according to law and their articles of association.

Chapter III Charging and Management

Sixteenth private schools to implement academic education, the charging items and charging standards by private schools to apply, reported to the local price authorities for approval and publicity. Private schools that implement non-academic education, the charging items and charging standards shall be formulated by private schools and reported to the local price authorities for filing and publicity.

Seventeenth private schools shall, in accordance with the approved charging items and standards, charge by semester or school year, and shall not charge across years. When students in private schools retire (transfer), the school shall refund students a certain fee in accordance with the relevant provisions of the state, province and city.

Eighteenth social organizations or individuals other than state institutions jointly run private schools, should sign a joint school agreement, clear the way and proportion of capital contribution, the rights and obligations of all parties. Before signing the agreement, you should accept the guidance of the legal department of the government, and after signing the agreement, send a copy to the examination and approval authority for future reference.

Private schools should register and establish accounts for the assets invested by the state, the assets invested by the sponsors, the social donations received and the accumulation of running schools, manage and use them according to law, and must not confuse the nature of various assets, and accept the supervision of the examination and approval authorities and other relevant departments.

Donations accepted by private schools can only be used for the construction and development of schools, not for distribution and off-campus investment.

The fees charged by private schools should be mainly used for education and teaching activities and improving school conditions. During the existence of a private school, the sponsor shall not withdraw funds or misappropriate school funds. No organization or individual may illegally occupy the property of a private school.

Nineteenth private schools should sign labor contracts when hiring teachers, staff and other employees. The termination of the contract shall be handled in accordance with the relevant provisions of the state.

Twentieth private schools should be examined by the examination and approval authorities to publish enrollment advertisements and enrollment brochures. Radio, television, newspapers and other news media shall publish and broadcast according to the examination and approval authority's examination certificate.

Article 21 The examination and approval authority shall supervise the running quality of private schools according to law. Private schools shall accept the business guidance, supervision and management of the examination and approval authorities and relevant departments.

Article 22 Private schools that carry out academic education shall, in accordance with the provisions of the provincial and municipal education administrative departments, establish student status files for freshmen, and go through the procedures of submitting student status and student mobility (transfer, suspension, withdrawal, etc.). ) in a timely manner, and standardize the management of student status.

Students who have completed their studies in accordance with the relevant provisions of the state shall be awarded corresponding academic certificates.

Chapter IV Support and Reward

Article 23 The municipal, county (city) and district people's governments shall set up a leading group for the development and coordination of private education, headed by the leaders in charge of the government, with the departments of education, labor and social security, civil affairs, development and reform, finance, planning, land and resources, construction, personnel, compilation, radio and television, industry and commerce, urban management, taxation, health, public security and fire control as members, to make overall research and coordinate the development of private education. The leading group office is located in the administrative department of education.

Education administrative departments and labor and social security departments at all levels shall give support and guidance from the aspects of school setting, school running direction, planned enrollment, teaching management, personnel management, financial management, and the construction of teachers' team in private schools, and implement classified management. Other relevant departments should carry out their duties and implement policies to promote the development of private education.

Twenty-fourth city, county (city), District People's governments and their relevant departments should do a good job in serving the development of private education and create a good school environment. It is forbidden for any unit or individual to illegally inspect, apportion, collect fees and impose fines on private schools. No unit, organization or individual may occupy or illegally requisition the legal school-running property and teaching places of private schools. The relevant departments shall promptly investigate and deal with illegal acts such as disrupting school education and teaching activities, destroying school buildings and venues, endangering the personal safety of teachers and students, and ensuring the normal education and teaching order of private schools.

Article 25 Since 2007, the Municipal People's Government has set up a special fund of 300,000 yuan for private education every year, which is mainly used to reward and commend the collectives and individuals who have made outstanding contributions to the development of private education. Counties (cities) and district governments should also set up corresponding special funds. The use of special funds is approved by the leading group for the development and coordination of private education and allocated by the financial department.

Twenty-sixth private school construction land should be included in the overall planning of urban and rural construction. Private schools enjoy preferential treatment in land acquisition, new construction, renovation and expansion of teaching and research houses. , in line with the provisions of public welfare land and construction.

Twenty-seventh teachers in private schools enjoy the same treatment as teachers in public schools in terms of length of service (teaching experience), evaluation and appointment of professional and technical positions, evaluation of excellent and advanced training.

Twenty-eighth private school teachers should pay social insurance and housing provident fund, except for the part that individuals should bear, the rest should be borne by the school and the examination and approval authority at the same level.

Article 29 For a private school located in Jiaozuo City and directly managed by the municipal examination and approval authority, if its net assets or investment in running a school reach the specified amount, the municipal finance department may allocate a certain proportion of the staff salaries according to the average salary standard of public school teachers in the previous year, which will be continuously supported for 10 year after being evaluated by a qualified intermediary agency and confirmed by the finance department.

The specific disbursement criteria are: 30% for existing private schools with rolling development net assets of more than 6,543,800 yuan; 50% for newly-built private schools with a one-time investment of 30 million yuan to 50 million yuan; 70% will be allocated to newly-built private schools with a one-time investment of more than 50 million yuan.

County (city) District People's government may formulate more favorable support policies with reference to these measures or with reference to these measures.

