The development zone is located in Xiaoshan District, Hangzhou. Article 3 The development zones shall implement the preferential policies of the state for the economic and technological development zones of coastal open cities, establish a new management system adapted to the socialist market economy, follow the principles of equality, mutual benefit and common development, introduce capital, advanced technology, advanced equipment and scientific management methods through external introduction, focus on industrial and scientific research and development projects, develop capital, technology-intensive industries and basic industries, set up the tertiary industry, and promote opening up and economic development. Article 4 Enterprises at home and abroad, other economic organizations and individuals are encouraged to invest and set up advanced technology enterprises and export enterprises in the Development Zone, and to build infrastructure such as transportation, energy, communication and environmental protection.
Encourage domestic and foreign enterprises, scientific research institutions, universities, other economic organizations and individuals to carry out various forms of technical cooperation in the development zone, and establish scientific and technological development institutions or science, industry and trade consortia. Article 5 Development zones shall provide investors with a good investment environment. Article 6 The assets, income and other lawful rights and interests of investors in the Development Zone are protected by the laws and regulations of People's Republic of China (PRC) and these Regulations.
Enterprises, units and individuals in the Development Zone must abide by the laws, regulations and these regulations of People's Republic of China (PRC). Article 7 The Xiaoshan Economic and Technological Development Zone Management Committee (hereinafter referred to as the Development Zone Management Committee) shall be established in the Development Zone to exercise unified leadership and management over the work of the Development Zone on behalf of the Xiaoshan District People's Government of Hangzhou. Article 8 The Development Zone Management Committee shall exercise the following functions and powers according to law:
(a) the preparation of the overall planning and economic and social development planning of the development zone, and the organization and implementation after the approval of the Xiaoshan District People's Government of Hangzhou;
(two) to formulate administrative regulations of the development zone and organize their implementation;
(3) Examining and approving investment projects in the Development Zone;
(four) responsible for finance, taxation, state-owned assets, auditing, statistics, labor, personnel, public security and industrial and commercial administration of the Development Zone;
(five) responsible for the planning, requisition, development and management of land in the development zone, the assignment and transfer of land use rights, and the management of construction projects and real estate;
(six) unified planning and management of infrastructure and public facilities in the development zone;
(seven) to ensure that enterprises in the development zone operate independently according to law;
(eight) to manage the import and export trade, foreign economic and technological cooperation and other foreign-related economic activities in the Development Zone;
(9) Handling the foreign affairs of the Development Zone;
(ten) to coordinate and supervise the work of the branches or agencies of the relevant departments in the development zone;
(eleven) responsible for environmental protection, underground resources and cultural relics protection in the development zone;
(twelve) the establishment and management of public welfare undertakings in the development zone;
(thirteen) other functions and powers granted by the Xiaoshan District People's Government of Hangzhou. Article 9 The Administrative Committee of the Development Zone may, according to the needs of its work, set up a number of functional institutions to be specifically responsible for the administrative work of the Development Zone.
The relevant departments of Xiaoshan District People's Government of Hangzhou Municipality shall support and cooperate with the work of the Development Zone Management Committee. Article 10 Foreign exchange management, customs and inspection of import and export commodities in the Development Zone shall be handled directly by the relevant departments or their branches located in the Development Zone. Eleventh in the development zone investment and operation can take the following ways:
(1) Sino-foreign joint ventures;
(2) Sino-foreign cooperative operation;
(3) Wholly foreign-owned operation;
(4) Domestic investors operate independently or jointly;
(5) Compensation trade;
(six) lease or transfer of enterprises in the development zone;
(seven) to buy shares or bonds of enterprises in the development zone;
(8) Other ways permitted by laws and regulations of People's Republic of China (PRC).
Enterprises invested and operated in the ways of items (1), (2) and (3) of the preceding paragraph are hereinafter referred to as foreign-invested enterprises. Twelfth development zones give priority to the introduction of the following advanced technologies:
(a) belongs to the national or local key development of high and new technology;
(two) has a significant role in promoting the technological transformation or product upgrading of domestic enterprises;
(3) Its products can be exported or imported instead;
(four) the production process or manufacturing technology is needed in China;
(five) is conducive to a domestic industry or product to catch up with the world advanced level;
(six) is conducive to the development of local resources. Article 13 The following enterprises shall not be established in the Development Zone:
(a) backward technology or outdated equipment;
(two) environmental pollution and lack of effective control measures;
(three) the laws and administrative regulations of People's Republic of China (PRC) shall not be established. Article 14 An investor who wants to set up an enterprise or institution in the Development Zone shall apply to the Administrative Committee of the Development Zone, and go through the formalities of land use, industrial and commercial registration and tax registration according to law after examination and approval according to the prescribed authority and procedures. Fifteenth enterprises in the development zone should provide civilized, safe and hygienic working conditions for employees and protect their legitimate rights and interests in accordance with the relevant provisions of the state and the province on labor protection.
Enterprises in the Development Zone shall implement the social insurance system in accordance with the relevant provisions of the state and the province.
