Regulations of Guizhou Province on Township Enterprises
Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Constitution of the People's Republic of China and relevant laws and regulations, combined with the actual situation of our province, for the purpose of prospering the rural economy and wealthy farmers, safeguarding the legitimate rights and interests of township enterprises, and guiding and promoting the sustained, rapid and healthy development of township enterprises. Article 2 The term "township enterprises" as mentioned in these Regulations refers to agriculture engaged in primary, secondary and tertiary industries, which is mainly invested by townships, towns, villages, villagers' groups or rural collective economic organizations, farmers and township residents. Mainly includes:

(1) Enterprises organized by townships, towns, villages, villagers' groups or collective economic organizations;

(2) Enterprises organized by farmers and township residents in cooperation or partnership;

(three) enterprises organized by farmers and township residents;

(4) Rural collective economic organizations or enterprises jointly organized by farmers, township residents, enterprises and institutions, social organizations, individuals and foreign investors;

(5) Other enterprises as stipulated by local people's governments at or above the county level. Article 3 Township enterprises are the leading force of rural economic development and an important part of the national economy. People's governments at all levels should actively support township enterprises, rationally plan, correctly guide and manage according to law, so as to promote their efficiency and accelerate their development. Fourth to encourage and support the development of township enterprises in minority areas and remote and poor mountainous areas.

Encourage and guide the centralized and contiguous development of township enterprises, and build various types of township industrial communities in combination with urban planning.

Encourage qualified township enterprises to form joint-stock cooperative enterprises, joint-stock enterprises or enterprise groups. Fifth township enterprises to implement independent management, independent accounting, self-financing, self-restraint and self-development mechanism.

Township enterprises enjoy the rights of investment decision-making, product and service pricing, product sales, material procurement, asset disposal, self-owned funds control, labor and employment according to law. Article 6 Township enterprises shall adjust their industries and product structures according to market demand and national industrial policies.

Township enterprises should develop, rationally utilize and protect resources according to law. Article 7 The State protects the lawful rights and interests of township enterprises. No organization or individual may transfer, occupy or use the property of township enterprises for free; Shall not interfere with the legitimate production and business activities of township enterprises. Eighth people's governments at all levels and the administrative departments of township enterprises shall commend and reward the units and individuals that have made remarkable achievements in the development of township enterprises. Chapter II Owners, Operators and Workers of Township Enterprises Article 9 Township enterprises shall follow the principle of who invests, who owns and who benefits.

The funds invested by individuals in township enterprises can be transferred, inherited and donated according to law. Tenth township, town, village, village group organized enterprises, the ownership belongs to the collective ownership of farmers in the area where the enterprise is invested, and its ownership is exercised by the collective economic organizations of farmers representing the area.

Part of the farmers, township residents cooperative partnership enterprises, the ownership belongs to the investment in the enterprise * * * with all, and exercise the ownership.

Rural joint-stock cooperative system and joint-stock enterprise, the ownership belongs to the shareholders of the enterprise, and its ownership is exercised by the shareholders' meeting.

The ownership of individual and private township enterprises belongs to investors and shall be exercised according to law. Eleventh owners of township enterprises shall enjoy the following rights according to law;

(1) Obtaining lawful income;

(two) to decide the direction of production and operation and the scale of development of the enterprise;

(3) Electing the organizational form and management form of the enterprise;

(four) to decide the appointment and removal of the factory director (manager);

(5) Deliberating and deciding on corporate finance;

(six) to determine the profit distribution plan of the enterprise;

(seven) refused to apportion and illegal fees and fines. Twelfth owners of township enterprises shall perform the following obligations:

(1) Abide by the laws and regulations of the state and the articles of association of the enterprise concluded according to law;

(two) respect the autonomy of enterprise operators in production and operation, and provide services for the production and operation of enterprises;

(three) to safeguard the legitimate rights and interests of enterprises, business operators and employees;

(four) the establishment, alteration and termination of an enterprise shall go through the formalities of registration, alteration or cancellation with the administrative department of township enterprises, the administrative department for industry and commerce and the tax authorities in accordance with the relevant provisions of the state. Thirteenth township enterprise operators to lead and organize the production and business activities of enterprises. Presided over the preparation and implementation of medium-and long-term development plans, annual production and operation plans, fixed assets investment and technical transformation plans of enterprises; To formulate the annual financial budget, final accounts plan and profit distribution plan of the enterprise; Determine the internal organization of the enterprise and employ employees. Fourteenth township enterprises must establish and improve financial accounting and statistical systems according to law, and pay taxes and fees; To achieve the production and operation objectives of enterprises, ensure product quality, improve economic benefits, promote scientific and technological progress, and enhance the development ability of enterprises; Protect the legitimate rights and interests of workers, do a good job in production safety, prevent and control pollution, and protect resources and the environment. Fifteenth township enterprises shall sign labor contracts in accordance with the law when recruiting and employing employees. Prohibit the use of child labor. Sixteenth township enterprises should gradually improve the welfare and working conditions of their employees, enrich their cultural life, and provide ideological and political, scientific and cultural education and professional and technical training for their employees. Seventeenth township enterprise workers shall enjoy the following rights:

(a) to participate in labor and obtain labor remuneration and enjoy labor protection;

(two) to participate in learning and business training;

(three) put forward reasonable suggestions and opinions on the production and operation of enterprises;

(four) the legitimate rights and interests are violated, and have the right to request the relevant departments to deal with it according to law;

(5) Men and women receive equal pay for equal work, and women workers enjoy special labor protection according to law.
