Trademark transfer mainly has the following risks:

1, two transfers of trademarks

After concluding a trademark assignment contract with the first assignee, the trademark assignor conceals the above facts, and then concludes a trademark assignment contract with the second assignee. From the point of view of contract, first of all, the first trademark transfer contract was established and came into effect, while the second contract was a revocable contract (because the trademark assignor concealed from the trademark assignee the fact that it had previously concluded a trademark transfer contract with others). Where the transferee of the second trademark knows the facts concealed by the trademark assignor and fails to exercise the right of revocation, the transferee of the second trademark shall be the second. 2. The responsibility for trademark transfer has been determined.

Some trademarks to be transferred have been pledged by trademark owners, or have been licensed to others (and registered in the Trademark Office), or have been applied for cancellation by others. The above burden will seriously affect the smooth transfer of trademarks. For example, the dispute arising from the transfer of "Oni" trademark is such. In this case, Guangzhou Libai Company spent a huge sum of money to acquire the "Aoni" trademark, but did not notice that the owner of the "Aoni" trademark had previously exclusively licensed the trademark to a company in Hong Kong, and the license had been filed. In this case, there is a dispute about who should use the "Oni" trademark. In fact, if Guangzhou Libai Company conducts a trademark inquiry before accepting the "Aoni" trademark, it will be easier to find out whether the "Aoni" trademark to be purchased has been burdened, thus providing reference for whether to buy it at such a high price. 3. Before accepting the trademark, the transferee of the trademark to be transferred that has not been renewed at the expiration date must check and confirm the service period of the trademark, which is indicated on the registration certificate. If the trademark is being renewed or extended, the obligation of renewal must be stipulated in the contract. If the trademark has passed the grace period, it can no longer be wanted, and it must not be sloppy, resulting in the application for trademark transfer not being approved.
