1. Scope of income
Based on the following personal income, personal income tax should be paid:
(1) Wage and salary income;
(2) Income from remuneration for labor services;
(3) Income from royalties;
(4) Income from royalties;
(5) Business operations Income;
(6) Income from interest, dividends, bonuses;
(7) Income from property leasing;
(8) Income from property transfer;
(9) Accidental income.
Income from wages and salaries; income from labor remuneration; income from author remuneration; income from royalties (hereinafter referred to as comprehensive income), personal income tax shall be calculated based on the tax year; if there is a withholding agent, the personal income tax shall be calculated by The withholding agent shall withhold and pay taxes on a monthly or per-time basis; if it is necessary to handle the final settlement, the withholding agent shall handle the final settlement between March 1 and June 30 of the following year when the income is obtained.
Personal income tax is calculated on a monthly or itemized basis for non-resident individuals’ income from wages and salaries; income from remuneration for labor services; income from author remuneration and royalties, and no final settlement is required.
2. Applicable tax rate
(1) For comprehensive income, an excess progressive tax rate of 3% to 45% is applicable (tax rate table is attached);
(2) Business income is subject to an excess progressive tax rate of 5% to 35% (tax rate table is attached);
(3) Interest, dividends, and bonus income, Income from property rental, property transfer and incidental income is subject to a proportional tax rate of 20%.
3. Special circumstances
The comprehensive income obtained by resident individuals from January 1, 2019 to December 31, 2023, the annual comprehensive income does not exceed 120,000 yuan and requires remittance. If the annual settlement and payment of tax and supplementary tax do not exceed 400 yuan, resident individuals are exempt from the final settlement and settlement of comprehensive personal income tax. This exception applies when resident individuals obtain comprehensive income and the withholding agent fails to withhold and prepay taxes in accordance with the law.
