(a) the implementation of labor laws and regulations;
(two) to formulate the labor market development plan and organize its implementation;
(3) macro-control, management, training and coordination of the export of local labor force and the import of foreign labor force;
(four) the implementation of supervision and inspection of the labor market;
(five) the management of employment agencies, issued by the "Guizhou province occupation introduction license". Article 7 Departments of industry and commerce, public security, finance, price control and taxation shall manage the labor market within their respective functions and duties. Chapter II Employment Agencies Article 8 Employment agencies are organizations that provide intermediary services for workers to apply for jobs and employers to recruit personnel.
To set up an employment agency, the labor administrative department shall issue the License for Employment Agency in Guizhou Province. Article 9 To establish an employment agency, the following conditions must be met:
(1) Having an organization, articles of association, clear business scope and management system;
(2) Having a fixed service place and necessary office facilities;
(3) Having three or more full-time staff members who are familiar with labor policies, laws and regulations;
(four) for-profit employment agencies must have a statutory registered capital;
(5) Other conditions stipulated by laws and regulations. Tenth labor administrative departments at all levels can set up public welfare employment agencies, which shall be examined and approved by the people's government at the same level. Eleventh for-profit employment agencies, should hold the relevant information and written reports stipulated in Article 9 of these regulations, apply to the local county and city labor administrative departments. After examination and approval, you can obtain the Employment Permit of Guizhou Province, register with the administrative department for industry and commerce at the same level with certificates and relevant materials, obtain a business license, and go through the tax registration and charging permit before you can start business. Twelfth "Guizhou province occupation introduction license" shall be subject to the annual examination system, and the annual examination shall be organized and implemented by the labor administrative department. Thirteenth occupation introduction agency business scope:
(a) to collect and publish labor supply and demand information and consulting services;
(two) to apply for job registration, employment guidance and introduction;
(3) Recommend qualified workers to the employing units;
(4) introducing family service personnel to families;
(five) contact, organize and guide the workers and employers to negotiate;
(six) to accept the entrustment of the employer to recruit personnel.
The service items and business scope of various employment agencies can be different, which shall be approved by the labor administrative department in charge of approval. Fourteenth public welfare employment agencies established by the labor administrative department are not for profit and should play the role of the main channel of the labor market. Its business scope, in addition to the services listed in Article 13 of this Ordinance, can also provide the following services:
(a) to provide services for cross-regional mobile employment of urban and rural workers, and organize labor cooperation and inter-regional labor export and import.
(two) in accordance with the provisions of the state to carry out employment services to foreign countries and Hong Kong, Macao and Taiwan;
(3) In accordance with the relevant provisions of the state, at the request of migrant workers and employers who do not have the conditions for keeping files, escrow the personnel files of migrant workers;
(four) to undertake other tasks entrusted by the labor administrative department. Fifteenth employment agencies in employment activities, must abide by the relevant laws and regulations of the state, truthfully introduce the relevant information to employers and workers, carefully check the relevant documents of both sides, and safeguard the legitimate rights and interests of both employers and workers. Sixteenth the use of newspapers, periodicals, radio, television and other news media to publish recruitment information should be approved by the labor administrative department at the same level. Seventeenth employment agencies in accordance with the principle of paid service, after the employer and the employee sign a labor contract, they can charge intermediary service fees, and the charging items and standards shall be formulated by the provincial labor, finance and price departments. Eighteenth employment agencies in the introduction activities, shall not have the following acts:
(a) the employment of minors under the age of sixteen;
(2) Introducing female workers or workers who have reached the age of 16 but have not reached the age of 18 to engage in labor prohibited by laws and regulations;
(3) Deceiving job seekers and employers with false information or engaging in illegal intermediary activities by means of threats or temptations;
(four) to expand the scope of occupation introduction;
(five) to increase the fees or raise the fees without authorization;
(six) other occupation introduction activities that infringe upon the legitimate rights and interests of employers and workers and hinder social order;
(seven) other acts in violation of laws and regulations.
