First, review.
(1). After receiving the application for registration, the Administration for Industry and Commerce shall first examine whether the application materials are complete and conform to the legal form.
(2) Application materials refer to all materials submitted by the applicant in accordance with the requirements announced by relevant laws, regulations and rules.
(3) The legal form of application materials means that the legal time limit is met, the recorded items meet the legal requirements, and the file format meets the specifications.
Two. Acceptance: After examining the application for registration submitted by the applicant, the Administration for Industry and Commerce shall make a decision on whether to accept it according to the following circumstances:
(1), the application materials are complete and conform to the statutory form, or the applicant has submitted all the corrected application materials according to the requirements of the industrial and commercial bureau, and decided to accept it.
(2) The application materials are complete and conform to the statutory form, but if the Administration for Industry and Commerce considers that the application materials need to be verified, it decides to accept them, and at the same time, it also informs the applicant in writing of the matters, reasons and time that need to be verified.
(3) If there are errors in the application documents and materials that can be corrected on the spot, the applicant is allowed to correct them on the spot, and the applicant shall sign or seal the correction place and indicate the date of correction. If it is confirmed that the application materials are complete and conform to the statutory form, it is decided to accept it.
(4) If the application materials are incomplete or do not conform to the statutory form, the applicant shall be informed of all the contents that need to be corrected on the spot or within 5 days. Informed on the spot, the application materials will be returned to the applicant; If it is notified within 5 days, it shall receive the application materials and issue the credentials for receiving the application materials. Fails to inform, from the date of receipt of the application documents and materials.
(5) If it does not fall within the scope of enterprise registration or the jurisdiction of the administrative department for industry and commerce registration, it will immediately decide not to accept it, and will inform the applicant to apply to the relevant administrative organ.
6. Where the administrative department for industry and commerce applies by letter, telegram, fax or e-mail, it shall make a decision on whether to accept the application within 5 days from the date of receiving the application documents and materials.
Three. Decided that, for an application for registration that has been decided to be accepted, a decision on whether to approve the registration shall be made within the prescribed time limit under the following circumstances:
(1), the Administration for Industry and Commerce accepted the applicant's application and made a decision to approve the registration on the spot.
(2) If an application submitted by the applicant by letter is accepted, a decision to approve the registration shall be made within 15 days from the date of acceptance.
(3) If the application is submitted by telegram, fax or e-mail, the applicant shall submit the original application materials that are consistent with the contents of telegram, fax or e-mail and conform to the legal form within 15 days from the date of receiving the acceptance notice; If the applicant directly submits the original application materials to the Industrial and Commercial Bureau, it may make a decision on approving the registration on the spot; If the original application materials are submitted by letter, the decision to approve the registration shall be made within 15 days from the date of acceptance.
(4) If the original application materials are not received within 60 days from the date when the Administration for Industry and Commerce issues the acceptance notice or are inconsistent with the application materials accepted by the Administration for Industry and Commerce, a decision shall be made not to register.
⑤ If the Administration for Industry and Commerce needs to verify the application materials, it shall make a decision on whether to approve the registration within 15 days from the date of acceptance.
6. In addition to deciding to grant registration on the spot, the industrial and commercial bureau that decides to accept it will issue a Notice of Acceptance; Decided not to accept, issued a "notice of rejection" and indicate the reasons for rejection.
⑦ If the Industrial and Commercial Bureau approves the change registration, it shall issue a notice of approval of the change registration, informing the applicant to obtain the business license within 10 days from the date of decision; If it decides not to register, it shall issue a notice of disapproval and indicate the reasons for disapproval, informing the applicant of the right to apply for administrative reconsideration or bring an administrative lawsuit according to law.
