Article 5 stipulates that:

Enterprises engaged in foreign labor service cooperation shall meet the following conditions and obtain the qualification certificate for foreign labor service cooperation:

(1) Having the qualification of a legal person; Having paid-in capital not less than the prescribed limit of registered capital;

(2) Having a fixed business place and infrastructure suitable for foreign labor service cooperation;

(3) Having managers with knowledge and skills in foreign labor service cooperation;

(4) Having a sound internal management system and an emergency handling system;

(5) The legal representative has no intentional criminal record.

Regulations on the Administration of Foreign Labor Service Cooperation

Article 6 stipulates that:

An enterprise applying for the qualification certificate of foreign labor service cooperation shall submit the certification materials that meet the conditions stipulated in Article 5 of these regulations to the competent commercial department of the local provincial or municipal people's government. The competent commercial department that receives the application materials shall review it within 20 working days from the date of receiving the application materials and make a decision on whether to grant or not to grant the license. If the license is granted, the qualification certificate for foreign labor service cooperation shall be issued; If the license is not granted, notify the applicant in writing and explain the reasons.
