According to the needs of the construction and development of the Pilot Free Trade Zone, these Regulations shall apply to the expanded scope of the Pilot Free Trade Zone approved by the State Council. Article 3 Promote the construction of the Pilot Free Trade Zone into an important demonstration zone of open maritime doors in eastern China, an experimental zone of international commodity trade liberalization and investment facilitation, and a resource allocation base with international influence, enhance the global allocation capacity of commodities with oil as the core, and explore the construction of a free trade port. Article 4 The Pilot Free Trade Zone shall be encouraged and supported to try first on matters not prohibited by laws and regulations, and explore reform and innovation.
If there are mistakes in reform and innovation, but they are in line with the reform direction determined by the state and the province, the decision-making procedures are in line with laws and regulations, they are diligent and conscientious, do not seek personal gain, take the initiative to recover losses, eliminate adverse effects or effectively prevent harmful results, they will not make negative comments on the relevant units and individuals and be exempted from relevant responsibilities. Chapter II Management System Article 5 The Pilot Free Trade Zone promotes the reform of simple administration and decentralization, the combination of decentralization and management, and the optimization of services, and establishes an administrative management system with clear powers and responsibilities, efficient management, openness and transparency, and coordinated operation.
Matters applied by natural persons, legal persons and unincorporated organizations in the Pilot Free Trade Zone shall be settled at one time if the application materials are complete and meet the statutory acceptance conditions, except those that cannot be settled at one time as stipulated by laws and regulations. Article 6 The provincial people's government shall set up a deliberation and coordination body in the Pilot Free Trade Zone, which shall be responsible for organizing, leading and coordinating the construction and development of the Pilot Free Trade Zone, and studying and deciding on major issues concerning the reform and development of the Pilot Free Trade Zone.
The office of the deliberation and coordination body of the Pilot Free Trade Zone is located in the Provincial Department of Commerce, which undertakes the daily work of the deliberation and coordination body of the Pilot Free Trade Zone, coordinates the pilot tasks of the reform of the Pilot Free Trade Zone, organizes and implements the replication and promotion of the innovative experience and achievements of the Pilot Free Trade Zone, and performs other duties entrusted by the provincial people's government. Article 7 The Administrative Committee of China (Zhejiang) Pilot Free Trade Zone (hereinafter referred to as the Administrative Committee) is an agency of the provincial people's government, which is responsible for the construction and management of the pilot free trade zone and performs the following duties:
(a) responsible for the implementation of the "China (Zhejiang) Pilot Free Trade Zone Overall Plan", the implementation of national and provincial policies and measures related to the Pilot Free Trade Zone, and the formulation of administrative management system;
(2) Organizing the implementation of various development plans of the Pilot Free Trade Zone, and coordinating and promoting the reform pilot tasks and the construction of major investment projects;
(3) To be responsible for the administration of investment and trade, financial services, investment attraction, development and construction, human resources and statistics in the Pilot Free Trade Zone, and improve the supervision system after the event;
(four) to coordinate the administrative work of customs, inspection and quarantine, maritime affairs, border inspection, marine police, financial supervision, national tax and other departments in the Pilot Free Trade Zone;
(five) to perform the duties related to intellectual property protection according to law, and cooperate with the anti-monopoly review and national security review;
(6) To release all kinds of public information in the Pilot Free Trade Zone as a whole, and carry out external contacts and exchanges;
(seven) to perform other duties entrusted by the provincial people's government.
Encourage the Pilot Free Trade Zone to establish a relatively centralized administrative licensing system and mechanism, and the administrative committee shall exercise the administrative licensing right of the Municipal People's Government and its relevant departments where the Pilot Free Trade Zone is located. The specific matters of relatively centralized administrative license shall be implemented after approval in accordance with the regulations. Article 8 The provincial people's government shall, according to the needs of the development, construction, reform and innovation of the Pilot Free Trade Zone, grant the relevant provincial management authority to the CMC according to law.
Belonging to the management authority of the provincial people's government and its relevant departments, the provincial people's government and its relevant departments may entrust the CMC to exercise it, except that laws and administrative regulations clearly stipulate that it cannot be entrusted.
The CMC may, according to the needs of development, put forward the catalogue of exercising provincial management authority, and announce it to the public after being reported to the competent department for approval in accordance with legal procedures. Article 9 The customs, inspection and quarantine, maritime affairs, border inspection, marine police, financial supervision, national tax and other working institutions in the Pilot Free Trade Zone (hereinafter referred to as the working institutions in the Zone) shall perform relevant management duties according to law, implement relevant policies and measures in the Pilot Free Trade Zone, and support the reform and innovation in the Pilot Free Trade Zone.
The relevant departments of the provincial people's government shall, in accordance with the prescribed duties, support the work of the Pilot Free Trade Zone and undertake the relevant administrative affairs of the Pilot Free Trade Zone.
The CMC shall establish and improve the communication and coordination mechanism with the working institutions and relevant departments in the region. Article 10 The Pilot Free Trade Zone may establish an administrative consultation mechanism to provide decision-making consultation for the development planning, introduction of major projects and important reform measures of the Pilot Free Trade Zone.
Management Committee, accredited institutions and relevant departments can learn from international practice, entrust social organizations or hire professional teams to undertake professional, technical or social participation in public management and service functions. Article 11 The Administrative Committee, the working institutions in the area and the relevant departments shall publish a list of administrative powers such as administrative license, administrative penalty and administrative coercion exercised according to law, as well as a list of responsibilities for defining the responsibilities of institutions, the supervision system after the event and public service matters.
If the rights and responsibilities change, the CMC, the dispatched offices and the relevant departments shall timely adjust the list and re-announce it.
