Three-year Action Plan of Anhui Province for Sustainable Renovation and Normalization of Real Estate Market Order

In order to implement the Notice on Continuously Rectifying and Regulating the Order of the Real Estate Market issued by the Ministry of Housing and Urban-Rural Development and other eight departments, focus on the difficulties and pain points strongly reflected by the people in the housing field, earnestly do a good job in rectifying and regulating the order of the real estate market, safeguard the legitimate rights and interests of the people, and combine the reality of our province to formulate this plan.

I. Work objectives

By continuously stepping up efforts to rectify and standardize the order of the real estate market, we will focus on solving the outstanding problems in the housing sector that are strongly reflected by the people and highly concerned by the society. We will strive to achieve a significant improvement in the order of the real estate market in the province in about three years, effectively curb illegal acts, continuously improve the market supervision system, basically establish a supervision information system, and gradually form a work pattern in which all departments work together. Contradictions and disputes in the real estate sector are significantly reduced, and the number of complaints about housing-related letters and visits is significantly reduced.

Second, the key points of rectification

(1) Real estate development. Real estate development enterprises started construction in violation of laws and regulations; Not according to the construction drawing design documents development and construction; Failing to deliver on schedule as agreed in the house sales contract; The quality problems such as leakage, cracking and hollowing of houses are outstanding; Failing to build supporting facilities according to the construction standards of complete residential communities.

(2) buying and selling houses. Publish false and illegal real estate advertisements and publish false housing information; Property hoarding, hoarding housing; Misappropriation of transaction supervision funds; Taking or assisting in taking non-personal housing loans such as "business loans" and "consumer loans" for purchasing houses; Assist buyers to illegally evade taxes and fees on house transactions; Illegal collection of advance payment, "tea fee" and other fees, disguised price increases; Infringe on consumers' rights and interests by using unfair format clauses; Bundle sales of parking spaces and storage rooms; Fabricating and spreading false information, disrupting market order.

(3) Housing lease. Operating without submitting the opening report; Failing to submit the relevant lease information truthfully and completely as required; The network information platform fails to fulfill the responsibility of verifying the qualification of the information publishing subject; Deduct the rent deposit; Forced eviction of tenants by violence, threats and other means; Carry out housing rental consumer loan business in violation of regulations; There are high-risk business behaviors such as "AG low output" and "long receipt and short payment"; Failing to handle rent supervision as required.

(4) Property services. Failing to provide services in accordance with the contents and standards agreed in the property service contract; Failing to publicize relevant information such as the standards of property service fees, the operation and income of some owners, the use of maintenance funds, etc.; Charge fees beyond the contract or the standard of public charging items; Unauthorized use of part of the owner * * * to carry out business activities, embezzlement, misappropriation of part of the owner * * * operating income; After the property service contract is dissolved or terminated according to law, it refuses to withdraw from the property service project without justifiable reasons.

Third, effectively carry out rectification according to law

(1) Collect problem clues through multiple channels. All localities should conduct a comprehensive investigation on real estate development, housing sale, housing leasing, property services and other fields, and promptly publish the report telephone number and open the report mailbox on the news media, government hotline and portal website. Violations of laws and regulations reported by the masses or exposed by the media should be investigated and dealt with in a timely manner according to law. Dock with the petition department, comprehensively sort out the petitions and complaints in the real estate field in recent years, and find clues to the problem. Combined with the "double random and one open" spot check and special inspection, the list of remediation problems was supplemented and improved.

(two) the establishment of rectification work ledger. All localities should sort out the problems one by one, check and verify them, establish a rectification work account by classification, and form a "four lists" (that is, a list of problems, a list of causes, a list of responsibilities, and a list of measures). It is necessary to establish a transfer and supervision mechanism, regularly supervise and dispatch, implement sales number management, achieve "in and out", rectify one and one sales number, and dynamically adjust the ledger list.

(3) to investigate and deal with violations of laws and regulations. All localities should strengthen departmental coordination and concentrate their efforts. Real estate development enterprises, intermediaries, housing leasing enterprises, property service enterprises, financial institutions, online media and employees who violate laws and regulations in this region shall take warning interviews, suspend business for rectification, revoke business licenses and qualification certificates and other measures according to law, and make public exposure; Suspected of a crime, transferred to the public security and judicial departments to investigate and deal with according to law. Focus on the supervision of enterprises with major operational risks, such as overdue debts, large-scale delay in delivery of houses, and more negative overdue grievances.

(4) Establish a long-term supervision mechanism while checking and changing. It is necessary to comprehensively analyze the existing blind spots and loopholes in the supervision of the matters investigated, timely adjust and improve relevant policies in conjunction with relevant departments, improve supervision measures, and tighten the cage of the system.

Fourth, the implementation steps

(1) Mobilization and deployment and self-examination and self-correction. (before the end of September 20021year)

All localities should refine the plan as soon as possible and hold mobilization meetings for deployment. Urge all real estate developers, intermediaries, property services and relevant financial institutions to carry out self-examination and self-correction in accordance with the requirements of national and provincial special rectification, and correct the existing violations of laws and regulations by themselves, and submit written materials for self-examination and self-correction to the local competent department.

