Haojiang District, Chenghai District, Chaoyang District, Chaonan District and Nanao County real estate administrative departments are responsible for the supervision and management of commercial housing sales within their respective administrative areas.
The administrative departments of development and reform, land and resources, urban and rural planning, housing and urban and rural construction, price, state-owned assets management, press, publication, radio and television, civil affairs, justice, industry and commerce, taxation, banking supervision and management shall, according to their respective functions and duties, do a good job in the sales management of commercial housing. Article 5 The municipal real estate administrative department shall, jointly with the relevant district (county) real estate administrative departments, establish a real estate information network management system and a commercial housing online signing system in the Special Zone, dynamically monitor the commercial housing sales activities in the Special Zone, and timely, accurately and comprehensively release the commercial housing sales market information to the society. Article 6 Social organizations in the real estate industry shall carry out activities according to the articles of association, urge real estate development enterprises, real estate brokerage institutions and their employees to abide by laws, regulations, rules and industry self-discipline norms, organize business training and continuing education, and do a good job in information communication, industry self-discipline and professional ethics education.
Social organizations in the real estate industry shall accept the guidance of the real estate administrative department. Chapter II Pre-sale Permit and Record-keeping of Spot Sale Article 7 The Special Zone shall implement the system of pre-sale permit for commercial housing and the record-keeping system of spot sale of commercial housing. Eighth real estate development enterprises should obtain the pre-sale permit of commercial housing before they can pre-sell commercial housing, and those who have not obtained the pre-sale permit may not pre-sell. Article 9 A real estate development enterprise applying for a pre-sale permit for commercial housing shall meet the following conditions:
(a) to obtain a real estate development qualification certificate and business license;
(two) delivery of land use rights transfer fees, land use rights certification documents;
(3) Obtaining a construction project planning permit and a construction project construction permit;
(four) to determine the construction schedule and completion delivery time;
(five) submit the commercial housing sales plan;
(6) Opening a special account for the proceeds from the pre-sale of commercial housing (hereinafter referred to as the pre-sale payment) in a commercial bank in the Special Zone, and signing a supervision agreement for the pre-sale payment with the real estate administrative department and the bank that opened the special account for the pre-sale payment (hereinafter referred to as the bank);
(seven) to formulate the preliminary property management plan and handle the property management area for the record;
(eight) to obtain the results of the prediction of the area of commercial housing projects issued by surveying and mapping institutions with corresponding qualifications;
(nine) the commercial housing project and the land use right within its occupation scope have not been mortgaged, or the mortgage has been set but has been agreed in writing by the mortgagee;
(ten) the funds invested in development and construction have reached more than twenty-five percent of the total investment of the project. The project image progress of commercial housing projects has reached the corresponding standards: completed foundation and structural projects below three floors; There is no basement project between four floors and thirty-two floors, and the foundation and four-story structure project have been completed; If there is a basement project with more than four floors and less than thirty-two floors, the foundation and the first floor (including basement) structural project have been completed; Completed foundation and four-story (including basement) structural engineering with more than thirty-two floors;
(eleven) involving the naming and renaming of place names, and obtaining the approval documents of standard place names;
(twelve) other conditions stipulated by laws and regulations.
The municipal real estate administrative department may, according to the market conditions, adjust the project image progress standard of commercial housing projects on the premise of not being lower than the standard specified in Item (10) of the preceding paragraph, and implement it after being approved by the Municipal People's Government. Tenth real estate administrative departments shall, within ten working days from the date of accepting the application for pre-sale permit of commercial housing, review the application materials and conduct on-site investigation, and issue the pre-sale permit of commercial housing if it meets the conditions; Do not meet the conditions, shall not be issued and a written explanation.
The pre-sale permit for commercial housing shall specify the name of the real estate development enterprise and the location, building number, floor and construction area of the commercial housing project, and indicate the location and building number of the commercial housing project in the attached drawings. Eleventh real estate administrative departments to make a decision to approve the pre-sale permit of commercial housing, should be made public on the portal website and real estate information network management system, to facilitate public access. Article 12 Commercial housing projects may apply for issuing pre-sale permits of commercial housing by stages and blocks, and may not apply for issuing pre-sale permits of commercial housing by layers and blocks. However, if commercial housing projects jointly developed by different construction units or individuals cannot be applied for as a building due to the scope of division, a single building shall apply for the part of commercial housing in one lump sum.
