Article 5 Ready-mixed concrete shall be used in the following construction projects, and it is forbidden to mix concrete at the construction site:
(a) national, provincial and municipal key projects;
(2) Large-scale public works;
(three) the construction area of more than 4000 square meters or more than eight floors of concrete structure engineering;
(four) the use of concrete more than 5000 cubic meters or a use of more than 30 cubic meters of engineering projects. Article 6 The construction projects listed in Article 5 of these Measures may be mixed with concrete at the construction site with the approval of the municipal administrative department of construction in any of the following circumstances:
(a) due to special requirements such as rapid setting, ready-mixed concrete production enterprises can not meet their requirements;
(two) other unfavorable use of ready mixed concrete. Article 7 Ready-mixed concrete enterprises shall have the corresponding qualifications stipulated by the state and meet the national industrial policies and environmental protection requirements; Do not have the corresponding qualifications and other relevant conditions stipulated by the state, shall not sell ready-mixed concrete.
The establishment of ready-mixed concrete production enterprises shall conform to the urban planning and rational layout of this Municipality, and concrete mixing stations shall not be set up in urban built-up areas; Before the promulgation of these measures, the concrete mixing station established in the urban built-up area shall move out of the urban built-up area within two years from the date of promulgation of these measures. Article 8 Ready-mixed concrete production enterprises shall establish corresponding laboratories, establish and improve quality management and quality assurance systems in accordance with national standards, provide relevant technical data to users in a timely manner, and accept supervision and inspection by engineering quality supervision institutions. Article 9 Bulk cement shall be used in the production of ready-mixed concrete, except for special needs and restrictions of bulk transportation conditions. Article 10 The price of ready-mixed concrete shall be implemented in accordance with the current relevant national price regulations. Eleventh ready mixed concrete supply and demand sides shall sign a contract according to law, and strictly perform the contract. Article 12 Where a special vehicle (including a pump truck) for transporting ready-mixed concrete needs to pass through the urban area, it shall drive according to the prescribed time limit and route with the pass issued by the traffic police department of the public security; Except for vehicles that transport ready-mixed concrete for mass concrete projects that must be continuously poured, commuting vehicles should avoid peak hours; Parking vehicles shall not affect traffic.
The traffic police department of the public security shall, according to the construction project and the construction period, timely issue the pass for the ready-mixed concrete special vehicle, and the pass shall specify the passage route and the passage period. Thirteenth ready mixed concrete vehicle drivers should strictly abide by the laws, regulations and rules of road traffic management, and shall not affect traffic, block roads and park vehicles at will.
If the special vehicle for transporting ready-mixed concrete violates regulations during transportation, but has not caused a major accident, the public security traffic police shall promptly handle and release it; If it cannot be handled on the spot, the violation shall be recorded and the time and place for handling shall be informed before release. Fourteenth in violation of the provisions of these measures, one of the following acts, the municipal construction administrative department shall order it to make corrections within a time limit and impose a fine of 30000 yuan to 10000 yuan:
(a) mixing concrete at the construction site without authorization in the ready-mixed concrete construction project;
(two) do not have the qualifications prescribed by the state to sell ready-mixed concrete;
(three) the establishment of concrete mixing stations in urban built-up areas;
(four) the ready-mixed concrete production enterprise fails to use bulk cement in accordance with the provisions;
(five) the ready-mixed concrete production enterprise fails to establish the laboratory and quality management and guarantee system in accordance with the provisions. Article 15 Other acts of construction units and ready-mixed concrete enterprises that violate the provisions of these Measures shall be punished by the construction administrative department or the relevant administrative departments of environmental protection, public security, industry and commerce in accordance with the provisions of relevant laws, regulations and rules. Article 16 If the staff of the administrative departments of construction, environmental protection and public security neglect their duties, abuse their powers or engage in malpractices for selfish ends in the management of ready-mixed concrete, they shall be given administrative sanctions by their units or higher authorities; If the circumstances are serious enough to constitute a crime, they shall be submitted to judicial organs for criminal responsibility according to law. Article 17 Yuzhong County, Yongdeng County, Gaolan County and Honggu District shall actively promote the use of ready-mixed concrete technology in construction projects according to the tenth five-year plan for the development of bulk cement, and manage the production, supply, transportation and use of ready-mixed concrete with reference to these measures; By March 2004 1, the goal of prohibiting concrete mixing in construction sites in urban built-up areas will be achieved.