1. Comprehensive review. Local authorities should conduct a strict review on the basis that the self-inspection rate of enterprises reaches 100%. To arrange the progress reasonably, in principle, within three years, the review rate of projects (enterprises) that are being sold, under construction and providing services should reach 100%.

2. Focus on inspection. Recently, focus on the inspection of bad enterprises whose letters and visits from the masses and complaints are concentrated and exposed by the media, with an annual inspection coverage of not less than 25%. The verified violations of laws and regulations shall be handled in a timely manner according to law.

3. Guidance and supervision. The joint meeting of the provincial real estate market regulation will organize relevant member units to monitor, evaluate and assess the overall situation, self-examination, review and key inspection of the real estate market order rectification in various cities.

The third stage: the establishment of rules and regulations and the improvement of supervision level. (throughout the whole process)

All localities should thoroughly analyze the root causes of the problems behind the investigation, study and establish a sound market supervision and internal supervision mechanism, focus on filling shortcomings from the source, and promote long-term and long-term special rectification. It is necessary to enhance the ability of the supervision team and strengthen the construction of professional skills and style.

V. Job Requirements

(1) Strengthen coordination and linkage among departments. The department of housing and urban-rural construction (real estate management) is responsible for leading the organization and implementation of this special rectification, formulating an action plan, organizing a thorough self-examination, handing over clues to problems, summarizing the treatment results, summarizing the information, and investigating and handling illegal acts in the real estate field in conjunction with relevant departments according to their duties. Urban and rural construction departments are responsible for investigating and dealing with illegal construction and housing quality of real estate development projects. The urban management department is responsible for timely receiving cases transferred by relevant departments, exercising the right of punishment according to law, and strengthening the connection between urban management law enforcement and residential property management supervision. The development and reform department is responsible for incorporating illegal information in the real estate field into the national credit information sharing platform, and promoting all departments to jointly punish relevant enterprises and employees for dishonesty according to laws and regulations. The public security department is responsible for investigating suspected criminal acts such as contract fraud and illegal fund-raising in the real estate sector. Natural resources and planning departments are responsible for investigating and dealing with problems such as starting work without obtaining land according to law and regulations. The tax department is responsible for investigating and dealing with illegal evasion of taxes and fees on housing transactions. The market supervision department is responsible for investigating and dealing with false and illegal real estate advertisements, illegal prices, and infringement of consumers' rights and interests by using unfair format terms. In accordance with the national division of labor, the financial management department is responsible for investigating and dealing with illegal and illegal issues such as illegal flow of credit funds into the real estate market and illegal provision of financial support for bid bond and land price. The petition department is responsible for sorting out the outstanding problems of letters and visits in the housing field and cooperating with the settlement of contradictions and disputes. The network information department is responsible for investigating and dealing with issues such as publishing false real estate information through the network.

Leading departments in all localities should take the initiative to take the lead, and jointly with relevant departments, improve the work consultation mechanism, rationally dispatch law enforcement forces, investigate and deal with them according to laws and regulations, report the progress of the ledger on time, urge the implementation of rectification, and promote the detailed implementation of rectification work.

(two) the establishment of special classes. In Hefei, Fuyang, Chuzhou, Bengbu, Suzhou, Bozhou, Wuhu and other cities with contradictions and disputes in the real estate field and a large number of complaints and letters from the masses, in order to ensure that the special rectification work is carried out in an orderly manner, a leading group for rectifying and standardizing the real estate market order should be established and reported to the municipal leaders as the team leader to coordinate and solve outstanding problems. Under the leading group, there is an office, a special work class is set up, and personnel from relevant departments are transferred to work in a centralized manner to ensure that the special rectification actions are carried out in a solid manner.

(3) Strengthen supervision, evaluation and assessment. The local leading departments should submit the work ledger to the Provincial Department of Housing and Urban-Rural Development before the end of each month, and submit the work development, typical cases and experiences and practices at the end of each quarter. The Provincial Department of Housing and Urban-Rural Development reports the progress of local work every six months, and sends a copy to the relevant state departments and the municipal people's governments. In accordance with the requirements of the state and the province to implement the evaluation and assessment measures for the regulation and control of the real estate market, commend the cities with effective rectification work and obvious results; Conduct interviews and accountability for cities with outstanding problems in the real estate market order and failing to fulfill their regulatory responsibilities in a timely and proper manner.

(4) Correctly guide public opinion. All localities should comprehensively use newspapers, television, radio, Internet and other news media, strengthen positive publicity, correctly guide public opinion, timely summarize and promote the rectification work practices, experiences and achievements, publicly expose typical cases of violations of laws and regulations, and play a warning and deterrent role. The website of the housing and urban-rural construction department should open a column for publicity and reporting, form a strong rectification atmosphere, and create a good public opinion environment for the rectification work.