Thirtieth city, county (city), District People's government commissioned or agreed to undertake the task of compulsory education of private schools, should be based on the number of students receiving compulsory education and local public schools to implement compulsory education per student public funding standards, appropriate funding for education. Students receiving compulsory education in private schools are treated equally with students in public schools if they meet the conditions of exemption from textbook fees, tuition fees and accommodation subsidies. Subsidies should be deducted from students' tuition fees.

Thirty-first private schools can implement independent enrollment according to local enrollment policies. Encourage private schools to recruit foreign students on the basis of local enrollment. Education departments and schools should provide convenience for students attending private schools in terms of student files and student status management. Students from public schools who request to be transferred to private schools shall be handled in accordance with the relevant provisions on student status management.

Thirty-second private school students enjoy the same rights as public school students in the aspects of school roll management, continuing education, examination, evaluation, employment and participation in social activities.

Chapter V Risk Prevention

Thirty-third city, county (city), District People's governments and their relevant departments shall take measures to strengthen the risk prevention of private schools and ensure social stability.

Thirty-fourth private schools should set up a school-running risk protection fund, which is specially used to deal with the remaining problems such as tuition fees, miscellaneous fees and other expenses that should be refunded to students and salaries that should be paid to faculty and staff after the school is closed or dissolved.

The following measures shall be taken for the extraction, storage and use of the school-running risk guarantee fund:

1. When applying for the bid, a private school shall deposit a school-running risk deposit with a total amount of half-year tuition fees for students enrolled in this school year and three months' salaries for all faculty members in the bank designated by the examination and approval authority. After the school is opened, 2% of the tuition fees charged by students will be withdrawn every year (including existing private schools). When the risk guarantee fund has accumulated to 50% of the total assets of the school, it can no longer be withdrawn.

2 private educational institutions (refers to all kinds of cultural and educational training classes and cram schools, etc.). ) When bidding, deposit RMB 20,000 in the bank designated by the examination and approval authority.

3. The risk deposit belongs to the school property, stored in a special account, and the interest belongs to the school. The school can use the risk guarantee fund for large-scale project construction and equipment purchase in the school, but the cumulative use within one year shall not exceed 50% of the total risk guarantee fund, and the expenditure shall be supplemented in the next year. No organization or individual may occupy or misappropriate the risk deposit and its interest.

4. After private schools and private educational institutions have been closed for six months and there are no remaining problems, with the consent of the school-running examination and approval authority, the bank may refund the principal and interest of the school-running risk deposit deposited by private schools and private educational institutions to the organizers in full.

5. If the sponsor of a private school refuses to accept the behavior of the school-running examination and approval authority to refund the school-running risk guarantee fund, he may apply to the people's government at the same level for review, and the people's government shall make a reply within 7 days.

Chapter VI Legal Liability

Article 35 The education administrative department or the labor security administrative department of the municipal, county (city) and district people's governments may, in accordance with the provisions of Article 64 of the Law on the Promotion of Private Education, order private schools held without authorization before the promulgation of these Measures to go through the examination and approval procedures within a time limit; Private schools held without authorization that do not meet the conditions prescribed by laws and regulations shall be ordered to rectify within three months; Those who fail to meet the requirements stipulated by laws and regulations within the time limit shall be ordered to stop running schools.

Article 36 If a private school issues false enrollment brochures or advertisements to defraud money, the administrative department for industry and commerce shall, in accordance with the provisions of Article 62 of the Law on the Promotion of Private Education, order it to make corrections within a time limit, refund the fees collected, confiscate the illegal income and give it a warning; If the circumstances are serious, the examination and approval authority shall order it to stop enrolling students and revoke its school license; If a crime is constituted, criminal responsibility shall be investigated according to law.

Article 37 Where the examination and approval authorities of private schools and other relevant departments and their staff abuse their powers, neglect their duties or engage in malpractices for selfish ends, the higher authorities or their units shall order them to make corrections in accordance with the provisions of Article 63 of the Law on the Promotion of Private Education; If the circumstances are serious, the directly responsible person in charge and other directly responsible personnel shall be given administrative sanctions according to law; Causing economic losses, it shall be liable for compensation according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Chapter VII Supplementary Provisions

Thirty-eighth overseas organizations and individuals to run private schools in the form of cooperation, according to the relevant provisions of the state and province.

Article 39 The county (city) and district people's governments may formulate specific measures to promote the development of private education in their respective administrative regions in accordance with the Law of People's Republic of China (PRC) on the Promotion of Private Education, the Regulations for the Implementation of the Law of People's Republic of China (PRC) on the Promotion of Private Education and these Measures, and in light of local conditions.

Article 40 Matters not covered in these Measures shall be implemented in accordance with the Education Law of the People's Republic of China, Compulsory Education Law of People's Republic of China (PRC), Education Promotion Law of the People's Republic of China, Private Education Promotion Law of People's Republic of China (PRC), Regulations for the Implementation of Education Promotion Law of the People's Republic of China and Regulations for the Implementation of Private Education.

Article 41 These Measures shall come into force as of June 6, 2006. 1On March 9, 993, the Municipal People's Government issued the Measures for the Implementation of the Management of Social Forces in Jiaozuo City, which shall be abolished at the same time.
